CHAPTER 6

68 OFF-STREET PARKING

§ 6.68.010 Purpose of chapter.

The purpose of this chapter is to set forth the off-street parking requirements and standards for the various land uses in order to create a better living environment for the community.

§ 6.68.020 General conditions.

A. 
The provisions of this chapter shall apply at the time that a building or structure is erected, altered or enlarged to increase floor space, numbers of dwelling units or guestrooms, or in the change of occupancy of a building or structure.
B. 
In the case of mixed uses, the total automobile parking spaces required shall be the sum of the requirements for the various uses computed separately. Required automobile parking spaces for one use shall not be considered as providing required parking spaces for any other use.
C. 
Automobile parking spaces established by this chapter shall be improved as required by this chapter prior to the occupancy of new buildings or structures or occupancy of a new use in the case of an existing building or structure which has been altered or enlarged in accordance with subsection A of this section.
D. 
"Off-street parking space" as used in this chapter means any permanently maintained space with a minimum width of nine feet and a minimum depth of 20 feet on the same lot or parcel of land as is the use it is designed to serve, so located and arranged as to permit the parking of a passenger vehicle readily accessible under its own power.
E. 
All parking areas in nonresidential zones shall conform to the requirements set forth in Article II of Chapter 6.52, commencing with Section 6.52.080.

§ 6.68.030 Location of parking spaces.

A. 
Location of Parking.
1. 
Residential Uses. Required parking facilities for residential uses shall be located on the same lot or parcel of land as the use the parking facilities are intended to serve. Such facilities shall be conveniently accessible and located at a place where the erection of garages or carports is permitted.
2. 
Uses Other Than Residential.
Parking Facilities. Required parking facilities for uses other than residential shall be located:
a. 
On the same lot or parcel of land as the use such parking facilities are intended to serve; or
b. 
On the lot or parcel of land held under joint ownership, provided such parking facilities are located adjoining the use or uses served.
B. 
Ingress and Egress. Required parking and loading facilities shall be provided with easily accessible and adequate ingress and egress from and to a street, highway or alley.

§ 6.68.040 Schedule of minimum requirements.

