167.14 “M-2

MODERATE INDUSTRIAL DISTRICT.

The regulations set forth in this section, or set forth elsewhere in this chapter when referred to in this section, are the “M-2” Moderate Industrial District.
1.   Uses Permitted. No land shall be used or occupied and no building or structure shall be erected, altered, enlarged, occupied, or used, except as otherwise provided in this chapter, for other than one or more of the following specified uses:
   A.   Any listed permitted use in a “M-1” District.
   B.   Cheese factory.
   C.   Coal yard in the open for resale, enclosed by approved fence.
   D.   Dyeing plant.
   E.   Any other use that is lawful within the City which would not be harmful by reason of dust, gas, smoke, noise, fumes, odor, vibration, soot, sudden fire or explosion, or any other causes deemed a like type, provided such use is a distance (lot line to lot line) of 2,000 feet or more from any subdivision of “S.A.”, “R-1”, “R-2”, “R-3”, and “R-4” district, and 500 feet from any “C-1”, “C-2”, or “C-3” district, except those districts zoned and recorded prior to passage of the zoning ordinance (July 1, 1992), then the distance may be reduced to 500 feet from a zoned district of “R-1”, “R-2”, “R-3”, “R-4”, and 200 feet from “C-1”, “C-2”, or “C-3” district.
2.   Special Uses Permitted. The following uses may be permitted if specifically authorized by the Zoning Board of Adjustment, following a recommendation by the Commission in accordance with provisions contained herein and elsewhere in this Code of Ordinances and may require a site plan review as outlined in Section 167.29.
   A.   Concrete and/or asphalt mixing proportioning plant.
   B.   Plastic re-manufacturing.
   C.   Above-ground storage of Class II and III liquids, less than 1,100 gallons, that shall comply with all federal, State, and local codes and Fire Department regulations.
   D.   Waste treatment facilities.
   E.   Any similar uses which are not likely to create any more offensive noise, vibration, dust, smoke, odor, or other objectionable influences that result from the above uses as determined by the Commission.
3.   Uses Prohibited. The following uses are specifically prohibited in “M-2” Moderate Industrial Districts:
   A.   Any residential dwelling unit, except residence quarters of the caretaker when located on the premises of the industrial use.
   B.   Churches, schools, hospitals, clinics, businesses as permitted in “C-1”, “C-2”, “C-3”, “M-3”, and “M-4” Districts.
   C.   Above-ground storage tanks of Class I, II, and III petroleum exceeding 100,000 gallons.
4.   Area Regulations.
   A.   Minimum Lot Area. No minimum lot area is specified.
   B.   Minimum Lot Width. No minimum lot width is specified.
   C.   Front Yard. There shall be a front yard having a depth of not less than 50 feet. In addition, 25 feet from the roadway shall be dedicated to the City as a right-of-way. No plantings of trees and/or shrubbery shall be permitted in the right-of-way. The right-of-way shall be maintained as open space and parking shall not be permitted on the right-of-way.
      (1)   Where lots have a double frontage, the required front yard shall be provided on both sides. Where a lot is located at an intersection of two or more streets, there shall be a front yard on each street side of the corner lot.
      (2)   No accessory building shall project beyond the setback line along either street.
   D.   Side Yard. There shall be a side yard having a width of not less than 50 feet.
   E.   Rear Yard. There shall be a rear yard having a depth of not less than 50 feet.

5.   Height Regulations. No building shall exceed six stories or 80 feet in height. Where a building is located on a lot adjoining an “S.A.”, “R-1”, “R-2”, “R-3”, and “R-4” district, or a publicly owned area, other than an alley or street, it shall not exceed three stories or 45 feet in height unless it is set back one foot from all required yard lines for each foot of additional height above 45 feet.
6.   Decks. Decks are considered structures and must meet setback requirements.
