CHAPTER 16

50 CP-2 And CCP-1 Planned Commercial Zones

Section 16.50.010 Purpose

  1. The intent of the planned commercial zone is to permit the establishment of a well designed complex of retail commercial facilities and associated services, which will provide goods and services for the people to be served, minimize traffic congestion of public streets in the vicinity and which shall best fit the general environment and land use pattern of the area. The protective standards contained in this chapter are intended to minimize any adverse effect of the planned commercial zone on nearby property values by achieving maximum compatible integration of land uses, by preserving the aesthetic qualities of the area and to provide for safe and efficient use of the planned commercial zone itself.
  2. The two (2) types of planned commercial zones provided for in this chapter are as follows:
    1. CP-2, Community. The CP-2 zone provides for the sale and supply of daily living needs for the people in the neighborhood; in addition, a wider range of facilities for the sale of retail goods and personal services for the neighborhood and major segments of the community.
    2. CCP-1, Regional. The CCP-2 zone provides for the sale and supply of the complete range of retail and wholesale goods and personal services for the metropolitan area as well as a center for recreational, entertainment and cultural activities for the entire region.

Section 16.50.020 Uses

In the following list of possible uses, those designated in any zone as "P" will be a permitted use. Uses designated as "C" will be allowed only when authorized by a conditional use permit obtained as provided in Chapter 16.14 Conditional Uses, of this title. Uses designated as "N" will not be allowed in that zone.

Section 16.50.030 Site Development Standards -- CP-2 Zone

Site development standards in the CP-2 zone are as follows:

  1. Minimum lot area: none;
  2. Maximum lot area: none;
  3. Minimum yard setbacks:
    1. Front: thirty (30) feet for the main building or walls or fences over three (3) feet high except:
      1. Bus shelters.
        1. Bus shelters must not interfere with ADA accessibility or pedestrian movements.
        2. Must be set back a minimum of five (5) feet from a barrier curb or where no curb is present, behind the edge of the sidewalk or ten (10) feet back from edge of travel way.
        3. Bus shelters must not interfere with any clear vision triangle.
        4. The entity installing the bus shelter shall be responsible for its maintenance.
    2. Side: none, except ten (10) feet adjoining a residential zone,
    3. Side facing street on corner lot: twenty (20) feet,
    4. Rear: none, except ten (10) feet adjoining a residential lot;
  4. Building height:
    1. Minimum: One (1) story,
    2. Maximum: none;
  5. Lot coverage: the aggregate of all buildings shall not exceed fifty (50) percent of the entire lot area.
  6. Landscaping shall be in conformance with Chapter 16.27 herein.

Section 16.50.040 Site Development Standards -- CCP-1 Zone

Site development standards in the CCP-1 zone are as follows:

  1. Minimum lot area: none;
  2. Maximum lot area: none;
  3. Minimum yard setbacks;
    1. Front: none,
      1. Bus shelters.
        1. Bus shelters must not interfere with ADA accessibility or pedestrian movements.

Section 16.50.050 Fencing Requirements

Commercial developments adjacent to property zoned and/or used for residential purposes shall install a six (6) foot privacy fence between commercial and residential properties to afford privacy for the residential dwellings. The fence shall be installed so as not to create a safety hazard for vehicular and pedestrian traffic.

Section 16.50.060 Protection Of Adjoining Residential Properties

Where a planned commercial development adjoins any lot in any residential zone, there shall be provided and maintained along such property line a wooden or ornamental masonry opaque fence of not less than six (6) feet in height; provided, however, that such fence shall be four (4) feet in height along the property line which bounds the front yard of adjoining residential lots. At least fifty (50) percent of such wall shall be maintained with a minimum six (6) foot wide planting strip and landscaping with trees and shrubs.

Section 16.50.070 Sign Limitations

Off-premises or billboard advertising signs shall not be permitted in any planned commercial zone.

