ARTICLE XIV

HIGH EDUCATION DISTRICT HE*

Sec 21-127 Statement Of Intent

This district is to protect the area of the town which now encompasses the college and to provide for fraternity and sorority houses. This district is also designed to protect the campus environment and to allow for the orderly expansion of the college by not allowing the encroachment of uses that would be detrimental to the college or town.

Sec 21-128 Use Regulations

  1. Colleges, offering general education courses.
  2. Parks, playgrounds, and athletic fields, with a conditional use permit.
  3. Major utilities such as plant expansions, tanks, pump stations, or other buildings require a conditional use permit. See ATC article XXII of this chapter for underground utility requirements.
  4. Off-street parking in accordance with ATC chapter 21, article XIX.
  5. Signs in accordance with ATC chapter 21, article XX.
  6. Dormitories, with a conditional use permit.
  7. Accessory buildings as defined.
  8. Churches or other places of worship.
  9. Single-family detached dwellings.
  10. Fraternity and sorority houses, with a conditional use permit.
  11. Home occupations.
  12. Wireless communications antennas and related equipment, with a conditional use permit, provided that such antennas and related equipment attached to an existing building or other structure, including a steeple or smokestack, and such attachment is installed so as to mask the utilitarian nature of the antennas and that any related ground based equipment are screened from view. A plan depicting the installation and the means by which such antennas will be masked and the ground-based equipment will be screened shall be submitted to the director of planning for approval.
  13. Special interest house, with a conditional use permit. There is a maximum occupancy per house of twenty (20) people. Must adhere to all terms and conditions of the fraternity and sorority house designation.

Sec 21-129 Area Regulations

None, except that a lot occupied by a single-family detached dwelling or a fraternity or sorority house shall contain a lot area of not less than fifteen thousand (15,000) square feet.

Sec 21-130 Setback Regulations

Structures shall be located twenty-five (25) feet from any street or highway right-of-way, however, single-family detached dwellings and fraternity or sorority houses shall be located forty (40) feet or more from any street or highway right-of-way. This shall be known as the "setback line."

Sec 21-131 Frontage And Yard Regulations

For single-family detached dwellings and fraternity or sorority houses:
  1. The minimum width of any lot at the setback line shall be one hundred (100) feet.
  2. Side. The minimum width of each side yard shall be fifteen (15) feet.
  3. Rear. The minimum rear yard for each main structure shall be thirty-five (35) feet.

Sec 21-132 Height Regulations

  1. No building or structure shall exceed a height of thirty-five (35) feet from grade. See ATC chapter 21, article XXV for supplemental height regulations.
  2. Exceptions to the height regulations set forth in subsection (a) may be granted by the town council upon finding that an exception is necessary to ensure that future buildings are constructed to match the scale and character of existing buildings in the HE, Higher Education district.  Requests for exceptions must be submitted in writing by the property owner or applicant.
  3. Any wireless communications antennas permitted under ATC section 21-128(l) shall not extend beyond the height of the structure upon which the antennas are attached.

Sec 21-133 Criteria For Dormitory, Fraternity And Sorority Houses

In addition to the standards otherwise applicable to conditional use permits, when evaluating conditional use permits for dormitory, fraternity and sorority houses, the planning commission and town council shall consider the following:
  1. Noise and congestion normally associated with the type of use proposed.
  2. The reasonable anticipated state of maintenance and care of the property based on the experience with other similar uses in the town.
  3. The number of vehicles and personal trips to and from the use and the times at which the trips are made, and the possibility of on-site accommodation of such vehicles.
  4. The number of residents to be housed in the facility in relation to the amount of land and the size of the structure devoted to the use.
  5. The relationship of the proposed use to existing uses on adjacent properties and in the area.

Sec 21-133.2 Landscape Plan: Landscaping, Trees, Buffers And Screening

A landscape plan shall be required and landscaping, trees, buffers, and screening shall be provided in accordance with the applicable provisions of ATC article XXIII of this chapter.
