The regulations set forth in this section and set forth elsewhere in this chapter when referred to in this section are the regulations in the “C-2” Central Business District. This centrally located commercial district is for the conduct of retail trade and personal service enterprises, to meet the regular needs and the convenience of the people of adjacent residential areas. Because their shops and stores are closely associated with residential, religious, recreational and educational uses, more restrictive requirements are required for light, air, open space, and off street parking.
1. Uses Permitted. No land shall be used or occupied and no building or structure shall be erected, altered, enlarged, occupied, or used, except as otherwise provided in this chapter, for other than one or more of the following specified uses:
A. Any listed permitted use in “C-1” District.
B. Automotive service station, body shop.
H. New and/or used car, truck, boat, farm equipment sales.
I. Parking lots and garages.
K. Plumbing, heating, electrical shop totally enclosed.
L. Private club or lodge.
M. Printing shop and sales.
P. Tinsmith shop totally enclosed.
2. Special Uses Permitted. The following uses may be permitted if specifically authorized by the Zoning Board of Adjustment, following a recommendation by the Commission in accordance with provisions contained herein and elsewhere in this Code of Ordinances and may require a site plan review as outlined in Section
167.29:
A. Commercial laundry shop.
C. Hotel or motel, with or without residence.
D. Any similar uses which are not likely to create any more offensive noise, vibration, dust, smoke, odor, or other objectionable influences that result from the above uses as determined by the Commission.
3. Uses Prohibited. Uses prohibited are those uses not authorized in Subsections 1 and 2.
4. Area and Structure Regulations.
A. Minimum Lot Area. No minimum lot area is specified.
B. Minimum Lot Width. No minimum lot width is specified.
C. Front Yard. No front yard is required, except where the frontage of the lot is adjoining a residential dwelling district either by lot line or between streets, the required front yard shall be 25 feet. When a lot is located on a corner lot, a 25-foot yard shall be required on both streets.
D. Side Yard. No side yard is required except where it is adjoining to a residential zoned lot, then the side yard shall not be less than 10 feet.
E. Rear Yard. There shall be a rear yard of not less than 10 feet unless abutting an alley, then there must be a minimum setback of five feet.

5. Decks. Decks are considered structures and must meet setback requirements.
6. Height Regulations. No building shall exceed six stories or 80 feet in height. Where a building is located on a lot adjoining a residential dwelling district, or a publicly owned area other than an alley or street, then it shall not exceed three stories or 45 feet in height unless said structure is set back one foot from all required yard lines for each foot of additional height above 45 feet.
7. Parking Regulations. 50 percent of parking may be on City streets. Also see Section
167.03(8) for other parking requirements.
8. Trash Disposal. All Commercial Districts shall contract with commercial haulers for garbage and/or refuse disposal at the proprietor’s expense. In addition, the trash receptacle must be adequate in size, compartments, and function to properly contain all trash, garbage, and debris. Such trash receptacle or receptacles shall be placed upon a concrete pad adequate in construction to support the said receptacles. The area selected for location of the trash receptacles shall be both readily accessible for collection, and if deemed necessary by the type of receptacles, with adequately paved driveway to and from the trash receptacle. The proposed location of the trash receptacle area shall be shown on the site plan as approved by the Commission.