Section 16.50.080 Establishment -- Regulations

  1. A CP zone may be established only upon land held in single ownership or under unified control or where the Planning Commission determines that the commercial development on separate adjoining properties could be coordinated to form a physically unified commercial facility which will be compatible with the surrounding land uses. At the time a CP zone is established and before building permits are issued, deed restrictions on the property or properties covered under the zone change shall be filed by the applicant or owners of subject property with Uintah County recorder and shall provide that development with a final site development plat approved by the City Council and on file with the City Recorder.
  2. CP zone shall not be established upon a tract of land which would contain a nonconforming use after the passage of such amendment to the zoning map, unless the development planned for the tract includes the elimination of the nonconforming use or its integration into the planned development.
  3. The location of the CP zone shall have an acceptable relationship to and further the purposes of the comprehensive plan for the City as determined by the Planning Commission.

Section 16.50.090 Submission -- Content

A rezoning petition for a planned commercial zone shall be submitted to the Planning Commission and shall be accompanied by a preliminary development plat for the commercial center, showing a unified and organized arrangement of buildings and structures and their proposed uses, off-street parking, internal and external traffic circulation and service facilities, architectural sketch drawings, landscaping plans and sketches demonstrating the design and character of the proposed development. The developer shall submit all evidence deemed necessary by the City Council and/or Planning Commission of his ability to undertake and complete the proposed project.

Section 16.50.100 Zoning Petition And Development Plat -- Planning Commission Action

The Planning Commission shall recommend approval or denial of the zoning petition and preliminary development plat to the City Council. The recommendation of the Planning Commission may contain conditions, limitations and amendments to the preliminary development plat to ensure that the planned commercial development is integrated into its surroundings and serves the public interest to the greatest extent possible. The Planning Commission may also require a reasonable financial guarantee to ensure the completion of the landscaping and other improvements for the entire plan or phase thereof.

Section 16.50.110 Zoning Petition And Development Plat -- City Council Action

The City Council, after holding a public hearing thereon, may approve or disapprove a petition for a planned commercial zone. In approving a zoning petition, the City Council may concurrently approve a preliminary development plat, together with whatever amendments, conditions or requirements as it may deem necessary to secure the purpose of this chapter.

Section 16.50.120 Final Development Plat

After the rezoning of a site to a CP zone, a final development plat for the entire project, or for the initial phase if a stage development plat has been approved, shall be submitted to and approved by the Planning Director in accordance with Chapter 16.60 of this code, as complying with the regulations and requirements attached thereto prior to the issuance of any building permits. The final development plat shall show in detail the proposed areas and locations of buildings, off-street parking, internal and external traffic circulation, improvements, landscaping, signs and service facilities. No changes shall be made in the final development plat during the course of construction pursuant thereto without first obtaining approval of the Planning Director. Three copies of the approved final development plat shall be kept on file in the office of the Planning Department and only changes which may be subsequently approved shall be added thereto.

Section 16.50.130 Building Permit Issuance And Time Limitations

  1. A building permit shall be secured and construction begun in accordance with the approved final development plat within eighteen (18) months from the effective date of the ordinance establishing such zone or other period of time as determined by the City Council. Application may be made one (1) time to the Building Official for not more than six (6) months extension of time limit for commencement of construction. Building permits shall be issued only for those uses and buildings indicated on the approved final development plat. Building permits shall not be issued until a financial guarantee guaranteeing the installation of improvements and landscaping has been accepted by the City.
  2. In the event construction is not started within the specified time limits, the Planning Commission shall review the classification of the zone and the progress which has taken place and, if deemed necessary, revoke the plan approval and initiate proceedings to rezone the property to its prior classification or to a zone consistent with the comprehensive plan.
  3. All construction authorized in the approved final development plat shall be completed within three (3) years of the date construction has commenced. A plan for stage development which will require more than the limits contained herein may be approved by the Planning Commission.
  4. In the event construction is not completed within the time limits specified, the Planning Commission shall review the development which has taken place and, if necessary, initiate proceedings to reclassify the property or part thereof in a manner consistent with the comprehensive plan.

Section 16.50.140 Applicability To Existing Commercial Zones

In existing zones, the Planning Commission and City Council may proceed to rezone such zones to an equivalent planned commercial zone without the requirements of a preliminary development plat and other necessary information. After being so zoned to a planned commercial zone, a preliminary and final development plat of each development shall be submitted to and approved by the Planning Commission in accordance with the provisions of this chapter prior to the issuance of building permits; provided, however, that improvements already in existence at the time of rezoning shall not be affected.
