CHAPTER 12

OFF-STREET PARKING REQUIREMENTS

12-12-1: PLANS AND SPECIFICATIONS:

No building permit shall be issued until the applicant has presented satisfactory evidence to the Building Official that the off-street parking facilities required by the provisions of this chapter will be provided and maintained. Such evidence shall include, but not necessarily be limited to, detailed plans and specifications of the proposed off-street parking facilities.

12-12-2: DESIGN OF PARKING AREA:

   A.   Surfacing:
      1.   All open off-street parking areas, roads, and drives, except those located on the same lot of a single-family residential structure and used as such, shall be improved as follows: (i) a concrete surface course having a depth of not less than six inches (6") over a compacted gravel base course having a depth of not less than four inches (4"); (ii) an asphalt surface course having a depth of not less than three and one-half inches (3.5") over a compacted gravel base course having a depth of not less than eight inches (8"); a tar and chip surface course over a compacted gravel base course having a depth of not less than twelve inches (12"); or, other comparable hard surface all-weather dustless material having such depth as may be approved by the city engineer. The requirements of this section shall be met for the entire off-street parking area for all new construction projects or construction projects constituting a “substantial improvement,” whether or not located on the same lot as the principal structure or use, as well as the creation of or expansion of any off-street parking areas.
      2.   All driveways and parking areas located on the same lot of a single-family residential structure and used as such shall be improved with compacted gravel, or equivalent material with the approval of the city engineer, having a depth of not less than six (6"); provided, however, that portion of any driveway or parking area in the parkway (i.e., located between the street and the property line) shall be improved as follows: (i) a concrete surface course having a depth of not less than six inches (6") over a compacted gravel base course having a depth of not less than four inches (4"); or (ii) an asphalt surface course having a depth of not less than three and one-half inches (3.5") over a compacted gravel base course having a depth of not less than eight inches (8"). The requirements of this section shall be met for the entire driveway and/or parking area for all new construction projects or construction projects constituting a “substantial improvement,” as well as the creation of or expansion of any driveway or parking area.

   B.   Access: Access to parking facilities shall be designed with appropriate means of vehicular access to a street or alley in such a manner as will least interfere with the movement of traffic. Driveways shall be constructed in accordance with Section 9-3-1 of this Code.
   C.   Screening And Landscaping (see also subsection 13-3-5H9e of this Code): All open off-street parking areas and access driveways that are four (4) spaces or more, even if for residential use, and those spaces and access driveways that serve uses other than residential, shall be effectively screened along the entire boundary by a wall or solid fence or a densely planted compact hedge along any side which adjoins, or is directly across a street or alley from, a property in a residential district. The public right-of-way between the curb and the property line shall not be screened.
   D.   Penalty: Any person found in violation of any provision of this section shall be fined not less than Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00) for each offense. Each day that said violation continues shall be considered to be a separate offense.

12-12-3: PARKING SPACE REQUIREMENTS:

   A.   One hundred eighty (180) square feet of lot or floor area which has a means of ingress or egress from an alley or street shall be deemed parking space for one vehicle.
   B.   The space shall not occupy any part of any required front yard, but where open, may be included as part of a required open space for side or rear yard.
   C.   On corner or through lots, parking space may not be included as part of required yards lying adjacent to either street.
   D.   Lights used to illuminate parking lots shall be so arranged as to reflect lighting away from the adjoining premises.

12-12-4: NUMBER OF PARKING SPACES:

   A.   For all new construction to be used for residential purposes in any district, there shall be provided at least one off-street parking space for each dwelling unit.

   B.   All Other Uses Except The Central Business District:
      1.   Provide one off-street parking space for each three hundred (300) square feet of building area in the B-1 District (retail) and one space for each five hundred (500) square feet of building area in the M Districts.
      2.   Off-street parking requirements may be met on a separate lot, if within two hundred feet (200') of the lot in question and under the same ownership.
      3.   To encourage continued business growth in the Central Business District, no off-street parking shall be required, except for residential uses.
      4.   If the owner objects to the requirements of one space for each three hundred (300) or five hundred (500) square feet in subsection A of this section, as the case may be, the owner may file an application for a variance in accordance with section 12-3A-11 of this title.

12-12-5: MAINTENANCE OF FACILITIES:

Off-street parking spaces required by this chapter shall be maintained in good condition, so long as the structure or use for which they are provided exists.