Standards included in this section indicate the spaces and facilities required for off-street parking that shall apply at the time the subject building or structure is erected or placed on the ground. These standards shall also apply when an existing building is altered or enlarged by the addition of dwelling units or guestrooms, or the use in question is intensified by the addition of floor space, seating capacity or change of use:
A. 
Residential Uses.
1. 
One-Family Dwellings. Required parking spaces shall be provided in an enclosed garage; however, when four or more parking spaces have been provided in an enclosed garage, the remaining parking spaces may be open spaces. Open parking spaces may not be located within a required front setback. An existing three-car garage may not be reduced to a two-car garage or otherwise converted to livable area, thereby eliminating a third garage space. For the purposes of this section, "bedroom" shall mean any room, other than a living room, family room, dining room, kitchen, bathroom or laundry room, and shall include specialty rooms as defined in Section 6.08.020. The gross floor area of a residence, for the purposes of this section, shall not include any room that is a "kitchen" as defined by the Building Code. When determining the number of required parking spaces, the more restrictive standard shall prevail. Off-street parking shall be provided as follows:
1—4 bedrooms
2 parking spaces in an enclosed garage.
5 bedrooms
3 parking spaces in an enclosed garage.
5 bedrooms
3 parking spaces in an enclosed garage.
6—7 bedrooms
4 parking spaces in an enclosed garage.
More than 7 bedrooms
4 parking spaces plus one additional parking space for each bedroom over 7 bedrooms.
AND
Less than 3,000 square feet of gross floor area
2 parking spaces in an enclosed garage.
3,001 to 4,500 square feet
3 parking spaces in an enclosed garage.
4,501 to 6,000 square feet
4 parking spaces in an enclosed garage.
6,001 square feet and greater.
5, plus 1 additional space for each 1,000 square feet of floor area or fraction thereof over 7,001 square feet.
Tandem parking may be permissible for the purpose of providing the required parking spaces in an enclosed garage provided tandem parking is limited to not more than one vehicle behind another and a minimum of two parking spaces are provided side-by-side at the garage entrance.
2. 
Apartment Houses. Two and one-half parking spaces per dwelling unit in a garage or as approved by the Planning Commission.
3. 
Hotels. One parking space in a garage or carport for each guestroom.
4. 
Motels and Motor Hotels. One parking space for each sleeping room without kitchen facilities, and two parking spaces for each motel unit with kitchen facilities.
B. 
Commercial Uses.
1. 
Automobile Sales, Boat Sales, Trailer Sales, Retail Nurseries and Other Open Uses Not in a Building or Structure. One parking space for each 1,000 square feet of open area devoted to display or sales; provided, however, that where such area exceeds 10,000 square feet, only one parking space need be provided for each 5,000 square feet of such area in excess of the first 10,000 square feet contained in such area, or one space for each two employees, whichever is greater.
2. 
Bowling Alleys. Three parking spaces for each alley.
3. 
Business, General. One parking space for each 250 square feet of gross floor area.
4. 
Chapels and Mortuaries. One parking space for each three fixed seats and for every 21 square feet of seating area where there are no fixed seats, within the main chapel, and one parking space for each 400 square feet of floor area outside the main chapel.
5. 
Dancehalls. One parking space for each 21 square feet of dance floor area, and one parking space for each three fixed seats and for every 21 square feet of seating area where there are no fixed seats.
6. 
Offices, Business and Professional. One parking space for each 250 square feet of floor area.
7. 
Restaurants, Cafés, Nightclubs, Bars and Other Similar Places Preparing Food or Refreshment. One parking space for each three fixed seats or one parking space for every 45 square feet of seating area where there are no fixed seats of the dining area and one space for each 250 square feet of the remaining area. Businesses that use less than 25% of the area for preparing and dispensing food are exempt from this requirement.
8. 
Skating Rinks, Ice or Roller. One parking space for each three fixed seats and for every 21 square feet of seating area where there are no fixed seats, and one parking space for each 250 square feet of floor area not used for seating.
9. 
Swimming Pools, Commercial. One parking space for each 1,000 square feet of area on the lot or parcel of land on which such use is established. One parking space for each two employees, and a minimum of 10 parking spaces shall be provided for such use regardless of lot area or number of employees.
10. 
Theaters, Auditoriums, Stadiums, Sports Arenas, Gymnasiums and Similar Places of Public Assembly. One parking space for each three fixed seats or one parking space for every 21 square feet of seating area where there are no fixed seats.
C. 
Industrial Uses.
1. 
Industrial Uses of All Types. One parking space for each two employees on the largest shift or for each 400 square feet of floor area, whichever is greater, and one parking space for each vehicle operated or kept in connection with the use.
2. 
Public Utility Facilities, Including, but not Limited to, Electric, Gas, Water, Telephone, and Telegraph Facilities Not Having Business Offices on the Premises. One parking space for each two employees on the largest shift. One parking space for each vehicle used in connection with the use, and a minimum of two parking spaces shall be provided for each such use regardless of building space or number of employees.
D. 
Other Uses.
1. 
Child Care Centers. One parking space for each employee, and loading and unloading space of sufficient size to prevent traffic congestion on the street.
2. 
