ARTICLE II

Terminology

§ 340-4 Definitions; word usage.

A. 
Certain words, phrases and terms in this chapter are defined for the purpose thereof as follows:
ACCESSORY USE OR BUILDING
A subordinate use or building, the purpose of which is customarily incidental to that of the main use or building and on the same lot.
ADULT BOOKSTORE
A retail establishment which sells or distributes books, printed materials, movies, film strips, paraphernalia and related items which, by applying contemporary standards, have as a dominant theme or purpose an appeal to prurient interests.
ALTERATIONS
As applied to a building or a structure, a change or rearrangement in the structure parts or in the existing facilities or an enlargement, whether by extension of a side or by increasing in height or by moves from one location or position to another.
ANIMAL HOSPITAL
Any building or portion thereof designed or used for the care, observation or treatment of domestic animals.
APPLICANT
A developer submitting an application for development.
ASSISTED LIVING
A coordinated array of supportive personal and health services, available 24 hours per day, to residents who have been assessed to need these services, including residents who require formal long-term care. Assisted living promotes resident self-direction and participation in decisions that emphasize independence, individuality, privacy, dignity and homelike surroundings.
ASSISTED LIVING FACILITY
Means a facility licensed by the New Jersey Department of Health and Senior Services pursuant to N.J.A.C. 8:36 which is designed and operated to provide apartment-style housing and congregate dining while assuring that a coordinated array of supportive personal and health services are available, as needed, to four or more adult persons unrelated to the proprietor. Each unit in an assisted living facility shall offer, at minimum, one unfurnished room, a private bathroom, a kitchenette and a lockable door on the unit entrance. For purposes of the Berlin Township Code, assisted living facility shall include assisted living residences and assisted living programs as defined at N.J.A.C. 8:36-1.3.
ASSISTED LIVING RESIDENCE
A facility which is licensed by the Department of Health, in accordance with N.J.A.C. 8:36, to provide apartment-style housing and congregate dining and to assure that assisted living services are available when needed, to four or more adult persons unrelated to the proprietor. Apartment units offer, at a minimum, one unfurnished room, a private bathroom, a kitchenette, and a lockable door on the unit entrance.
BUFFER ZONE
That zone as prescribed by the Planning Board of the Township of Berlin which shall separate a residential district from a commercial or industrial district by the planting of trees or shrubbery to such a height and density so as to restrict a clear view beyond said area.
BUILDING
A structure designed, built or occupied as a sheltered or roofed enclosure for persons, animals or property, including tents, lunch wagons, dining cars, camp cars, trailers and other roofed structures.
BUILDING HEIGHT
The vertical dimension measured from the average elevation of the finished lot grade at the front of the building to the highest point of the ceiling of the top story in the case of a flat roof, to the deckline of the mansard roof and to the average height between the plate and ridge of a gable, hip or gambrel roof.
BUILDING INSPECTOR
The Building Inspector of the Township of Berlin.
BUILDING LINE
A line formed by the intersection of a horizontal plane at the average grade level and a vertical plane that coincides with the exterior surface of the building on any side. In case of a cantilevered section of a building, the vertical plane will coincide with the most projected surface. All yard requirements are measured to the building line.
COMMON OPEN SPACE
An open space area within or related to a site designated as a development and designed and intended for the use or enjoyment of residents and owners of the development. Common open space may contain such complimentary structures and improvements as are necessary and appropriate for the use or enjoyment of residents and owners of the development.
CONDITIONAL USE
A use permitted in a particular zoning district only upon a showing that such use in a specified location will comply with the conditions and standards for the location or operation of such use as contained in this chapter and upon the issuance of an authorization therefor by the Planning Board.
CONTINUING CARE RETIREMENT COMMUNITY
Means a development regulated in accordance with the rules of the New Jersey Department of Community Affairs pursuant to N.J.A.C. 5:19 which provides a continuum of accommodations and care, from independent living to assisted living to long-term bed care in a nursing facility, at the same or another location to an individual pursuant to an agreement effective for the life of the individual or for a period greater than one year.
DAYS
Calendar days.
DEVELOPER
The legal or beneficial owner or owners of a lot or any land proposed to be included in a proposed development, including the holder of an option or contract to purchase, or other person having an enforceable proprietary interest in such land.
DEVELOPMENT
The division of a parcel of land into two or more parcels, the construction, reconstruction, conversion, structural alteration, renovation or enlargement of any building or other structure or of any mining, excavation or landfill, and any use or change in the use of any building or other structure or land or extension of the use of the land.
DRAINAGE
The removal of surface water or groundwater from land by drains, grading or other means and includes the control of runoff to minimize erosion and sedimentation during and after construction or development and means necessary for water supply preservation or prevention or alleviation of flooding.
DUPLEX
Two dwelling units, each on separate lots and sharing a common wall.
DWELLING
A building designed or used as the living quarters for one or more families.
DWELLING HOUSE
A detached house designed for and occupied exclusively as the residence of a single family living as an independent housekeeping unit.
DWELLING, MULTIFAMILY
