46 Manufactured Home Zone MH

Section 16.46.010 Purpose

The purpose of the manufactured home (MH) zone is to provide appropriate areas for suitable development of manufactured home parks and manufactured home subdivisions. It is also to ensure that such facilities receive adequate service and blend harmoniously with surrounding residential neighborhoods.

Section 16.46.020 Permitted Uses

The following buildings, structures and uses of land shall be permitted upon compliance with the requirements set forth in this title:

  1. Accessory buildings and uses customarily incidental to any permitted use;
  2. Temporary buildings for use incidental to construction work, such buildings shall be removed upon completion or abandonment of the construction work;
  3. Single-family manufactured home subdivisions in accordance with the site development standards set out in this chapter and the standards prescribed by Chapter 16.58, Vernal City subdivision regulations, of this title;
  4. Single-family dwellings meeting the International Residential Code as adopted by Vernal City and dwelling, internal additional.
  5. Household pets not to exceed a combination of four (4) pets over the age of four (4) months.
  6. Day care nursery's which have been approved by the State Health and Welfare Department and are eligible for licensing by the State.
  7. Towers
    1. Amateur radio.
    2. Low power radio.
    3. Small cellular.
  8. Urban farms
  9. Portable Storage Containers.

Section 16.46.030 Conditional Uses

The following uses shall be permitted only when authorized by a conditional use permit, as provided in Chapter 16.14 of this title:

  1. Manufactured home parks, provided such parks meet the requirements and standards prescribed in Chapter 16.56, Vernal City manufactured home park regulations, of this title;
  2. Residential facilities for the elderly for eight (8) or less individuals, owned by one (1) of the individuals or an immediate family member of one (1) of the individuals residing at the facility or for which the title has been placed in trust for a resident, that also complies with the following:
    1. The facility conforms to all applicable health, safety and building codes,
    2. The facility is capable of use as a residential facility for elderly persons without structural or landscaping alterations that would change the structure's residential nature,
    3. No other residential facility for elderly persons shall be established within three-quarters (3/4) of a mile of another existing residential facility for elderly persons or residential facility for handicapped persons;
  3. Residential facilities for the handicapped for (8) or less individuals under the supervision of a house family or manager on a twenty-four (24) hour per day basis and complying with Department of Human Services standards and requirements and be operated by or operated under contract with that department, that also complies with the following:
    1. No person being treated for alcoholism or drug abuse shall be placed in a residential facility for handicapped persons,
    2. No person who is violent shall be placed in a residential facility for handicapped persons,
    3. Placement in a residential facility for handicapped persons shall be on a strictly voluntary basis and shall not be a part of, or in lieu of confinement, rehabilitation or treatment in a correctional institution,
    4. The facility shall conform to all applicable health, safety and building codes,
    5. The facility is capable of use as a residential facility for handicapped persons without structural or landscaping alterations that would change the structure's residential nature,
    6. No other residential facility for handicapped persons shall be established within three-quarters (3/4) of a mile of another existing residential facility for elderly persons or residential facility for handicapped persons,
    7. That the operator of the facility shall establish a City advisory committee through which all complaints and concerns of neighbors shall be initially addressed,
    8. The operator of the facility shall provide adequate off-street parking.
  4. Bed and Breakfast homes as outlined at 16.22.035 of this title.
  5. Tower, low power radio.
  6. Long term RV parks, provided such parks meet the requirements and standards prescribed in Chapter 16.56.

Section 16.46.040 Manufactured Home Subdivisions -- Site Development Standards

The following site development standards apply to manufactured home subdivisions:

  1. Minimum area: four (4) acres;
  2. Minimum lot size: seven thousand (7,000) square feet;
  3. Minimum lot width: seventy (70) feet;
  4. Minimum yard setbacks:
    1. Front: twenty-five (25) feet, except ;
      1. Lots on the periphery of a manufactured home subdivision abutting a different land use. In such cases, a greater setback may be required as part of the Planning Commission review.
      2. Bus shelters.
        1. Bus shelters must not interfere with ADA accessibility or pedestrian movements.
        2. Must be set back a minimum of five (5) feet from a barrier curb or where no curb is present, behind the edge of the sidewalk or ten (10) feet back from edge of travel way.
        3. Bus shelters must not interfere with any clear vision triangle.
        4. The entity installing the bus shelter shall be responsible for its maintenance.
    2. Side:
      1. Home: Eight (8) feet on each side, except for lots on the periphery of a manufactured home subdivision abutting a different land use. In such cases, a greater setback may be required as part of the Planning Commission review,
      2. Accessory building: Six (6) feet, except one (1) foot if located at least five (5) feet from the rear of the manufactured home,
      3. Side facing street on corner lot: fifteen (15) feet,
    3. Rear:
      1. Home (dwelling): twenty-five (25) feet,
      2. Accessory building: one (1) foot, except five (5) feet where accessory building rears on side yard of adjacent corner lot;
  5. Lot coverage: no main structure and accessory structures shall cover more than sixty (60) percent of the lot area;
  6. Building height:
    1. Minimum: one (1) story or ten (10) feet ,
    2. Maximum: two (2) story or twenty-five (25) feet.

Section 16.46.050 Manufactured Home Subdivisions -- Building Permit Required Prior To Placement

A building permit shall be required before any home is located on a lot in a manufactured home subdivision.

Section 16.46.060 Manufactured Home Subdivisions -- Compliance With HUD Standards

The home must comply with the 1976 HUD Manufactured Housing Standards and must be at least eighteen (18) feet in width. The home shall have proof of meeting the HUD standards.

Section 16.46.070 Manufactured Home Subdivisions -- Wheels To Be Removed -- Foundation Required

Each manufactured home in the subdivision must have its wheels removed and the home must be placed on a foundation and anchored to the foundation to City standards.

Section 16.46.090 Manufactured Home Subdivisions --Skirting

Each home shall be skirted with decorative masonry, blocks, brick skirting or a continuation of the facing material of the home.

Section 16.46.100 Manufactured Home Subdivisions -- Parking

There shall be two (2) off-street parking spaces provided on the same lot with each home. The spaces shall be located in an area that could be covered by a carport or within which a garage could legally be built.

Section 16.46.110 Manufactured Home Subdivisions -- Streets

Streets within a manufactured home subdivision may be public or private, as determined in the best interests of the public welfare by the Planning Commission.

Section 16.46.120 Manufactured Home Subdivisions -- Fencing

The Planning Commission may require perimeter fencing of the manufactured home subdivision as it deems necessary to protect property values, prevent trespass or in the interest of physical safety.

Section 16.46.130 Manufactured Home Subdivisions -- Homeowners' Association

Each manufactured home subdivision may be required to establish a nonprofit homeowners' corporation to own property on which owner recreation or service facilities are developed to establish rules, regulations and to enforce restrictive covenants placed upon the property and to own and be responsible for private streets if such are allowed by the City in the subdivision.

Section 16.46.140 Use As Model Home

Manufactured homes within a manufactured home park may be used as a model manufactured home and a sales office for the sale of manufactured homes.