Children’s Home. One parking space for each employee on the largest shift.
3. 
Churches. One parking space for each three fixed seats or one parking space for every 45 square feet of seating area within the main auditorium where there are no fixed seats.
4. 
Golf Courses, Not to Include Miniature Courses. Ten parking spaces per hole. One parking space for each 21 square feet of building floor area used for public assembly, and one parking space for each 400 square feet of building floor area used for other commercial purposes.
5. 
Hospitals. One and one-half parking spaces per patient bed.
6. 
Rest Homes. One parking space for each resident in accordance with the resident capacity of the home as listed on the required license or permit, and if employee residence facilities are provided on the premises, additional parking spaces shall be provided as specified for the appropriate type of residences in subsection (A)(1) of this section.
7. 
Schools, Accredited, General Curriculum Through Grade 12. One and one-half parking spaces per classroom and one parking space for each five fixed seats and for every 35 square feet of seating area where there are no fixed seats in the school auditorium, gymnasium, or similar place of public assembly.
8. 
Colleges and Universities, Schools, Business, Processional, Special or Trade Schools. One parking space for each three students which the school buildings and facilities are designed to accommodate. One parking space for each two employees.
9. 
Special Uses Including Public Uses Not Elsewhere Classified, Airports, Jails, Museums, Race Tracks, Shooting Ranges, Parks, Zoos, and Uses Not Otherwise Designated Herein. To be determined by the Commission at the time of site plan consideration.
10. 
Internet Access Uses. One parking space for every three machines plus one space for every three seats in the waiting area.
E. 
Computation of Required Off-Street Parking Spaces.
1. 
Consideration of Fractional Remainders. When a fractional figure is found as a remainder in computations made to determine required off-street parking facilities, the fraction shall be construed as a whole number.
2. 
Parking in Buildings. Where required parking computations are based on floor area, floor space devoted to parking within a building, or necessary interior driveways and ramps thereto, shall be excluded. A building, or portion of a building, devoted exclusively to parking shall have no off-street parking space requirements.
3. 
For Uses on Separate Lots or Parcels of Land. Required parking facilities may be provided collectively for two or more buildings or uses located on separate lots or parcels of land; provided, that the total area of such facilities does not equal less than the combined requirements of the individual uses unless a shared parking permit is approved in accordance with paragraph 5 of this subsection.
4. 
For Uses With Varying Requirements Located on the Same Lot or Parcel of Land. In the event that uses having varying parking requirements are located on the same lot or parcel of land, the facilities provided, including collective parking facilities, shall equal the sum total of the requirements for the various individual uses computed separately in accordance with provisions in this chapter unless a shared parking permit is approved in accordance with paragraph 5 of this subsection.
5. 
Shared Parking. Multitenant developments in nonresidential zones may enter into a shared parking agreement by obtaining a conditional use permit pursuant to Chapter 6.64 and the findings listed in this section.
a. 
The following findings shall be made by the final decision-making body:
i. 
The City has been provided with an adequate legal instrument to guarantee that the uses that are subject to the shared parking agreement will not significantly change in the amount of parking required and the parking facilities provided will remain available and unaltered.
ii. 
There is no substantial conflict in the principal operating hours for the building or uses for which the joint use parking facility is proposed.
iii. 
There will be adequate parking provided on the site for all uses within the subject development.
iv. 
The joint use agreement is consistent with the general plan and all other requirements of this code.
b. 
A shared parking permit application shall include, but not be limited to, the following items:
i. 
A parking study prepared by a registered traffic engineer that specifically analyzes the parking generation, hours of operation and other related issues of all uses involved as determined by the City.
ii. 
A shared parking agreement to the satisfaction of the City of Walnut. Said agreement shall address the amount of parking provided and the justification for any reduction in the number of spaces required for all uses involved. This agreement may also include conditions of operation for the uses in the subject development.
iii. 
A copy of any required easement, lease, license agreements, or other legal instruments before approval of any shared parking agreement.
c. 
Shared parking shall only be permitted on properties that are adjacent, that are within an integrated multitenant development, or where an off-site parking agreement has been approved pursuant to paragraph 6 of this subsection.
6. 
Off-Site Parking. Off-site parking may be permitted for nonresidential projects subject to obtaining a conditional use permit pursuant to Chapter 6.64 and the findings listed in this section. An off-site parking permit shall be subject to the following criteria:
a. 
All off-site parking facilities shall be located within 1,000 feet of the property where the use in question is located.
b. 
A binding agreement shall be prepared and recorded that maintains the parking site for the same period of time as the lease or purchase of the site where the use is located.
c. 
Public transit service shall be available from a location near the off-site parking lot to a location near the parcel where the use is located on a regular basis.

