56 Manufactured Home Park And Travel Trailer Court Regulations

Section 16.56.010 Definitions

"Hard surface" means a surface constructed of asphalt or concrete.

"Manufactured home" means a structure, transportable in one (1) or more sections, which, in the traveling mode, is eight (8) body feet or more in width or forty (40) body feet in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning and electrical systems contained therein, and constructed in accordance with the "Manufactured Housing Construction and Safety Standard Act of 1974," and shall bear a data plate in accordance to (Part 3280.5 - Data Plate) of the HUD Code.

"Mobile home" means a transportable factory housing structure prior to 1976.

"Manufactured home park" means an area or tract of land dedicated to the use, and licensed as an area, for parking and utilization of manufactured homes.

"Skirting" means a continuation of the facing material of the manufactured home or a decorative masonry, block, brick, vinyl material that is architecturally compatible with the manufactured home and is installed. Skirting must be of substantial strength to withstand winds or erosion.

"Travel trailer" or "camper" means all units, other than manufactured homes as defined in this section, which are mobile and are primarily used or maintained as a temporary dwelling for travel, vacation or recreational purposes.

"Travel trailer court" means a tract of land dedicated to be used as, and licensed as an area for parking and utilizing travel trailers or campers.

Section 16.56.020 Manufactured Home Park Regulations -- Approval -- Intent

  1. The owners of a tract of land not less than four (4) acres, which land lies in an MH zone may construct a manufactured home park thereon upon compliance with regulations and restrictions as hereinafter set forth and after approval of such manufactured home park by the Planning Commission.
  2. The intent of this provision is:
    1. To permit variety and flexibility in land development for residential purposes by allowing the use of manufactured homes in certain areas within the City which have been zoned for such use;
    2. To do so in a manner to promote the objectives and purposes of the zoning ordinance and to protect the integrity and characteristics of the zones contiguous to those areas where manufactured home parks are located.

Section 16.56.030 Manufactured Home Park Regulations -- Permit -- Application -- Content

Before a permit shall be issued for a manufactured home park, nine (9) copies of the overall plan of development must be submitted to the Planning Commission for its review. The plan must show:

  1. The topography represented by contours shown at not greater intervals than two (2) feet when required by the Planning Commission;
  2. The proposed street and trailer space layout, including sidewalks, curbs and gutters;
  3. Proposed reservations for parks, playgrounds and open spaces;
  4. Tabulations showing percent of area to be devoted to parks, playgrounds and open space, number of manufactured homes and total area in the manufactured home park;
  5. Proposed location and number of parking spaces;
  6. Landscaping plan, including water, electric and gas lines, fire hydrant locations and sewer lines;
  7. Storm drainage facilities and disposal plan for storm water runoff;
  8. Sewer capacity analysis;
  9. Any other data that the Planning Commission may require.

Section 16.56.040 Manufactured Home Park Regulations -- Permit -- Application -- Submittal --Hearing -- Determination

Applications for approval shall be submitted to the Planning Commission at least thirty (30) days prior to its regular meeting and shall be granted or denied only after a public hearing by the Planning Commission. The thirty (30) day period may be waived by the authority of the Mayor. If approved by the Planning Commission, the application shall be deemed approved unless the City Council indicates disapproval within five (5) days after the next regularly scheduled Council meeting.

Section 16.56.050 Manufactured Home Park Regulations -- Construction Drawings -- Requirements

  1. Three (3) copies of detailed construction drawings shall be supplied to and approved by the Vernal City Public Works Department and City Engineer prior to approval by the Planning Commission.
  2. Such construction drawings shall be drawn by a State of Utah licensed engineer as regulated by Utah Division of Professional Licensing and shall show the following:
    1. Profile and location of water and sewer lines;
    2. Location of water vales and fire hydrants;
    3. Location and size of water meters;
    4. Location and size of sewer manholes;
    5. Storm water disposal plan.

Section 16.56.060 Manufactured Home Park Regulations -- Standards And Requirements -- Conformance To Required

The development of a manufactured home park shall conform to the following standards and requirements.

Section 16.56.070 Manufactured Home Park Regulations -- Ownership

The area shall be in one (1) ownership, or if in several ownerships, the application for approval of the manufactured park shall be filed jointly by all owners of the property included in the plan.

