CHAPTER 6

16 R-1 RURAL OVERLAY ZONE

§ 6.16.010 Intent and purpose.

A. 
The R-1 overlay zone classification is created for the purpose of permitting certain specified areas of the City to be used for the maintenance and keeping of horses and other domestic animals for the purpose of pleasure for those residing on subject property; for the development of recreational and cultural uses; which areas are particularly suitable for such use and should be subject to specialized restrictions other than required by the provisions of this chapter for other classifications of use.
B. 
The R-1 rural zone area shall be designated by action of the City Council. Areas so designated shall be designated on the zoning map by an "A" overlay. The provisions of the base zone shall apply except for those regulations contained in the "A" overlay zone, which shall have precedence over those in the base zone. These additional requirements shall be those set forth in this chapter.

§ 6.16.020 Animals permitted as an accessory use.

Domestic animals may be kept or maintained as household pets for the personal use of members of the family subject to the following restrictions:
A. 
Each dwelling unit having a minimum lot area of not less than 13,500 square feet may keep or maintain one of the following animals: horse, donkey, steer, burro, bovine, sheep, goat or pony.
1. 
One additional animal listed above may be added for each additional 1,500 square feet of land area within said lot to a maximum of four such animals on 18,000 square feet of land area.
2. 
One additional animal listed above may be added for each additional 5,000 square feet above the 18,000 square feet.
B. 
Each dwelling unit having a minimum lot area of 13,500 square feet may keep or maintain the following animals:
1. 
Dogs—maximum of three over four months of age.
2. 
Cats—maximum of three over four months of age.
3. 
Chickens, ducks, geese, pigeons, and other small domesticated fowl—maximum of 25 total.
4. 
Rabbits, chinchillas, guinea pigs, and other small animals—maximum of 25 total.

§ 6.16.030 Prohibition.

A person shall not keep or maintain any of the following animals:
A. 
Pigs, swine and other omnivorous hoofed animals.
B. 
Any adult male horse, adult male donkey, adult male burro, adult male cattle, adult male bovine, adult male sheep, adult male goat or adult male pony that has not been castrated.

§ 6.16.040 Accessory buildings.

All accessory buildings, structures including, but not limited to, pens, corrals, fences, sheds, etc. for the keeping and maintenance of the animals permitted in this chapter shall be approved by the development review board subject to the following requirements:
A. 
Site plan drawn to scale indicating all existing and proposed structures.
B. 
A brief description of the type of materials to be used and the exterior appearance of the proposed accessory structures.
C. 
Fences and walls for the containment of the animals may be approved within the building setback area under this procedure.
D. 
All structures for the housing of animals shall be no closer than 35 feet from a habitable building. Dwelling units shall take precedence over all accessory structures.
E. 
A fee of $25.00 shall be paid for all plans reviewed by the development review board as required by this section, except that the fee shall be five dollars for the review of said plans when related to those animals set forth in paragraphs 6.16.020(B)(1) through (4).
This section shall not apply to any of said buildings, structures or uses existing at the time of the effective date of this chapter. It shall be applicable in the event of any material alterations, additions, or modifications of said existing buildings, structures, or uses.

§ 6.16.050 Nonconforming uses and structures.

All nonconforming uses and structures built without a valid building permit shall be terminated by December 31, 1978.
