CHAPTER 16

48 C-2 And CC-1 Planned Commercial Zones

Section 16.48.010 Purpose

The purpose of the C-2 commercial and CC-1 central commercial zones is to provide suitable areas for the location of various types of commercial activity needed to serve the people and commerce of the City. It is also to separate into two (2) zones uses, based upon type of activity, which are compatible and complementary as well as intensity of land utilization and accessory use needs. The two (2) types of commercial zones provided for in this chapter are:

  1. C-2 commercial: provides, in addition to the convenience goods, a wider range of facilities for the sale of retail goods and personal services for the neighborhood and major segments of the community;
  2. CC-1 central commercial: provides for the sale and supply of the complete range of retail and wholesale goods and personal services for the regional area and also a center for recreational entertainment and cultural activities for the entire region.

Section 16.48.020 Permitted And Conditional Uses -- Conditions -- Compliance Required

Hereinafter specified permitted and conditional uses shall be permitted only when the following conditions are complied with:

  1. All manufacturing shall be done within a completely enclosed building.
  2. All uses shall be free of objection because of odor, dust, smoke or noise.
  3. All development within a commercial zone requires site plan approval from the Vernal City Planning Commission as set forth in Chapter 16.06, Administration and Procedure, of this title.
  4. Urban farms.

Section 16.48.030 Uses

In the following list of possible uses, those designated in any zone as "P" will be a permitted use. Uses designated as "C" will be allowed only when authorized by a conditional use permit obtained as provided in Chapter 16.14 Conditional Uses, of this title. Uses designated as "N" will not be allowed in that zone.

Section 16.48.040 Site Development Standards

  1. Minimum lot area: none;
  2. Minimum lot width: none;
  3. Minimum yard setbacks:
    1. Front:
      1. C-2 zone: thirty (30) feet,
      2. CC-1 zone: none,
      3. Bus shelters in both C-2 and CC-1 zones;
        1. Bus shelters must not interfere with ADA accessibility or pedestrian movements.
        2. Must be set back a minimum of five (5) feet from a barrier curb or where no curb is present, behind the edge of the sidewalk or ten (10) feet back from edge of travel way.
        3. Bus shelters must not interfere with any clear vision triangle.
        4. The entity installing the bus shelter shall be responsible for its maintenance.
      4. Side: none, except ten (10) feet adjacent to residential zone boundary,
      5. Side facing street on corner lot: twenty (20) feet, except average where fifty (50) percent frontage is developed,
      6. Rear: none, except ten (10) feet where building rears on residential zone;
  4. Building height:
    1. Minimum: one (1) story,
    2. Maximum: none;
  5. Landscaping shall be in conformance with Chapter 16.27 herein;
  6. Minimum site development standards for dwelling units are the same as provided in the residential R-4 zone;
  7. Site development standards for travel-trailer courts are set forth in Chapter 16.52 of this code;
  8. Fence requirements: Commercial developments adjacent to property zoned and/or used for residential purposes shall install a six (6) foot privacy fence between commercial and residential properties to afford privacy for the residential dwellings. The fence shall be installed so as not to create a safety hazard for vehicular and pedestrian traffic.

Section 16.48.050 Sign Regulations

The height, size and location of permitted signs shall be in accordance with the regulations set forth in Chapter 16.28, Sign Regulations, of this title.
