CHAPTER 9

BUSINESS DISTRICTS

12-9-1: USES EXCLUDED IN ALL BUSINESS DISTRICTS:

The following uses are specifically excluded from Business Districts:
Any use which creates detrimental noise, odor, fumes, dust, waste, or vibration causing unlawful annoyance or damage, which creates abnormal traffic congestion, or which is dangerous because of high combustible materials used or manufactured; and any of the following uses:
Animal feedlots.
Bottling works.
Bulk storage of petroleum products.
Coal yards.
Contractor plant or storage yard.
Equipment storage yards.
Hatcheries.
Junkyards.
Livestock sales yards.
Manufacturing and industrial uses, except those incidental to an accepted use.
Milk receiving and/or processing.
Mobile homes.
Motor vehicle wrecking yards.
Poultry dressing.
Trucking depots.

12-9A-1: PERMITTED USES:

The following uses are permitted in the B-1 District or Neighborhood Business District:
Any retail or commercial business use not excluded in section 12-9-1 of this chapter; and all residential uses, except those of mobile homes or trailers.

12-9A-2: LIMITATIONS ON CERTAIN USES:

Residential uses shall be subject to the following conditions and standards:
   A.   Single-family homes shall be subject to the standard use requirements for R-2 Districts as provided by section 12-6B-4 of this title.
   B.   Duplex residential homes shall be subject to the standard use requirements for R-3 Districts as provided by section 12-6C-4 of this title.
   C.   Multi-family residential homes shall be subject to the standard use requirements for R-4 Districts as provided by section 12-6D-4 of this title.

12-9A-3: SPECIAL USES:

Special uses may be granted herein in accordance with the provisions of chapter 3, article C of this title; provided, that the minimum standard use requirements hereof are observed.

12-9A-4: STANDARD USE REQUIREMENTS:

The following standard use requirements must be observed for B-1 Districts:
   A.   Lot Size: The minimum lot size shall be six thousand (6,000) square feet. Any lot exclusively used for the operation of a cell tower shall be excluded from the six thousand (6,000) square foot minimum lot size requirement.

   B.   Average Width Of Lot: The minimum average width of a lot shall be fifty feet (50').
   C.   Front Yard: The building front shall be set back to allow for the existing site line or where no site line may be established, a distance of twenty five feet (25'). This will be the minimum requirements.
   D.   Building Height: The maximum building height shall not exceed thirty five feet (35'), except in the cases of radio or TV towers, stacks, elevators or assemblages, or other structures wholly constructed of fireproof materials, the height thereof shall not exceed sixty feet (60').
   E.   Floor Area: The minimum floor area allowable per dwelling shall be none.
   F.   Open Space: The minimum open space is twenty percent (20%) of the lot. Open space does include required drive and parking areas.
   G.   Required Trees: Each two thousand (2,000) square feet of lot area shall require one deciduous tree; provided, that not more than five (5) trees shall be required on any one lot. Each tree shall be a minimum of one inch (1") in diameter.

12-9B-1: PERMITTED USES:

The following uses are permitted in the B-2 or Central Business District:
Public library and any retail, commercial or professional business use not excluded in section 12-9-1 of this chapter; and all residential uses, except those of mobile homes or trailers.

12-9B-2: LIMITATIONS ON CERTAIN PERMITTED USES:

Residential uses above the first floor of businesses may be permitted if parking is provided as per residential requirements.

12-9B-3: SPECIAL USES:

Special uses may be granted herein in accordance with the provisions of chapter 3, article C of this title; provided, that the minimum standard use requirements in this article are observed.

12-9B-4: STANDARD USE REQUIREMENTS:

The following standard use requirements must be observed for B-2 Districts:
   A.   Lot Size: The minimum lot size shall be none.
   B.   Average Width Of Lot: The minimum average width of a lot shall be none.
   C.   Yards: The minimum yard requirements shall be none.
   D.   Building Height: The maximum building height shall not exceed thirty five feet (35'), except in the cases of radio or TV towers, stacks, elevators or assemblages, or other structures wholly constructed of fireproof materials, the height thereof shall not exceed sixty feet (60').
   E.   Floor Area: The minimum floor area shall be none.
   F.   Open Space: The minimum open space shall be fifty (50) square feet.
   G.   Parking: No parking is required, except for residential uses.