Section 16.56.080 Manufactured Home Park Regulations -- Density

  1. The density in a manufactured home park shall not exceed seven (7) units per acre. Manufactured homes may be clustered within the manufactured home park; provided, that no single manufactured home space shall be smaller in area than four thousand (4,000) square feet.
  2. The remaining land not contained in individual lots, roads or parking shall be set aside and developed as park, playground and service areas for the common use and enjoyment of the occupants of the development and visitors thereto.

Section 16.56.090 Manufactured Home Park Regulations -- Playgrounds And Recreational Areas

Not less than ten (10) percent of the gross area of the manufactured home park shall be set aside as playground or recreation area for the use of the occupants. The land covered by vehicular roadways, sidewalks and off-street parking shall not be construed as part of the area required for parks and playgrounds.

Section 16.56.100 Manufactured Home Park Regulations -- Location Of Model Homes Or Add-Ons -- Landscaping

No manufactured home add-on shall be located closer than fifteen (15) feet from the nearest portion of any other manufactured home add-on.

Section 16.56.110 Manufactured Home Park Regulations -- Landscaping

All area, including common areas, not covered by manufactured homes, hard surfacing, buildings, off-street parking space or driveways shall be planted, landscaped, and maintained. All landscaping must conform with Section 16.27 of this code. Failure to provide landscaping in accordance with this section will be grounds for the City to withhold building permits.

  1. A strip of land at least twenty (20) feet on all sides of the manufactured homes shall be left unoccupied by other manufactured homes.

Section 16.56.120 Manufactured Home Park Regulations -- Roads And Off-Street Parking Spaces To Be Paved

All roads and off-street parking spaces shall be hard surfaced and roads bordered by concrete curbing and sidewalk. Roads shall be completed prior to any building permits being issued in the manufactured home park unless there is a specific written agreement with Vernal City. The owner must maintain all roads within the Park.

Section 16.56.130 Manufactured Home Park Regulations -- Privacy Fencing And Landscaping Requirements

A strip of land at least fifteen (15) feet wide on the sides and thirty (30) feet in front and rear of the manufactured homes shall be left unoccupied by manufactured homes and shall be planted and maintained in lawns, shrubs and trees designed to afford privacy to the development. A fence of a type approved by the Planning Commission around the perimeter of the manufactured home park shall be required.

Section 16.56.135 Manufactured Home Park Regulations -- Skirting And Anchoring Requirements

All manufactured homes within the Park shall be skirted, and each home shall be firmly anchored to prevent sway and/or give or play, and shall be adequately supported. Skirting must be attached within thirty (30) days from the date that the building permit is issued.

Section 16.56.140 Manufactured Home Park Regulations -- Storage And Solid Waste Receptacles

  1. RV Storage Space shall be provided within the park for the storage of boats, campers, trailers, and other recreational vehicles, etc. Said spaces shall be provided at a minimum rate of one (1) space for each ten (10) dwelling units. This storage area is to be fully enclosed with a six (6) foot masonry wall, opaque fence or screening material approved by the Planning Commission. Each individual storage unit shall be a minimum of 10' x 20'.
  2. All storage and solid waste receptacles outside of the confines of a manufactured home must be housed in a closed structure compatible in design and construction to the manufactured homes and to any service buildings within the manufactured home park; all patios, garages, storage units, carports and other add-ons must be compatible in design and construction with the manufactured home and with the service buildings as approved by the Planning Commission.

Section 16.56.150 Manufactured Home Park Regulations -- Roadways And Entrances

  1. Roadways shall be concrete or asphalt built to City specifications and of adequate width to accommodate anticipated traffic as follows:
    1. For one (1) way traffic with no parking: sixteen (16) feet in width plus extra width as necessary for maneuvering manufactured homes;
    2. For two (2) way traffic with no parking: twenty-four (24) feet in width;
    3. For entrance streets: minimum of thirty-six (36) feet in width.
  2. There shall be no more than two (2) entrances from the court into any one (1) street. Entrances shall be no closer than twenty-five (25) feet from each other; not closer than twenty (20) feet to the corner of the intersection or as otherwise required by the Planning Commission.
  3. A manufactured home park shall have at least two (2) vehicle accesses to public streets (one of which may be controlled access as approved by the Fire Department.)

Section 16.56.160 Manufactured Home Park Regulations -- Access Requirements

  1. Access shall be provided to each manufactured home space by means of an access way reserved for maneuvering manufactured homes into position and shall be kept free from trees and other immovable obstructions. Paving the access way shall not be required. Use of planks, steel mats or other means during the placement of a manufactured home shall be allowed so long as the same are removed immediately after placement of a manufactured home.
  2. Access to individual manufactured homes shall be from private interior roads and not from public roads.