A dwelling or group of dwellings on one plot containing separate living units for two or more families, but which may have joint services or facilities for both.
DWELLING UNIT
One or more rooms providing complete living facilities for one family, including equipment for cooking or provisions for the same and including a room or rooms for living, sleeping and eating.
ENVIRONMENTAL COMMISSION
A municipal advisory body created pursuant to P.L. 1968, c. 245 (N.J.S.A. 40:56A-1 et seq.).
FAMILY
One or more persons occupying a dwelling unit as a single nonprofit housekeeping unit, who are living together as a stable and permanent living unit, being a traditional family unit or the functional equivalent thereof.
FENCE
Any tangible barrier or obstruction of any material, living or inert, with the purpose or intent of having the effect of preventing passage or view across the line of the fence.
GARDEN APARTMENT
A building of no more than three stories containing at least three dwelling units in which one dwelling unit may be located over another unit. Access to such units via a common entrance and utilities may be shared.
GOVERNING BODY
The Mayor and members of the Township Council of the Township of Berlin.
HEAVY INDUSTRY
Means the manufacture, production, or handling of products from extracted or raw materials or the manufacture, assembly, fabrication, packaging or other processing of such products or an outdoor use engaged in the manufacture, assembly, fabrication, packaging or other processing of finished or partially finished parts or products from previously prepared materials. This term shall include, but shall not be limited to, the above activities involving the following: chemicals, stonework or concrete product manufacturing, crude oil or similar petroleum products and tanning.
HIGH-RISE APARTMENTS
A multifamily dwelling having not less than six stories above the average evaluation of the finished lot grade at the front of the building.
HOME OCCUPATION
Any accessory use of a service character conducted entirely within a dwelling, provided that the floor area devoted to the occupation does not exceed 150 square feet, does not require any vehicles, materials or equipment stored on the outside of the premises, employees do not visit or are employed at the premises, no article is sold or offered for sale except as may be produced by only members of the immediate family residing on the premises and which use is clearly incidental to the use of the dwelling for residential purposes and does not change the character thereof, and which shall in no manner have any adverse effect on the expected enjoyment of property rights of others within the zone designation in which it is located. In order to obtain approval for a home occupation an application for a minor site plan shall be submitted to the Board for approval.
HOME OFFICE
The use of a portion of a single-family detached residential dwelling which is used as an office area by only members of the household residing on the premises, and subject to the following:
(1) 
The office area shall not occupy more than 150 square feet or more than 12.5% of the gross floor area (gfa) of the detached dwelling, whichever is less, excluding the area of garages, basements and attics in the calculation of the gross floor area.
(2) 
The office area shall not have direct access to the outside via a door, but shall be an existing room or area within the detached dwelling unit which is integrated within the overall floor plan of the dwelling.
(3) 
The office area shall not contain any kitchen or bathroom facilities which are separate from the remainder of the detached dwelling unit.
(4) 
The office area shall have only typical office equipment limited to computers, telefax machines, telephones, copying machines and similar type equipment.
(5) 
No supplies or furnishing shall be permitted other than typical office supplies and furnishings.
(6) 
No evidence of the office area shall be shown to the outside of the detached dwelling unit.
(7) 
No person or persons shall be permitted on the premises regarding the office area other than individuals making deliveries or service calls as otherwise might occur on the premises related to the detached residential dwelling unit.
(8) 
The Home Office is to be identified as an accessory use to the residential dwelling, which will not require site plan review and approval by the Board or the issuance of a zoning permit by the Township.
HOTEL
A facility offering transient lodging accommodations to the general public on a short term or temporary basis, containing rooms intended or designated to be used, rented or hired out and occupied for sleeping purposes by guests and which may include additional services such as restaurants, meeting rooms and recreational facilities.
INDEPENDENT LIVING FACILITY
Means an age-restricted multiunit residential facility for residents over the age of 55 that provides room, board, and other amenities for a monthly fee (or a la carte) but does not include personal care or medical care.
JUNK
Any worn out, castoff or discarded article or material which is ready for destruction or has been collected or stored for salvage or conversion to some use. Any article or material which, unaltered or unchanged and without further reconditioning can be used from its original purpose as readily as when new, shall not be considered junk.
JUNK SHOP
Any place of business conducted or maintained for the purpose of buying, selling and storing, or any of them, old junk, ropes, iron, brass, copper, tin, lead, rubber in various forms, old papers, bottles or any other material or materials, old unregistered automobiles or trucks or other motor or mobile vehicles and other abandoned and unusable vehicles and such other miscellaneous assortments of articles and materials which are commonly classified and designated as junk.
JUNKYARD
Any place where any of the articles or items, or a combination thereof, referred to under the definition of "junk shop" are stored, kept or maintained, whether for sale or not, and shall be in a lot, place, building, structure or yard, whether improved or unimproved, where such articles or any of them are permitted to accumulate.
KENNEL
A premises or establishment wherein or whereon more than three dogs and/or cats are owned or the business of boarding or selling dogs and/or cats or breeding dogs and/or cats for sale is carried on, except for a pet shop.
