ARTICLE XXII

UNDERGROUND UTILITY SERVICES*

Sec 21-223 In General

All new customer utility services, including but not limited to, all wires, cables, pipes, conduits, and appurtenant equipment, carrying or used in connection with the furnishing of electric power, telephone, telegraph, cable television, petroleum, gas, stream, water or sewer systems, shall, after the effective date of this article, be placed below the surface of the ground, provided that:

  1. Equipment such as electric distribution transformers, switchgear, meter pedestals, and telephone pedestals, which is normally installed above ground in accordance with accepted utility practices for underground distribution systems may be so installed;
  2. Meters, service connections and similar equipment normally attached to the outside wall of the premises it serves may continue to be so installed;
  3. Overhead utility services existing as of the effective date of this section may be repaired, replaced, or increased in capacity; and
  4. Underground service connections shall not be required where existing overhead distribution lines including poles, transformers, etc., are located across the street, provided however, that this does not waive the requirement for underground service for new subdivisions of three (3) or more lots or for developments where such service would otherwise be required, or for property abutting Route 54 and/or Route 1.
  5. Facilities such as public utility generating, booster, or relay stations, transformer substations, transmission lines and towers which are normally installed above ground in accordance with accepted utility practices may be so installed. All improvements herein required shall be constructed in accordance with accepted standards of utility practice for underground connection and construction.
  6. Whenever relocation of utility facilities is compelled by any construction undertaken by the town or on behalf of the town, the provisions of this section may be waived.
