CHAPTER 6

36 C-P COMMERCIAL AND PROFESSIONAL OFFICE ZONE.

§ 6.36.010 Intent of zone.

Zone C-P is established to provide areas for the development of certain business and professional offices and related uses in locations within or in close proximity to residential areas where such uses can conveniently serve the public. This zone would permit the development of light traffic-generating uses to be located on heavily traveled highway frontages, or adjacent to commercial or industrial zones, in order to lessen the impact of the more dynamic uses on residential uses.

§ 6.36.020 Permitted uses.

Premises in Zone C-P may be used for the following principal uses:
A. 
Banks, savings and loan and credit unions.
B. 
Churches, temples and other places of religious worship.
C. 
Dental clinics, including laboratories in conjunction therewith.
D. 
Institutions of educational, philanthropic and charitable nature, not including any commercial or industrial enterprise sponsored or operated by such institutions.
E. 
Libraries.
F. 
Medical clinics, including laboratories and prescription pharmacies in conjunction therewith.
G. 
Museums, within an enclosed building only.
H. 
Offices, business and professional.
Similar uses—Other commercial or related uses by resolution of the Planning Commission or City Council, provided they are similar in character to those enumerated in this section.

§ 6.36.030 Additional uses by conditional use permit.

Premises in Zone C-P may be used for the following purposes, provided a conditional use permit has first been obtained, pursuant to the provisions of Chapter 6.64:
A. 
Hospitals.
B. 
Lodge halls.
C. 
Nursery schools, subject to the provisions of Section 6.08.230.
D. 
Rest homes.
E. 
Telephone repeater stations.
F. 
Tutoring and learning centers, subject to the provisions of Sections 6.08.230 and 4.12.130.

§ 6.36.040 Accessory uses.

Premises in Zone C-P may be used for accessory uses, including limited retail sale, provided such uses are established on the same lot or parcel of land, are incidental to, and do not substantially alter the character of any permitted principal use, including but not limited to:
A. 
Accessory buildings or structures, including private garages.
B. 
Storage of building materials used in the construction of a building or building project, during the construction and 30 days thereafter, including the contractor’s temporary office; provided, that any lot or parcel of land so used shall be a part of the building project, or on property adjoining the construction site.
C. 
Temporary storage of materials and construction equipment while used in construction or maintenance of streets and highways, sewers, storm drain, underground conduits, flood control works, pipe lines and similar uses.
D. 
Antennas, towers, telecommunication facilities and their support structures pursuant to Chapter 6.88.

§ 6.36.050 Lot area and size.

Premises in Zone C-P shall be subject to the development standards prescribed in this section.
A. 
Lot area. Each lot or parcel of land in Zone C-P shall have a minimum lot area of not less than 7,200 square feet.
B. 
Lot width. Each lot or parcel of land in Zone C-P shall have a minimum lot width of not less than 60 feet.

§ 6.36.060 Height restrictions.

A. 
Height Limit. No lot or parcel of land in Zone C-P shall have a building or structure in excess of two stories or 35 feet in height, whichever is less.
B. 
Maximum Lot Coverage. No lot or parcel of land in Zone C-P shall have a lot coverage by buildings or structures in excess of 50% of the lot area.

§ 6.36.070 Yard requirements.

A. 
Front Yard. The setback shall be 15 feet along all street frontages.
B. 
Side Yards. Each lot or parcel of land in Zone C-P which has a side lot line adjoining property in a residential zone shall have a side yard of not less than 10 feet in width on the side adjoining such residential lot or parcel of land. On the street side of a corner or reversed corner lot, the side yard shall be not less than 15 feet in width.
C. 
Rear Yard. Each lot or parcel of land in Zone C-P which has a rear lot line adjoining property in a residential zone shall have a rear yard of not less than 20 feet in depth.
D. 
Other Yard Requirements. Yards may be used for structures, landscaping, paving, parking, and storage as noted in Sections 6.08.080 through 6.08.140 except as noted in Chapter 3.36. Said items that are not otherwise allowed in the front yard shall be located behind a minimum five foot high fence/gate. Said fence/gate may be an open work fence gate.
E. 
Impervious Surfaces/Landscaping. Walkways, parking areas, vehicular accessways and other impervious surfaces shall not collectively occupy more than 50% of the entire front yard area, as required by the Walnut Zoning Code. All other areas shall be landscaped with lawn, trees, shrubs, ground covers and other plant materials and shall be properly maintained in a neat and orderly manner. The area necessary for providing access to the garage (maximum 25% feet wide) shall not be included in the calculation of impervious surfaces. Exceptions may be granted by the Planning Commission in accordance with Chapter 6.84 relative to site plan and architectural review.
F. 
Boats, Trailers or Recreational Equipment. Any boat, trailer or recreational equipment incapable of movement under their own power may not be parked or stored in the areas from the lot line(s) abutting a street to a line parallel with the main structure.

§ 6.36.080 Off-street parking.

Each lot or parcel of land in Zone C-P shall have off-street parking and loading facilities as prescribed in Chapter 6.68.

§ 6.36.090 Fences and walls.

Each lot or parcel of land in Zone C-P which has a side or rear lot line adjoining property in a residential zone shall have a solid masonry wall, not less than five feet in height nor more than six feet in height, established along such side and rear lot lines adjoining such zones, except the height shall not exceed three feet in height within the front yard setback area.

§ 6.36.100 Signs.

Each lot or parcel of land in Zone C-P may have such signs as prescribed in Chapter 6.92.

§ 6.36.110 Outdoor sales, display or storage.

All sales, display and storage in Zone C-P shall be located wholly within an enclosed building except as provided in Section 6.08.220.
