CHAPTER 6

40 C-1 LIGHT COMMERCIAL ZONE

§ 6.40.010 Intent of zone.

Zone C-1 is established to provide for restricted neighborhood retail commercial and residential needs. Business and professional offices and limited retail stores and single-family residences are permitted. Provisions are included to allow public educational institutions and the establishment of necessary public service facilities. The standards of development in Zone C-1 are designed to protect adjacent zones, promote orderly development and avoid the creation of traffic congestion within the neighborhood.

§ 6.40.020 Permitted uses.

Premises in Zone C-1 may be used for the following principal uses, provided all goods sold are new and all sales are retail only; all uses shall be conducted within an enclosed building:
1. 
Bakery shops, including baking only when incidental to retail sales from the premises.
2. 
Banks, savings and loan and credit unions.
3. 
Barber and beauty shops.
4. 
Bicycle sales and service.
5. 
Clothing, furrier and hattery shops, including alterations.
6. 
Copying, duplicating, addressing and mailing services.
7. 
Cleaning and dyeing agencies, including incidental spotting, sponging, pressing and repairs.
8. 
Colleges and universities, including appurtenant facilities, giving advanced academic instruction approved by the State Board of Education or other recognized accrediting agency, but excluding trade or commercial schools.
9. 
Community social centers.
10. 
Country clubs.
11. 
Dental clinics, including laboratories in conjunction therewith.
12. 
Dry cleaning, self-service.
13. 
Dwelling, single-family.
14. 
Institutions of educational, philanthropic and charitable nature, not including any commercial or industrial enterprise sponsored or operated by such institutions.
15. 
Interior decorating shops.
16. 
Jewelry stores with incidental repairs.
17. 
Laundries, self-service.
18. 
Locksmith shops.
19. 
Meat and poultry markets, not to include slaughtering.
20. 
Medical clinics, including laboratories in conjunction therewith.
21. 
Museums, within an enclosed building only.
22. 
Offices, business and professional.
23. 
Office equipment, including incidental repairs.
24. 
Pet supply shops, not to include pets.
25. 
Photograph studios.
26. 
Pottery stores, but not including a kiln or manufacturing.
27. 
Radio and television stores, including incidental repairs.
28. 
Restaurants and other eating establishments, not including drive-ins.
29. 
Retail stores.
30. 
Shoe repair shops.
31. 
Shoeshine stands within a building.
32. 
Tailor shops, custom tailoring only.
Similar uses—Other commercial or related uses by resolution of the Planning Commission or City Council, provided they are similar in character to those enumerated in this section.

§ 6.40.030 Additional uses by conditional use permit.

Premises in Zone C-1 may be used for the following purposes, provided a permit has first been obtained, pursuant to the provisions of Chapter 6.64:
1. 
Auditoriums and conference rooms.
2. 
Automobile service stations.
3. 
Bars and cocktail lounges.
4. 
Churches, temples and other places of religious worship.
5. 
Gas measurement stations.
6. 
Hospitals.
7. 
Ice vending machine.
8. 
Lodge halls.
9. 
Model homes, not occupied as a residence.
10. 
Mortuaries.
11. 
Nurseries, including growing of nursery stock.
12. 
Nursery schools, subject to the provisions of Section 6.08.230.
13. 
Parking lots and parking buildings as a commercial business.
14. 
Private clubs.
15. 
Rest homes.
16. 
Schools, through grade 12, accredited, including appurtenant facilities which offer instruction required to be taught in the public schools by the Education Code of the State of California and in which no pupil is physically restrained, but excluding trade or commercial schools. Private schools also subject to the provisions of Section 6.08.230.
17. 
Stations, bus, railroad and taxi.
18. 
Swimming pools, commercial.
19. 
Theaters.
20. 
Tutoring and learning centers, subject to the provisions of Sections 6.08.230 and 4.12.130.
21. 
Water wells, reservoirs, tanks, dams, treatment plants, gaging stations, pumping stations and any use normal and appurtenant to the obtainment, storage and distribution of water.
22. 
Wedding chapels.
23. 
Water wells, reservoirs, tanks, dams, treatment plants, gaging stations, pumping stations and any use normal and appurtenant to the obtainment, storage and distribution of water.

§ 6.40.040 Accessory uses.

Premises in Zone C-1 may be used for accessory uses provided such uses are established on the same lot or parcel of land, are incidental to, and do not substantially alter the character of any permitted principal use, including but not limited to:
A. 
Accessory buildings or structures.
B. 
Storage of building materials used in the construction of a building or building project, during the construction and 30 days thereafter, including the contractor’s temporary office; provided, that any lot or parcel of land so used shall be a part of the building project or on property adjoining the construction site.
C. 
Retail sale of used articles taken as trade-in on the sale of new articles.
D. 
Access to property lawfully used for purposes not permitted in Zone C-1 provided no other practical access to such property is available, and such access will not alter the character of the premises in respect to permitted uses in Zone C-1.
E. 
Antennas, towers, telecommunication facilities and their support structures pursuant to Chapter 6.88.

§ 6.40.050 Lot area and size.

Premises in Zone C-1 shall be subject to the development standards prescribed in this section:
A. 
Lot Area. Each lot or parcel of land in Zone C-1 shall have a minimum lot area of not less than 7,200 square feet.
B. 
Lot Width. Each lot or parcel of land in Zone C-1 shall have a minimum lot width of not less than 60 feet.

§ 6.40.060 Height restrictions.

A. 
Height Limit. No lot or parcel of land in Zone C-1 shall have a building or structure in excess of two stories or 35 feet in height, whichever is less.
B. 
Maximum Lot Coverage. No lot or parcel of land in Zone C-1 shall have lot coverage by buildings or structures in excess of 50% of the lot area.

§ 6.40.070 Yard requirements.

A. 
Front Yard. The setback shall be 20 feet.
B. 
Side Yards. Each lot or parcel of land in Zone C-1 which has a side lot adjoining property in a residential zone and/or street frontage shall have a side yard of not less than 10 feet in width on the side adjoining such residential lot or street frontage.
C. 
Rear Yard. Each lot or parcel of land in Zone C-1 which has a rear lot line adjoining property in a residential zone shall have a rear yard of not less than 20 feet in depth.

§ 6.40.080 Off-street parking.

Each lot or parcel of land in Zone C-1 shall have off-street parking and loading facilities as prescribed in Chapter 6.68.

§ 6.40.090 Fences and walls.

Each lot or parcel of land in Zone C-1 which has a side or rear lot line adjoining property in a residential zone shall have a solid masonry wall, not less than five feet in height nor more than six feet in height, established along such side and rear lot lines adjoining such zones, except the height shall not exceed three feet in height within the front yard setback area.

§ 6.40.100 Signs.

Each lot or parcel of land in Zone C-1 may have such signs as prescribed in Chapter 6.92.

§ 6.40.110 Outdoor sales, display or storage.

All sales, display and storage in the C-1 zone shall be located wholly within an enclosed building except as provided in Section 6.08.220.