Section 16.56.170 Manufactured Home Park Regulations -- Off-Street Parking

Off-street parking shall be provided at the rate of two (2) parking spaces per manufactured home space, and shall be located in the manufactured home space. All off-street parking shall be hard surface.

Section 16.56.180 Manufactured Home Park Regulations -- Additional Requirements

In addition to meeting the preceding requirement and conforming to the other laws of the City, all manufactured home parks shall also conform to requirement set forth in the Code of Camp-Trailer Court, Hotel, Motel and Resort Sanitation Regulations as adopted by the Utah State Board of Health, February 21, 1968, and by the Fire Prevention Code, which codes are adopted by reference, copies of which are on file at the Vernal City office for use of the public and all restrictions, regulations and notations contained therein shall be made a part of this title as if fully set forth herein. In event of any conflict between the regulations or codes and this chapter, this chapter shall take precedence.

Section 16.56.190 Manufactured Home Park Regulations -- Utility Lines And Equipment -- Location And Construction

Utility lines and equipment shall be located and constructed in conformity with good engineering and construction practices and shall be in compliance with all applicable laws, ordinances or codes of the City and State.

Section 16.56.200 Manufactured Home Park Regulations -- Sewer

  1. The manufactured home park shall be served by a private sewer system connecting to the public sewer system upon entering the public right-of-way. Each manufactured home space shall be provided with a four (4) inch sewer connection which shall be capped so as to prevent any escape of odors or possible damage to the sewer system.
  2. The manufactured home sanitary drain shall be watertight, self-draining and shall be constructed and approved in accordance with Vernal City Specifications and State of Utah regulations.

Section 16.56.210 Manufactured Home Park Regulations -- Water

  1. A public supply of water shall be obtained from an approved public water system.
  2. An adequate amount of water shall be piped to each manufactured home lot through a private system of a design acceptable to the City Engineer.
  3. Fire hydrants shall be designed and installed according to Vernal City Specifications.

Section 16.56.220 Manufactured Home Park Regulations -- Electric

All electric, telephone and other service lines to each manufactured home lot shall be underground and shall comply with all currently adopted state and local laws and regulations.

  1. In no case shall a utility company deliver service to any manufactured home without first obtaining written approval for the connection from the City building inspection department. When a manufactured home is removed from a lot, the utility company delivering service shall render the service connection unuseable.

Section 16.56.230 Manufactured Home Park Regulations -- Liquid Or Gaseous Fuels

All fuel lines shall be underground and if metered, the meters shall be arranged in a uniform manner.

  1. Any liquid fuel storage shall be located in tanks at a distance away from any manufactured home lot as determined safe by the Building Official and/or Fire Chief.
  2. In no case shall a utility company deliver service to any manufactured home without first obtaining written approval for the connection from the City building inspection department. When a manufactured home is removed from a lot, the utility company delivering service shall render the service connection unuseable.

Section 16.56.240 Manufactured Home Park Regulations -- Street Lighting

Street lighting shall be provided according to standards approved by the City in sufficient number and intensity to permit safe movement of vehicles and pedestrians at night. Street lights shall be installed and maintained by the manufactured home park owner who shall also be responsible for all costs associated with street lighting within the park on private roads. Failure to maintain street lighting will be grounds for the City to withhold issuing building permits in the manufactured home park.

Section 16.56.250 Manufactured Home Park Regulations -- Refuse Handling And Receptacles

The storage, collection and disposal of refuse in the manufactured home park shall be managed so as to create no health hazards, rodent harborage, insect breeding or accident hazards. All refuse shall be stored in watertight, rodent proof containers and shall be provided in sufficient number and capacity to prevent any refuse from overflowing or blowing away. Satisfactory container racks or dumpsters shall be provided at permanent locations convenient to manufactured home spaces, in areas screened from general view. Methods of storage and collection shall be in compliance with local laws and regulations.

