167.04 “S.A

SUBURBAN AGRICULTURAL DISTRICT.

The regulations set forth in this section or set forth elsewhere in this chapter are the district regulations in the “S.A.” Suburban Agricultural Districts. This district is intended to provide for single-family residential development on lot sizes adequate to create an environment of rural-type homes on larger lots than required in the urban-type residential areas, while providing also for the continuance of commercial agriculture on properties of sufficient area to permit compatibility with surrounding residential development. The permitted uses, lot areas, setbacks and other requirements are designed to encourage a quality residential, “estate,” or “gentleman’s farm” in a rural setting. This district is intended to provide regulations for those areas situated on the fringe of the urban areas used for agriculture purposes.
1.   Uses Permitted. No land shall be used or occupied and no building or structure shall be erected, altered, enlarged, occupied, or used, except as otherwise provided in this chapter, for other than one or more of the following specified uses:
   A.   Single-family dwelling.
   B.   Agricultural farms, including farm buildings and accessories used in agricultural farming.
   C.   Family child care home.
   D.   Golf courses, except miniature courses or practice driving tees operating for commercial purposes.
   E.   Nursery and greenhouses, wholesale only.
   F.   Public parks and public playgrounds.
   G.   Public schools.
   H.   Roadside stand offering for sale only products grown on the premises.
   I.   Accessory uses of buildings which are customarily incidental to any of the above uses.
2.   Special Uses Permitted. The following uses may be permitted only if specifically authorized by the Zoning Board of Adjustment in accordance with provisions contained herein and may require a site plan review as outlined in Section 167.29:
   A.   Bed and breakfast inn.
   B.   Church or place of religious worship.
   C.   Cemetery.
   D.   Elder family home which complies with all applicable federal, State, and City codes as adopted.
   E.   Golf course, miniature course, and driving ranges.
   F.   Group child care center.
   G.   Group home for the disabled.
   H.   Home occupation.
   I.   Kennel.
   J.   Municipal, public service building or properties, except such cases as open storage yard.
   K.   Plant nursery, greenhouse, retail.
   L.   Sanitary landfill.
   M.   Sewage lagoon or waste treatment plant.
   N.   (Repealed by Ord. 542-23 - Jan. 24 Supp.)
   O.   Above-ground storage of Class I, II, and III liquids, 1,000 gallons or less, that shall comply with all federal, State, and local codes and Fire Department regulations.
3.   Uses Prohibited. Uses prohibited are those uses not authorized in Subsections 1 and 2 of this section.
4.   Area Regulations.
   A.   Minimum Lot Area. A separate ground area, of not less than 20,000 square feet or such additional area to adequately provide for safe sewage disposal and water supply, shall be designated, provided, and continuously maintained for each structure or land containing a permitted or special use.
   B.   Minimum Lot Width. A minimum lot width of 100 feet shall be provided for each lot used for a permitted or site plan approval use.
   C.   Front Yard. There shall be a front yard having a depth of not less than 50 feet, unless 30 percent or more of the frontage on the same side of the street between two intersecting streets is improved with buildings that have observed a greater or lesser depth of front yard, in which instance no new buildings or portion thereof shall project beyond a straight line drawn between the point closest to the street right-of-way line of the residence upon either side of the proposed structure, or beyond the straight line projected from the front of the two nearest residences, but this regulation shall not be interpreted to require a front yard of more than 100 feet.
   D.   Side Yard. There shall be a side yard of not less than 15 feet. Wherever a lot of record existing at the time of the passage of the zoning ordinance has a width of 75 feet or less, the side yard on each side of a building may be reduced to a width of not less than 10 percent of the width of the lot, but in no instance shall it be less than five feet.
   E.   Rear Yard. There shall be a rear yard having a depth of not less than 40 feet or 20 percent of the depth of the lot, whichever amount is larger, but it need not exceed 50 feet.

5.   Height Regulations. None required in this section.
6.   Parking Regulations. See Section 167.03(8).
7.   Decks. Decks are considered structures and must meet setback requirements.
