CHAPTER 18

28 - B1 OFFICE BUSINESS DISTRICT

18.28.010 - Permitted uses.

The following uses of land or buildings are permitted:

Accessory uses which:

(1)

Serve and are subordinate in function and area to principal uses;

(2)

Contribute to the comfort, convenience or necessity of the occupants of the principal buildings or principal uses served; and

(3)

Are customarily associated with such principal uses in an accessory capacity.

Art galleries for display purposes only and not including retail shops selling gifts or antiques.

Barber shops, beauty parlors, chiropody, massage or similar personal services shops.

Business offices, other than personal services and where no product is made or offered for sale to the general public.

Funeral homes.

Offices of professional persons such as physicians, dentists (but not including veterinarians), attorneys, architects and engineers, and including outpatient medical and dental clinics, but not hospitals.

Off-street parking and loading facilities, as regulated by Chapter 18.44.

Outdoor seating for restaurants as enumerated in Section 18.32.040(e) Outdoor seating for restaurants.

Photography studios.

Public libraries.

Residential living units above the ground floor.

Schools—Art, dancing, vocational, professional and business.

Signs, as regulated by Chapter 5.64.

Telephone booths, public.

18.28.020 - Height and setbacks.

(a)

Buildings shall not exceed two stories in height, excluding basements, unless fifty percent or more of the finished floor-to-ceiling height of the basement is above curb level or finished grade, in which event it shall be counted as a story.

(b)

For the first one hundred feet of frontage adjacent to property in a residence district fronting on the same street, all buildings or portions thereof in the B1 district shall be set back from the front property line for a distance of twenty-five feet, provided that such one hundred foot requirement may be reduced by the width of any street or alley intervening between the property in the residence district and the property in the B1 district.

(c)

Along a side lot line which adjoins or is separated only by an alley from property in a residence district, buildings in the B1 district shall be set back at least ten feet from the nearest property lines in the residence district. Along front property lines in a B1 district, across a street from a residence district, buildings shall be set back at least ten feet from such front lot lines.

In a B1 district, all buildings shall be set back at least twenty feet from rear property lines.

18.28.030 - Special uses.

The following uses may be allowed as special uses in a B1 district by the plan and zoning commission in accordance with the requirements and procedures in Chapter 18.48:

Bus terminals and other public transportation terminal facilities.

Churches, rectories, parish houses.

Hospitals and sanitariums.

Hotels and motels, including restaurants and meeting rooms.

Meeting halls, for nonprofit organizations only.

Other municipal buildings.

Other similar uses.

Planned unit developments.

Public utility and public services uses, including:

Electric substations;

Gas regulating stations;

Fire stations;

Police stations;

Service stations;

Other municipal buildings.

Telephone exchanges, repeater stations, microwave relay towers and stations, mobile transmitting towers and stations, antenna towers and other outdoor equipment essential to the operation of the exchange in the interest of public convenience and necessity and including business offices in conjunction therewith.

Water filtration plants, water pumping stations, water reservoirs.

18.28.040 - Conditions of use.

(a)

In the B1 district, there shall be no storage, wholesale or retail sales, shipping or display of goods or merchandise on the premises except for:

(1)

Incidental and minor storage and retail which is clearly accessory to and customarily associated with the operation of a professional office, such as the dispensing of medicines by physicians on an individual patient basis;

(2)

Displays limited to floor samples in a business office;

(3)

The exhibition of individual art or craft products in an art gallery; and

(4)

Displays of materials or work normally connected with the operation of a library, school, church, photography studio; or other similar uses. However, in the B1 district there shall be no window display of goods or merchandise nor any other display, including floor samples, which is readily visible from the public way or from adjoining properties.

(b)

All business and professional activities shall take place within enclosed buildings.

(c)

Residential living units, including lodging rooms, are not permitted below the second floor except in a building allowed as a special use by the plan and zoning commission.

Adult-Use Cannabis Dispensing Organizations

Adult-Use Cannabis Infuser Organization or Infusers

Adult-Use Cannabis Processing Organization or Processors

Adult-Use Cannabis Transporting Organization or Transporters