LAND
Includes improvement and fixtures on, above or below the surface.
LIGHT INDUSTRY
Means any production, processing, assembly or fabrication of goods, materials or products, including any incidental cleaning, servicing, testing, repair or storage of those same goods, materials or products, but not including the storage of flammable or combustible materials as a principal use. Light industry takes place entirely within an enclosed building and results in the production of goods or the provision of services targeted to be sold to the end consumer. Operations that are harmful, hazardous or noxious are not included as light industrial uses.
LOADING AREA
An off-street space or berth on the same lot with a building or contiguous to a group of buildings for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials, and which abuts upon a street, alley or other appropriate means of access.
LOT
A designated parcel, tract or area of land established by a plat or otherwise as permitted by law and to be used, developed or built upon as a unit.
LOT AREA
An area of land which is determined by the limits of the lot line bounding the area and is always expressed in terms of square feet.
LOT CORNER
A parcel of land at the junction of and abutting on two or more intersecting streets when the interior angle of intersection does not exceed 150°.
LOT DEPTH
A mean horizontal distance between the front and rear lot lines, measured in the general direction of its side lot lines.
LOT WIDTH
The mean horizontal distance between the side lot lines, measured at right angles to its depth. In no case shall the lot width be less than the frontage as required by this chapter. Frontage shall be measured at the most forward allowable building line or setback line. The width at the front property line shall be at least 2/3 of the required width of the setback line.
MEMORY CARE FACILITY
Means a facility that offers services similar to those offered at an assisted living facility, but specialized to care for older adults living with Alzheimer's disease or other forms of dementia.
MOTOR VEHICLE
Any car, truck, trailer, or other vehicle for transporting persons or things, which requires licensing, tags, or registration with the New Jersey Department of Motor Vehicles.
NONCONFORMING LOT
A lot, the area, dimension or location of which was lawful prior to the adoption, revision or amendment of this chapter but fails to conform to the requirements of the zoning district in which it is located by reason of such adoption, revision or amendment.
NONCONFORMING STRUCTURE
A structure, the size, dimensions or location of which was lawful prior to the adoption, revision or amendment of this chapter, but which fails to conform to the requirements of the zoning district in which it is located by reason of such adoption, revision or amendment.
OFF-SITE
Located outside the lot lines of the lot in question but within the property of which the lot is a part, which is the subject of a development application or contiguous portion of a street or right-of-way.
OFF-TRACT
Not located on the property which is the subject of a development application nor on a contiguous portion of a street or right-of-way.
OPEN SPACE
Any parcel or area of land or water essentially unimproved and set aside, dedicated, designated or reserved for public or private use or enjoyment or for the use and enjoyment of owners and occupants of land adjoining or neighboring such open space, provided that such areas may be improved with only those buildings, structures, streets and off-street parking and other improvements that are designated to be incidental to the natural openness of the land.
PARKING AREA OR LOT
Any space utilized for the parking of motor vehicles, including both the parking spaces and the driveways, aisles, turnaround, loading areas and open space used to provide access to parking spaces or to control traffic within a parking lot except the access drive connecting a parking lot and a public right-of-way and within which no parking maneuver could occur.
PARKING SPACE
An off-street space available for the parking of a motor vehicle and which in this chapter is held to be 10 feet wide and 20 feet long, exclusive of passageways and driveways appurtenant thereto and giving access thereto.
PATIO HOUSE (ZERO LOT LINE)
One freestanding dwelling unit on a separate lot with open space on three sides.
PLANNING BOARD
The Planning Board of the Township of Berlin.
PRINCIPAL BUILDING
A building or buildings in which is conducted the main or principal use of the lot on which said building is situated.
PROFESSIONAL OFFICE
The office of a member of a recognized profession, as hereinafter indicated, when conducted on a residential property, which shall be conducted by a member or members of the residential family entirely within a residential building and shall include only the offices of doctors, ministers, architects, professional engineers, lawyers and such similar professional occupations which may be so designated by the Board of Adjustment upon finding by such Board that such occupation is truly professional in character by virtue of the need for similar training and experience as a condition for the practice of such occupation, and shall in no way adversely affect the safe and comfortable enjoyment of property rights in any zone in which it is located to a greater extent than for the professional activities listed herein. The issuance of a state or local license for a regulation of any gainful occupation need not be deemed indicative of professional standing.
RESIDENTIAL DENSITY
The number of dwelling units per gross acre of residential land area, including streets, easements and open space portions of a development.
SHOPPING CENTER
A business district consisting of an integrated development of such uses as retail stores and shops, personal service establishments, professional and business offices, banks, post offices, restaurants and theaters or auditoriums, housed in an enclosed building or buildings with party walls of eight inches of concrete block between each business use and utilizing such common facilities as customer parking areas, pedestrian walks, truck loading and unloading space and utility and sanitary facilities.