Section 16.56.260 Manufactured Home Park Regulations -- Plan Review -- Considerations

The Planning Commission shall review the plan to determine its compliance with all portions of the City's master plan. In considering the plan, the Planning Commission among other things shall make sure that such developments shall constitute a residential environment of sustained desirability and stability and that it will not adversely affect amenities in the surrounding area. The Planning Commission may require changes be made in the plan and development standards in excess of the minimum standards contained in this title, such as walls, buffers, setbacks, greater amounts of landscaping or parking spaces, etc., may be imposed as conditions of approval where it is determined by the Planning Commission such standards are necessary to ensure that the manufactured home park will mix harmoniously with joining or nearby uses and comply with sewage, drain fields and other code requirements.

Section 16.56.270 Manufactured Home Park Regulations -- Completion Of Required Improvements -- Guarantee -- Form -- Release

  1. In order to assure the completion of the required improvements, the manufactured home park developer shall establish with the City an escrow account or surety bond. Such financial guarantee shall be in an amount equal to one hundred ten (110) percent of the cost of the required improvements as estimated by the developer's engineer and as accepted by the City Engineer. Manufactured home park improvements which must be included in the financial guarantee are: road pavement, curb, sidewalks, landscaping and playground area development, fencing, street lighting, garbage receptacles, parking pads, and all other improvements required under this chapter.
  2. All required improvements shall be installed within one (1) year from the date of final approval of the manufactured home park. When all improvements are completed in accordance with the approved plan and installed to City standards, the financial guarantee shall be released according to the provisions described in the Vernal City subdivision ordinance, Section 16.58.450, guarantee of performance.

Section 16.56.280 Manufactured Home Park Regulations -- Appointment Of Agent Authorized To Receive Process

In any case when a manufactured home park is owned by more than one (1) natural person, the developer shall establish and appoint an agent for the purpose of service of process, which agent shall be authorized to receive process and represent fully the interests of the owners in respect to continuing management and maintenance of the manufactured home park.

Section 16.56.290 Manufactured Home Park Regulations -- License -- Required -- Revocation

  1. Prerequisite to the operations of any manufactured home park in Vernal City shall be the obtaining of an annual license. It is unlawful to operate a manufactured home park without first obtaining a license and the license shall be refused or revoked upon failure of the owner and/or operator to maintain the park in accordance with the standards and requirements herein set forth.
  2. A building permit must be obtained from the building official of the City prior to any placement, including relocation of homes within same park, additions, accessory buildings, prior to placement or construction.

Section 16.56.300 Long Term RV Park -- Location

Long term Rv parks may be permitted conditionally only in the MH zone. All such installations may be permitted only after approval of the Planning Commission subject to all restrictions and conditions hereinafter designated. Conditions for approval for both long term and short term Rv parks shall be found in Sections 16.56.300 through 16.56.400.

Section 16.56.310 Long And Short Term RV Parks -- Permit -- Plan Submission -- Content

Before a permit shall be issued for an RV park, the overall plan of the park must be submitted to the Planning Commission for its review. The plan shall show:

  1. Proposed road layout and trailer space;
  2. Proposed reservation for parks, playgrounds and other open space;
  3. Landscape plan;
  4. Storm water retention plan; and
  5. Sewer impact analysis.

Section 16.56.320 Long And Short Term RV Parks -- Standards And Requirements -- Conformance To Required

The RV park shall conform to the standards and requirements set out in Sections 16.56.330 through 16.56.400.

Section 16.56.330 Long And Short Term RV Parks -- Location In Relation To Streets

All RV parks shall abut upon the collector or arterial street as set forth in the major street plan of Vernal City. No RV space shall have direct access from a public street.

Section 16.56.340 Long And Short Term RV Parks -- Entrances And Exits

  1. All entrances and exits from the RV park shall be by forward motion only.
  2. No exit or entrance from the RV park shall be through a residential zone. No entrance or exit shall be located closer than twenty (20) feet to the intersection of two (2) streets.

Section 16.56.350 Long And Short Term RV Parks -- Setback From Streets

All RV's shall be set back at least twenty (20) feet from any public street.

Section 16.56.360 Long And Short Term RV Parks -- Roadways -- Widths -- Surfacing

All one (1) way roadways shall be at least sixteen (16) feet in width, and all two (2) way roadways at least twenty-four (24) feet in width, and all roadways shall be hard surfaced as defined in Section 16.26. Hard surfaced parking spaces shall be provided for the parking of each RV located with the park and at least one automobile space for each Rv space.

