CHAPTER 6

RESIDENTIAL DISTRICTS

12-6-1: AVERAGE DEPTH OF FRONT YARDS:

Whenever the established average front yards in any R District occasioned by dwellings previously built is less than the required front yards herein established, all new construction shall conform to the required front yards herein established. Whenever the established average front yards in any R District occasioned by dwellings previously built is more than the required front yards herein established, all new construction shall conform to the established average front yards; provided, that any owner of lands affected by this rule, who wishes to place new construction thereon, may avail himself of the special use procedures herein established for the purpose of obtaining a modification of said rule as to his property. 12-6A-1: PERMITTED USES:

Unless otherwise provided in this title, no building or land shall be used, and no building shall be erected, converted, enlarged or structurally altered, in the R-1 District except for one or more of the following uses:
Accessory buildings.
Grain farm.
Home garden.
Home occupations.
Park.
Playground.
Single-family dwellings.

12-6A-2: LIMITATIONS ON CERTAIN USES:

   A.   Accessory buildings and uses, if detached, shall be located no closer than two feet (2') to any rear yard or interior side yard but not in the front sixty feet (60') of the lot.
   B.   Home occupations shall not exceed twenty five percent (25%) of the gross floor area of the dwelling unit. Only one sign, not greater than one square foot, shall be permitted. No display of goods or services shall be visible from the outside.

12-6A-3: SPECIAL USES:

Special uses may be granted herein in accordance with the provisions of chapter 3, article C of this title; provided, that the minimum standard use requirements hereof are observed.

12-6A-4: STANDARD USE REQUIREMENTS:

   A.   Lot Size: The minimum lot size shall be eight thousand five hundred (8,500) square feet.
   B.   Average Width Of Lot: The minimum average width of a lot shall be seventy five feet (75').
   C.   Yards: The minimum yard requirements shall be:
      1.   Front yard: Thirty feet (30').
      2.   Each side yard: At least ten percent (10%) of the width of the lot.
      3.   Rear yard: Twenty feet (20').
      4.   Where a lot is at the intersection of two (2) or more streets, the building shall also be set back to allow for a site line.
   D.   Building Height: The maximum building height shall not exceed thirty five feet (35'), except in the cases of radio or TV towers, stacks, elevators or assemblages, or other structures wholly constructed of fireproof materials, the height thereof shall not exceed sixty feet (60').
   E.   Floor Area: The minimum floor area allowable per dwelling is one thousand two hundred (1,200) square feet.
   F.   Open Space: The minimum open space is seventy percent (70%) of the lot. Open spaces do include required drive and parking space.
   G.   Required Trees: Each two thousand (2,000) square feet of open area shall require one deciduous tree; provided, that not more than five (5) trees shall be required on any one lot. Each tree shall be a minimum of one inch (1") in diameter.

   A.   Standard Use Requirements:
      1.   Lot Size: The minimum lot size shall be six thousand five hundred (6,500) square feet.
      2.   Average Width Of Lot: The minimum average width of a lot shall be fifty feet (50').
      3.   Yards: The minimum yard requirements shall be:
         a.   Front yard: Twenty five feet (25').
         b.   Each side yard: At least ten percent (10%) of the width of the lot.
         c.   Rear yard: Twenty feet (20').
         d.   Where a lot is at the intersection of two (2) or more streets, the building shall also be set back to allow for a site line.
      4.   Building Height: The maximum building height shall not exceed thirty five feet (35'), except in the cases of radio or TV towers, stacks, elevators or assemblages, or other structures wholly constructed of fireproof materials, the height thereof shall not exceed sixty feet (60').
      5.   Floor Area: The minimum floor area allowable per dwelling is nine hundred (900) square feet.
      6.   Open Space: The minimum open space is fifty percent (50%) of the lot. Open spaces do include required drive and parking space.
      7.   Required Trees: Each two thousand (2,000) square feet of open area shall require one deciduous tree; provided, that not more than five (5) trees shall be required on any one lot. Each tree shall be a minimum of one inch in (1") diameter.

   B.   Exemptions: Where the parcel in question is a fifty foot (50') corner lot platted prior to 1961, the Building Official may waive the setback for a site line on one of the two (2) adjoining streets but shall require sufficient setback to allow for vehicles approaching the intersection of the two (2) streets to have a reasonably clear view of oncoming traffic into such intersection.

      3.   Yards: The minimum yard requirements shall be:
         a.   Front yard: Twenty five feet (25').
         b.   Each side yard: Six feet (6').
         c.   Rear yard: Twenty feet (20').
         d.   Where a lot is at the intersection of two (2) or more streets, the building shall also be set back to allow for a site line.
         e.   Where a duplex resident is so subdivided that each of the two (2) units in such duplex is in a separate lot or parcel, no side yard shall be required on the side of the duplex living unit connected with the other side.
      4.   Building Height: The maximum building height shall not exceed thirty five feet (35'), except in the cases of radio or TV towers, stacks, elevators or assemblages, or other structures wholly constructed of fireproof materials, the height thereof shall not exceed sixty feet (60').
      5.   Floor Area: The minimum floor area allowable per dwelling is seven hundred (700) square feet.
      6.   Open Space: The minimum open space is thirty percent (30%) of the lot. Open space does include required drive and parking space.
      7.   Required Trees: Each two thousand (2,000) square feet of open area shall require one deciduous tree; provided, that not more than five (5) trees shall be required on any one lot. Each tree shall be a minimum of one inch (1") in diameter.
