CHAPTER 18

38 - B4 RESTRICTED BUSINESS DISTRICT

18.38.010 - Permitted uses.

The following uses of land or building are permitted:

Business offices.

Offices of professional persons, including medical offices.

Art galleries.

Antique shops.

Banks and trust companies, savings and loan associations and similar institutions and their drive-in facilities.

Book and stationery stores.

Camera and photogenic supply shops for retail sale.

Candy and ice cream shops.

China and glassware stores.

Clothing stores.

Coin and philatelic stores.

Florist shops.

Funeral homes.

Furniture stores.

Furriers, when conducted for retail trade on the premises only.

Gift shops.

Haberdasheries.

Jewelry and watch repair shops.

Leather goods and luggage stores.

Millinery shops.

Musical instrument sales and repair, retail trade only.

Opticians, optometrists.

Photo developing and processing shops.

Photography studios.

Physical culture and health services.

Restaurants, tea rooms, or cafes, when the establishment is not of the drive-in type where food is served to occupants remaining in motor vehicles.

Schools-art, dancing, vocational, professional and business.

Shoe and hat stores; shoe repair shops.

Sporting goods stores.

Theaters, indoor.

Toy stores.

Wearing apparel shops.

Hotels and motels, including restaurants and meeting rooms.

18.38.020 - Height and setbacks.

(a)

Buildings shall not exceed four stories in height, excluding basements, unless fifty percent or more of the finished floor-to-ceiling height of the basement is above curb level or finished grade, in which event it shall be counted as a story.

(b)

For the first one hundred feet of frontage adjacent to property in a residence district fronting on the same street, all buildings or portions thereof in the B4 district shall be set back from the front property line for a distance of not less than twenty-five feet, provided that such one hundred foot requirement may be reduced by the width of any street or alley intervening between the property in the residence district and the property in the B4 district.

(c)

Along the side lot line which adjoins or is separated only by an alley from property in a residence district, buildings in the B4 district shall be set back at least ten feet from the nearest property lines in the residence district.

(d)

Along front property lines in a B4 district, across a street from a residence district, buildings shall be set back at least ten feet from the front lot lines.

(e)

In a B4 district, all buildings shall be set back at least twenty-five feet from the rear property lines.

18.38.030 - Special uses.

The special uses and the regulations governing special uses in the B3 district shall apply in the B4 district. In addition thereto, the allowed special uses by the plan and zoning commission must be in accordance with the requirements and procedures in Chapter 18.48.

18.38.040 - Conditions of use.

Residential living units, except for units in hotels and motels, shall not be permitted below the second floor, unless in a building allowed as a special use by the plan and zoning commission.

18.38.050 - Prohibited uses.

Adult-Use Cannabis Business Establishments

Adult-Use Cannabis Craft Growers

Adult-Use Cannabis Cultivation Centers

Adult-Use Cannabis Dispensing Organizations

Adult-Use Cannabis Infuser Organization or Infusers

Adult-Use Cannabis Processing Organization or Processors

Adult-Use Cannabis Transporting Organization or Transporters