SINGLE-FAMILY DETACHED DWELLING
One freestanding dwelling unit on a separate lot with open space (setbacks) on all sides.
SKILLED NURSING FACILITY
Means an extended or intermediate care facility licensed by the State of New Jersey to provide full-time health care under medical supervision to individuals who, by reason of advanced age, chronic illness or infirmity, are unable to care for themselves and do not require the degree of care and treatment which a hospital provides. Skilled nursing facilities may include long-term care and short-term subacute rehabilitation care.
SOUND BARRIER
Means an exterior structure designed to protect inhabitants of residential or other sensitive land use areas from noise pollution. Sound barriers are intended as an effective method of mitigating roadway, truck, and light industrial noise sources. Sound barriers are also referred to as "sound wall," "noise barrier," and "acoustical barrier."
STANDARDS OF PERFORMANCE
Standards adopted by ordinance pursuant to Subsection 52d[1] regulating noise levels, glare, earthborne or sonic vibrations, heat, electronic or atomic radiation, noxious odors, toxic matters, explosive and inflammable matters, smoke and airborne particles, waste discharge, screening of unsightly objects or conditions and such other similar matters as may be reasonably required by the municipality or required by applicable federal or state laws or municipal ordinances.
STORY
That part of a building between the surface of any floor and the next floor above it or, in its absence, then the finished ceiling or roof above it. A split level story shall be considered a second story if its floor level is six feet or more above the level of the line of the finished floor next below it, except a basement. Any floor under a sloping roof at the top of a building, which is more than two feet below the top place, shall be counted as a half story, provided that not more than 60% of the floor area is used for rooms, baths or toilets; otherwise, it shall be counted as the fraction of a story, which its floor area, rooms, baths or toilets bear to the entire floor area.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way, which is an existing state, county or municipal roadway, or which is shown upon a plat heretofore approved pursuant to law, or which is approved by official action as provided by this act, or which is shown on a plat duly filed and recorded in the office of the county recording officer prior to the appointment of a Planning Board and the grant to such Board of the power to review plats; and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines.
STRUCTURE
A combination of materials to form a construction for occupancy, use or ornamentation, whether installed on, above or below the surface of a parcel of land.
TOWNHOUSE (or ROW HOUSE)
One dwelling unit in a line of at least three dwelling units, in which each unit has its own front and rear access, no unit is located over another unit, each unit is separated from others by a fire wall and each unit has its own independent utilities.
TRAILER CAMP or TRAILER PARK
Any place, area, lot or tract of land which is so designed or intended for placing or locating thereon a trailer, trailer coach or other camp car, one or more, as above defined, other than a garage or similar enclosed-type of building in which such vehicles may be placed.
TRAILER, TRAILER COACH or CAMP CAR
Any unit which is, or may be, used for living, sleeping or business purposes by one or more persons and that is equipped with wheels or similar devices used for the purpose of transporting said unit from place to place, whether it be self-propelled or otherwise. Whenever the word "trailer" is used herein, it shall mean and include "trailer coach" and "camp car"; except, however, that a trailer used as a temporary office for administration purposes in connection with the doing of construction work in the Township of Berlin and which has no sanitary facilities attendant thereto is not within the meaning of this definition.
TRUCK TERMINAL
Means a building, structure, or land area primarily devoted to renting, leasing, storage, or dispatch of trucks and or tractor trailers.
TWO-STORY STRUCTURE
A structure having space above the first floor designed for and completed clearance of not less than seven feet as living quarters with a height of seven feet over an area equal to 100% of the first floor area, excluding the garage.
USE
The specific purpose for which land or a building is designed, arranged, intended or for which it is or may be occupied.
WAREHOUSE
Means a building that is primarily devoted to the storage of goods or materials and may also include office and maintenance areas.
WAREHOUSE, DISTRIBUTION
Means a building that is primarily devoted to the receipt, storage, and distribution of bulk quantities of goods, products, cargo, and materials including trans-shipment or cross-docking.
WAREHOUSE, FULFILLMENT
Means a building that is primarily devoted to the receipt of bulk quantities of goods and products and the storage, separation, and distribution of the products to individual end users. Often e-commerce facilities.
WHOLESALE BUSINESS
Means an establishment primarily engaged in selling merchandise to other businesses, including retailers, industrial, commercial or professional business users and other wholesalers; or acting as agents or brokers and buying merchandise for or selling merchandise to such individuals or companies.
YARD
An open space, other than a court, on a lot, unoccupied and unobstructed from the ground upward, except as otherwise provided in this chapter.
(1) 
YARD, FRONTAn open unoccupied space on the same lot with a main building, extending the full width of the lot and situated between the street line and front line of the building projected to the side lines of the lot.
(2) 
YARD, REARAn open unoccupied space on the same lot with a building between the rear lines of the building and rear lines of the lot extending the full width of the lot.
(3) 
YARD, SIDEAn open unoccupied space on the same lot with a building situated between the building and the side line of the lot extending from the front yard to the rear yard. Any lot line, not a rear line or front line, shall be deemed a lot line.

