167.16 “M-4

EXTRA HEAVY INDUSTRIAL DISTRICT.

The regulations set forth in this section or set forth elsewhere in this chapter when referred to this section are the “M-4” Extra Heavy Industrial District.
1.   Uses Permitted. There are no uses permitted except special uses.
2.   Special Uses Permitted. The following uses may be permitted if specifically authorized by the Zoning Board of Adjustment, following a recommendation by the Commission in accordance with provisions contained herein and elsewhere in this Code of Ordinances and may require a site plan review as outlined in Section 167.29.
   A.   Cement, lime, gypsum, or plaster of Paris manufacture.
   B.   Distillation of bones, fat rendering.
   C.   Fertilizer manufacture, quarry operations.
   D.   Garbage, landfill, dead animals, reduction or processing.
   E.   Gas manufacture, acid manufacturing.
   F.   Glue manufacture, slaughter house.
   G.   Handling & storage of hazardous materials.
   H.   Junk or salvage yards totally enclosed, no items visible from streets or surrounding and adjoining properties.
   I.   Manufacturing of gases: ammonia, alcohol, acetylene, and other like gases.
   J.   Manufacturing of paint, solvent, or other like items.
   K.   Petroleum bulk storage liquids up to Class I, II, III and IV.
   L.   Smelting of raw ore material.
   M.   Stock yard, feeding, transfer, and breeding stations.
   N.   Storage of explosive, fireworks, and other like items.
   O.   Storage, manufacturing and handling anhydrous ammonia.
   P.   Above-ground storage of Class II and III liquids, less than 1,100 gallons, that shall comply with all federal, State, and local codes and Fire Department regulations.
The uses permitted in the “M-4” District shall all be located a minimum of 3,500 feet from any “R-1”, “R-2”, “R-3”, or “R-4” district, and 1,000 feet from any “C-1”, “C-2”, or “C-3” district.
3.   Uses Prohibited.
   A.   Any residential dwelling unit, except residential quarters of the caretaker when located on the premises of the industrial use.
   B.   The handling of all radioactive materials.
Nothing in this provision shall be construed to eliminate the restrictions set forth in this Code of Ordinances concerning junk dealers, and junk vehicles, or nuisances.
4.   Area Regulations.
   A.   Minimum Lot Area. No minimum lot area is specified.
   B.   Minimum Lot Width. No minimum lot width is specified.
   C.   Front Yard. There shall be a front yard having a depth of not less than 100 feet. In addition, 25 feet from the roadway shall be dedicated to the City as a right-of-way. No plantings of trees and/or shrubbery shall be permitted in the right-of-way. The right-of-way shall be maintained as open space and parking shall not be permitted on the right-of-way.
      (1)   Where lots have a double frontage, the required front yard shall be provided on both sides. Where a lot is located at an intersection of two or more streets, there shall be a front yard on each street side of the corner lot.
      (2)   No accessory building shall project beyond the setback line along either street.
   D.   Side Yard. There shall be a side yard having a width of not less than 50 feet.
   E.   Rear Yard. There shall be a rear yard having a depth of not less than 50 feet.

5.   Decks. Decks are considered structures and must meet setback requirements.
6.   Height Regulations. No building shall exceed six stories or 80 feet in height. Where a building is located on a lot adjoining an “S.A.”, “R-1”, “R-2”, “R-3”, and “R-4” district, or a publicly owned area, other than an alley or street, it shall not exceed three stories or 45 feet in height unless it is set back one foot from all required yard lines for each foot of additional height above 45 feet.
