CHAPTER 6

32 R-3 MULTIPLE FAMILY RESIDENTIAL ZONE

§ 6.32.010 Intent of zone.

An R-3 zone is intended to provide for the development of multiple family dwellings, apartment houses, group houses and other similar buildings.

§ 6.32.020 Permitted uses.

Only the following buildings, structures and uses are permitted in the R-3 zone. No buildings or structures shall be erected, structurally altered or enlarged, or land used, except for the following purposes:
A. 
Churches, subject to a conditional use permit.
B. 
Convalescent or rest homes, subject to a conditional use permit.
C. 
Multiple dwelling units or apartment houses.

§ 6.32.030 Accessory buildings and uses.

Accessory buildings and uses shall be permitted in an R-3 zone only to the extent necessary and normal to the limited types of use permitted in this zone. Accessory buildings and structures are permitted in the rear and side yards; provided, that no building or structure is permitted in the side yard within 60 feet of the front lot line, nor within five feet of a side property line, nor permitted at all in a side yard abutting a street. All accessory buildings which are not a part of the main building shall be separated from the main building by at least 10 feet.

§ 6.32.040 Lot area and size.

A. 
Lot Area. The minimum lot area shall be 9,000 square feet.
B. 
Lot Dimensions. The minimum lot dimensions shall be:
1. 
Minimum width: 75 feet.
2. 
Minimum depth: 100 feet.
C. 
Minimum lot area per dwelling unit: 3,000 square feet per dwelling unit.

§ 6.32.050 Floor area and height restrictions.

The floor area and height restrictions for an R-3 zone are as follows:
A. 
In multiple family dwelling residences and in apartment houses the minimum floor area per dwelling unit:
1. 
Bachelor apartment: 550 square feet.
2. 
One-bedroom apartment: 650 square feet.
3. 
Two-bedroom apartment: 750 square feet plus a minimum of 100 square feet for each additional room.
B. 
The maximum building or structural height of the main building shall be two stories, or 35 feet, whichever is the lesser, and one story, or 15 feet whichever is the lesser, for accessory buildings. Any basement or portion thereof which projects more than two feet at any one place above the average adjoining grade shall be deemed a story for the purposes of this section in ascertaining building or structural height limitations.

§ 6.32.060 Yard regulations.

The yard regulations in an R-3 zone are as follows:
A. 
Front Yard.
1. 
Each lot in the R-3 zone shall have a front yard extending, except for access drives and walks, across the full width of the subject property of a depth of not less than 20 feet.
2. 
There shall be no structures located in a required front yard or in a required side yard abutting a street. No boat or trailer may be kept in such yard for a period of time in excess of 24 consecutive hours.
B. 
Side Yard. There shall be a side yard on each side of the lot extending from the front yard to the rear yard not less than five feet in width. A corner lot shall have a side yard abutting the street of not less than 10 feet.
C. 
Rear Yard. Each lot shall have a rear yard extending, except for access drives and walks, across the full width of the lot of a depth of not less than 20 feet. Accessory buildings are permitted in the rear yard. Any rear yard covered by structures shall be replaced on the lot exclusive of required yard areas.
D. 
Other Yard Requirements. Yards may be used for structures, landscaping, paving, parking, and storage as noted in Sections 6.08.080 through 6.08.140 except as noted in Chapter 3.36. Items that are not otherwise allowed in the front yard shall be located behind a minimum five foot high fence/gate. The fence/gate may be an open work fence gate.
E. 
Impervious Surfaces/Landscaping. Walkways, parking areas, vehicular accessways and other impervious surfaces shall not collectively occupy more than 50% of the entire front yard area, as required by the Walnut Zoning Code. All other areas shall be landscaped with lawn, trees, shrubs, ground covers and other plant materials and shall be properly maintained in a neat and orderly manner. The area necessary for providing access to the garage (maximum 25 feet wide) shall not be included in the calculation of impervious surfaces. Exceptions may be granted by the Planning Commission in accordance with Chapter 6.84 relative to site plan and architectural review.
F. 
Boats, Trailers or Recreational Equipment. Any boat, trailer or recreational equipment incapable of movement under their own power may not be parked or stored in the areas from the lot line(s) abutting a street to a line parallel with the main structure.

§ 6.32.070 Lot coverage.

The maximum coverage of the lot in an R-3 zone by all structures shall not exceed 60% of the lot building area; provided, that any semi-enclosed patio structure which is used solely for general open use shall not be counted as a structure in ascertaining coverage, nor shall swimming pools be counted.

§ 6.32.080 Access.

A. 
When a lot abuts upon an existing or proposed alley, all garages or accessory buildings having access from the alley shall be located not less than 29 feet from the opposite side of such abutting alley. The ingress and egress to any such garage, or accessory building, housing or intended to house any motor vehicle, shall be from such abutting alley only, and not from the street.
B. 
Width of access other than from an alley shall be 20 feet or as determined by the Planning Commission.

§ 6.32.090 Signs.

The provisions of Chapter 6.92 shall apply in determining the permitted signs.

§ 6.32.100 Off-street parking.

The provisions of Chapter 6.68 shall apply in determining the amount of parking space that must be provided for each use in an R-3 zone. The parking space shall be improved as set forth in said chapter.