B. 
Words and phrases. Words used in the present tense include the future. The singular number includes the plural, and the plural includes the singular; the word "lot" includes the word "plot"; the word "building" includes the word "structure"; the word "zone" includes the word "district"; the word "occupied" includes the phrase "intended to be occupied." The word "use" includes the words "arranged" and "designed" and the phrase "intended to be used." The word "shall" is always mandatory.

§ 340-5 Definitions of terms associated with Pinelands provisions.

As used in this chapter, the following terms associated with the Pinelands provisions of this chapter shall have the meanings indicated:
AGRICULTURAL COMMERCIAL ESTABLISHMENT
A retail sales establishment primarily intended to sell agricultural products produced in the Pinelands. An agricultural commercial establishment may be seasonal or year-round and may or may not be associated directly with a farm; however, it does not include supermarkets, convenience stores, restaurants and other establishments which coincidentally sell agricultural products, nor does it include agricultural processing facilities, such as farm itself, nor facilities which are solely processing facilities.
AGRICULTURAL OR HORTICULTURAL PURPOSE OR USE
Any production of plants or animals useful to man, including but not limited to forages or sod crops; dairy animals and dairy products; poultry and poultry products; livestock, including beef cattle, sheep, swine, horses, ponies, mules or goats, and including the breeding and grazing of any or all of such animals; bees and apiary products; fur animals; trees and forest products; fruits of all kinds, including grapes, nuts and berries; vegetables; nursery, floral, ornamental and greenhouse products; or any land devoted to and meeting the requirements and qualifications for payments or other compensation pursuant to a soil conservation program under an agency of the federal government.
ALTERNATE DESIGN PILOT PROGRAM TREATMENT SYSTEM
An individual or community on-site wastewater treatment system that has the capability of providing a high level of treatment, including a significant reduction in the level of total nitrogen in the wastewater, and that has been approved by the Pinelands Commission for participation in the alternate design wastewater treatment systems pilot program pursuant to N.J.A.C. 7:50-10.23(b). Detailed plans and specifications for each authorized technology are available at the principal office of the Pinelands Commission.