§ 6.68.050 Motor vehicle maneuvering and parking space layout.

A. 
Parking Space Dimensions.
1. 
Open parking spaces shall be a width of nine feet and a length of 20 feet.
2. 
Garage parking stalls shall be not less than 10 feet wide and 20 feet long.
B. 
Maneuvering Areas Adjacent to Parking Spaces. Maneuvering areas adjacent to parking spaces shall be arranged in accordance with the diagrams contained in this section.
C. 
Required Driveways Other Than Maneuvering Areas.
1. 
Driveways for Residential Uses. Driveways, other than maneuvering areas, serving to provide vehicular access to residential uses in any zone shall conform to the following provisions:
a. 
Driveways serving not more than two dwelling units shall have a width of not less than 10 feet.
b. 
Driveways serving three or more dwelling units shall have a width of not less than 20 feet. In lieu of a 20-foot driveway, two driveways of not less than 10 feet each may be substituted. Where used, such driveways shall have directional signs provided to ensure one-way ingress and egress respectively.
2. 
Other Than Residential Uses. Required aisles or driveways other than maneuvering areas, to serve other than residential uses, shall have a minimum width of 10 feet to accommodate one-way vehicular traffic, and a minimum width of 20 feet to accommodate two-way vehicular traffic, except as otherwise provided herein.

D. 
Turn-Around Areas. Any required garage, carport or parking space situated more than 100 feet from the street or highway from which access is taken, and served by a driveway, shall have a motor vehicle turnaround area adjacent thereto.
E. 
Modification of Maneuvering and Parking Space Layout. The Planning Commission may grant a modification of the maneuvering area, parking space layout or driveways required by this section where topographic features, or other conditions, create an unnecessary hardship or unreasonable situation making it impractical to require compliance with such requirements. All requests for modification shall be subject to the provisions of Chapter 6.84, site and building plan review.

§ 6.68.060 Parking area circulation.

A. 
Required parking for three or more motor vehicles shall be arranged to permit vehicular traffic to move into and out of the parking area without the backing of any motor vehicle onto a street or highway.
B. 
Parking areas having more than one aisle or driveway shall have directional signs provided in each aisle or driveway.

§ 6.68.070 Development of parking facilities.

A. 
Paving. All required parking spaces, maneuvering areas and any driveways used for access thereto shall be finished with:
1. 
Concrete or masonry surfacing to a minimum thickness of three and five-eighths inches and shall include expansion joints as necessary.
2. 
Asphalt-type surfacing compacted to a minimum thickness of one and one-half inches, laid over a base of crushed rock, gravel or other similar material compacted to a minimum of three inches.
3. 
Gravel or other impervious material in the rural overlay zone, subject to review and approval of the Planning Commission under the site plan and architectural review procedure provided in Chapter 6.84.
Concrete gutters shall be provided for all drainage courses.
B. 
Marking of parking spaces. Wherever three or more motor vehicle parking spaces are required, each space shall be clearly marked with paint or other easily distinguishable material.
C. 
Bumperguards or Wheelstop. Bumperguards or wheelstops, where appropriate, shall be provided for all required motor vehicle parking spaces except spaces established in a garage or carport.
D. 
Walls.
1. 
Front Yards.
a. 
No portion of a required front yard in a residential, commercial or industrial zone may be developed for required parking;
b. 
Except at accessway, perpendicular to the street, the setback area shall be landscaped.
2. 
Side or Rear Yards. Where required parking facilities for motor vehicles are located on land adjoining a residential zone, such parking facilities shall, except as otherwise provided herein, have a solid masonry wall, not less than five feet nor more than six feet in height established along the side and rear lot lines adjoining such zones except that:
a. 
Where such wall is located within 10 feet of any street, highway or alley and would interfere with the line of sight of the driver of a motor vehicle leaving the property on a driveway, or moving past a corner at the intersection of two streets or highways, the wall shall not exceed a height of three feet;
b. 
Such wall shall be not less than four feet in height above the surface of the adjoining, property, and it shall be set back from the adjoining property line a distance of one foot for each one foot in height above six feet.
E. 
Landscaping.
1. 
All setback area, except for accessway, shall be landscaped and continuously maintained.
2. 
Required parking facilities for motor vehicles shall, in addition, include interior landscaping to cover not less than seven percent of the area devoted to outdoor parking facilities whenever more than 15 off-street parking spaces are provided.
3. 
No planting area shall be less than 30 square feet or less than four feet in width with the exception of raised planter boxes around or in close proximity to buildings.
4. 
Required landscaping shall be subject to the provisions of Chapter 6.84.
F. 
Lighting. Lighting of outdoor parking areas shall be arranged to prevent glare or direct illumination in any adjacent residential zone.