Section 16.56.370 Long And Short Term RV Parks -- Landscaping

All areas within the park which are not hard surfaced, including the twenty (20) foot setback space, shall be landscaped and maintained with lawns, trees and shrubs designed to provide privacy and noise containment. All landscaping must conform with Section 16.27 of this code. Recreation space shall be provided for each RV park. A minimum useable area of one-hundred (1000 square feet shall be set aside and developed in each park with an additional twenty-five (25) square feet provided for each unit in excess of ten (10). The perimeter of the park shall be fenced with a six (6) foot, sight obscuring fence.

Section 16.56.380 Long And Short Term RV Park -- Spaces -- Width -- Length

Each RV space shall be at least twenty-five (25) feet in width and at least fifty (50) feet in length.

Section 16.56.390 Long And Short Term RV Parks -- License -- Required -- Revocation

Prerequisite to the operation of any RV park in Vernal City shall be the obtaining of an annual license. The license shall only be issued after inspection by the Building Official and it shall be unlawful to operate an RV park without first obtaining a license and the license shall be refused or revoked upon failure of the owner and/or operator to maintain the court in accordance with the standards and requirements as herein set forth.

Section 16.56.400 Long And Short Term RV Parks -- Additional Requirements

  1. In addition to meeting the preceding requirements, all RV parks shall conform to the requirements set forth in the Code of Camp, Trailer Court, Hotel, Motel and Resort Sanitation Requirements as adopted by the Utah State Board of Health and shall also conform to the Fire Prevention Code, which codes have been adopted by Vernal City.
  2. All RV's within long-term RV parks must be skirted within thirty (30) days of occupancy. Skirting must meet building code requirements.

Section 16.56.410 Additional Regulations For Manufactured Homes

  1. It is unlawful to maintain a manufactured home or travel trailer or camper in Vernal City except under the following conditions:
    1. All manufactured homes shall be located within licensed manufactured parks in conformance with all regulations applicable to the parks, and all occupied travel trailers or campers shall be located within a licensed travel trailer court in conformance with all regulations applicable to the courts;
    2. When located on a lot on which a dwelling or commercial or industrial building is being constructed, for a period of time not to exceed one (1) year, the manufactured home may not be located on the property until a building permit has been issued for the new building and all sanitation, health and other code requirements have been complied with;
    3. When located on a manufactured home sales lot, as long as the sales lot remains in operation.
    B. No add-on, auxiliary building or temporary addition shall be allowed in any trailer court or manufactured home park without prior consent of the Building Official.C. Existing trailer courts not in compliance with this title shall constitute a nonconforming use, but shall be subject to health and sanitary requirements as provided in this chapter.D. All manufactured home parks and travel trailer courts shall have addresses assigned to each pad or space prior to final approval.

Section 16.56.420 Manufactured Home Regulations

  1. It is unlawful to place a manufactured home on any lot or parcel in Vernal City, and to use the same for human habitation except in compliance with one (1) of the following conditions:
    1. When placed in a manufactured home (MH) zone in a licensed manufactured home park, as defined herein, and after obtaining approval and a permit from the City Building Official, provided;
      1. The manufactured home was fabricated under the revised U.S. Department of Housing and Urban Development (HUD) standards of June 15, 1976,
    2. When placed on a lot in a recorded manufactured home subdivision where the lot complies with all the regulations of the manufactured home subdivision (Chapter 16.46 of this code), and after receiving approval of the City Building Official, provided:
      1. The manufactured home was fabricated under the revised U.S. Department of Housing and Urban Development (HUD) standards of June 15, 1976, or,
    3. When placed on any lot where single-family dwellings are permitted and outside of a manufactured home zone or an approved manufactured home park , and where the lot complies with all the regulations of the zone in which the manufactured home is so placed; provided:
      1. The manufactured home was fabricated under the revised U.S. Department of Housing and Urban Development (HUD) standards of June 15, 1976,
      2. The manufactured home must have been fabricated in two (2) or more sections, each section measuring a minimum of twelve (12) feet in width,
      3. The manufactured home is placed on a permanently engineered foundation that meets or exceeds the standards adopted by the State Construction Code Administration Act for the installation of manufactured homes titled, "Model Manufactured Home Installation Standards, NFPA 225 ," the accompanying manufactured home, or equivalent standard as adopted by rule,
      4. The manufactured home shall have the appearance when installed of a conventionally-built single-family dwelling, and shall have:
      5. A roof which meets all standards of the building code.
      6. The manufactured home shall be entered upon the tax rolls of Uintah County as real property in accordance with Utah Code Annotated.