ANIMALS, THREATENED OR ENDANGERED
See N.J.A.C. 7:50-6.32.
APPLICATION FOR DEVELOPMENT
An application filed with any permitting agency for any approval, authorization or permit, which is a prerequisite to initiating development in the Pinelands Area, except as provided in § 200-45B of Chapter 200, Land Use and Development.
BILLBOARD
See "off-site commercial advertising sign."
CAMPER
A portable structure, which is self-propelled or mounted on or towed by another vehicle, designed and used for temporary living for travel, recreation, vacation and other short-term uses. A camper does not include mobile homes or trailers.
CAMPSITE
A place used or suitable for camping on which temporary shelter, such as a tent or camper, may be placed and occupied on a temporary and seasonal basis.
CERTIFICATE OF APPROPRIATENESS
An approval of the Planning Board pursuant to N.J.A.C. 7:50-6.156 and Article IV of this chapter.

COMMISSION
The Pinelands Commission created pursuant to Section 5 of the Pinelands Protection Act.[1]
COMPREHENSIVE MANAGEMENT PLAN
The plan and amendments thereto adopted by the Pinelands Commission pursuant to Section 7 of the Pinelands Protection Act.[2]
CONTIGUOUS LAND
Land which is connected or adjacent to other land so as to permit the land to be used as a functional unit, provided that separation by a lot line, streams, dedicated public roads which are not paved, rights-of-way and easements shall not affect the contiguity of the land unless a substantial physical barrier is created which prevents the land from being used as a functional unit.

DENSITY
The average number of housing units per unit of land.
DEVELOPMENT
The change of or enlargement of any use or disturbance of any land, the performance of any building or mining operation, the division of land into two or more parcels and the creation or termination of rights of access or riparian rights, including but not limited to:
A. 
A change in the type of use of a structure or land.
B. 
A reconstruction, alteration of the size or material change in the external appearance of a structure or land.
C. 
A material increase in the intensity of the use of land, such as an increase in the number of businesses, manufacturing establishments, offices or dwelling units in a structure or on land.
D. 
The commencement of forestry activities.

The commencement of resource extraction drilling or excavation on a parcel of land.
F. 
The demolition of a structure or the removal of trees.
G. 
The deposit of refuse, solid or liquid waste or fill on a parcel of land.
H. 
In connection with the use of land, the making of any material change in noise levels, thermal conditions or emissions of waste material.
I. 
The alteration, either physically and chemically, of a shore, bank or floodplain, seacoast, river, stream, lake, pond, wetlands or artificial body of water.
DEVELOPMENT, MAJOR
Any division of land into five or more lots, any construction or expansion of any housing development of five or more dwelling units, any construction or expansion of any commercial or industrial use or structure on a site of more than three acres or any grading, clearing or disturbance of an area in excess of 5,000 square feet.
DEVELOPMENT, MINOR
All development as defined in this section, as amended, other than major development.
DIVERT or DIVERSION
Means the taking of water from a river, stream, lake, pond, aquifer, well, other underground source, or other water body, whether or not the water is returned thereto, consumed, made to flow into another stream or basin, or discharged elsewhere.

DRAINAGE
The removal of surface water or groundwater from land by drains, grading or other means, including the control of runoff to minimize erosion and sedimentation during and after construction or development and means necessary for water supply preservation or prevention or alleviation of flooding.

ELECTRIC DISTRIBUTION LINES
All electric lines other than electric transmission lines.

ELECTRIC TRANSMISSION LINES
Electric lines which are part of an electric company's transmission and subtransmission system, which provide a direct connection between a generating station or substation of the utility company and:

A. 
Another substation of the utility company.
B. 
A subsection of or interconnection point with another interconnecting utility company.
C. 
A substation of a high-load customer of the utility.

ENLARGEMENT
An addition to the floor area of an existing building, an increase in the size of any other existing structure or an increase in that portion of a tract of land occupied by an existing use.
EROSION
The detachment and movement of soil or rock fragments by water, wind, ice or gravity.

FIRE HAZARD
The classification of a parcel of land in accordance with the following:

FISH AND WILDLIFE MANAGEMENT
The changing of the characteristic and interactions of fish and wildlife populations and their habitats in order to promote, protect and enhance the ecological integrity of those populations.
FORESTRY
The planting, cultivating and harvesting of trees for the production of wood products, including firewood, or for forest health. It includes such practices as reforestation, site preparation and other silvicultural practices, including but not limited to artificial regeneration, bedding, broadcast scarification, clear-cutting, coppicing, disking, drum chopping, group selection, individual selection, natural regeneration, root raking, seed tree cut, shelterwood cut and thinning. For purposes of this chapter, the following activities shall not be defined as "forestry":

A. 
Removal of trees located on a parcel of land one acre or less on which a dwelling has been constructed;
B. 
Horticultural activities involving the planting, cultivating or harvesting of nursery stock or Christmas trees;
C. 
Removal of trees necessitated by the development of the parcel as otherwise authorized by this chapter;
D. 
Removal of trees necessary for the maintenance of utility or public rights-of-way;
E. 
Removal or planting of trees for the personal use of the parcel owner; and
F. 
Removal of trees for public safety.
HABITAT
The natural environment of an individual animal or plant population or community.
HISTORIC RESOURCE
Any site, building, district, area, structure or object important in American history or prehistory, architecture, archaeology and culture at the national, state, county, local or regional level.

HYDROLOGIC UNIT CODE-11 or HUC-11
Means an area within which water drains to a particular receiving surface water body, also known as a "subwatershed," which is identified by an eleven-digit hydrologic unit boundary designation, delineated within New Jersey by the United States Geological Survey.

HYDROPHYTE
Any plant growing in water or in substrate that is at least periodically deficient in oxygen as a result of excessive water content.
IMMEDIATE FAMILY
Those persons related by blood or legal relationship in the following manner: spouses, domestic partners, great-grandparents, grandparents, great-grandchildren, grandchildren, parents, sons, daughters, brothers and sisters, aunts and uncles, nephews, nieces and first cousins.

IMPERMEABLE SURFACE
Any surface which does not permit fluids to pass through or penetrate its pores or spaces, typically having a maximum permeability for water of 10-7 cm/second at the maximum anticipated hydrostatic pressure. The term "impermeable" is equivalent in meaning.

IMPERVIOUS SURFACE
Any surface that has been compacted or covered with a layer of material so that it prevents, impedes or slows infiltration or absorption of fluid, including stormwater, directly into the ground and results in either reduced groundwater recharge or increased stormwater runoff sufficient to be classified as impervious in urban areas by the United States Department of Agriculture, Natural Resources Conservation Service, Title 210, Engineering, 210-3-1, Small Watershed Hydrology (WINTR-55), Version 1.0. Such surfaces may have varying degrees of permeability.

INTERESTED PERSON OR PARTY
Any person whose right to use, acquire or enjoy property is or may be affected by any action taken under this chapter or whose right to use, acquire or enjoy property under this chapter or under any other law of this state or of the United States has been denied, violated or infringed upon by an action or failure to act under this chapter.

INTERIM RULES AND REGULATIONS
The regulations adopted by the Pinelands Commission pursuant to the Pinelands Protection Act[3] to govern the review of applications from the adoption of the regulations until the Pinelands Comprehensive Management Plan took effect on January 14, 1981. These regulations were formerly codified as N.J.A.C. 7:1G-1 et seq.
LAND
Includes the surface and subsurface of the earth as well as improvements and fixtures on, above or below the surface and any water found thereon.

LANDFILL
A site where any waste is disposed of by application on or into the land, with or without the use of management practices or soil covering. It does not include a site where land application of waste or waste derived material occurs in accordance with N.J.A.C. 7:50-6.79.

LANDSCAPING
The installation of plant material or seed as a part of development.
LOCAL COMMUNICATIONS FACILITY
An antenna and any support structure, together with any accessory facilities, which complies with the standards in N.J.A.C. 7:50-5.4 and which is intended to serve a limited, localized audience through point to point communication, including cellular telephone calls, paging systems and dispatch communications. It does not include radio or television broadcasting facilities or microwave transmitters.

MOBILE HOME
A dwelling unit manufactured in one or more sections, designed for long-term occupancy and which can be transported after fabrication to a site where it is to be occupied.
NAVIGABLE WATERS
Water capable of being traversed by pleasure craft.
NONCONSUMPTIVE USE
Means the use of water diverted from surface or groundwaters in such a manner that at least 90% of the diverted water is returned to the source surface or groundwater at or near the point from which it was taken.

OFF-SITE COMMERCIAL ADVERTISING SIGN
Any sign which directs attention to a business, commodity, service or entertainment conducted, sold or offered at a location other than the premises on which the sign is located.
PARCEL
Any quantity of land, consisting of one or more lots, that is capable of being described with such definiteness that its location and boundaries may be established.

PERMEABILITY
The rate at which water moves through a unit area of soil, rock, or other material at a hydraulic gradient of one.

PERSON or PARTY
An individual, corporation, public agency, business trust, partnership association, two or more persons having a joint or common interest or any other legal entity.
PINELANDS AREA
The area designated pursuant to Section 10(a) of the Pinelands Protection Act.[4]
PINELANDS DEVELOPMENT CREDIT
A use right allocated to certain lands within the Pinelands Area pursuant to N.J.A.C. 7:50-5.43 that can be used to secure a residential density bonus on certain other lands within the Township and the Pinelands Area.

PINELANDS DEVELOPMENT REVIEW BOARD
The agency responsible from February 8, 1979, until June 28, 1979, for the review of and action on applications for development in the Pinelands Area, which required approvals of other state agencies, except where the Pinelands Commission acted on applications during that time period.
PINELANDS PROTECTION ACT
N.J.S.A. 13:18A-1 to 13:18A-29, as amended.
PINELANDS RESOURCE RELATED USE
Any use which is based on resources which are indigenous to the Pinelands, including but not limited to forest products, berry agriculture and sand, gravel, clay or ilmenite.

PLANT, THREATENED OR ENDANGERED
A Pinelands plant species whose survival worldwide, nationwide or in the state is in jeopardy.

PROTECTION AREA
All land within the Pinelands Area in Berlin Township.

PUBLIC SERVICE INFRASTRUCTURE
Sewer service, gas, electricity, water, telephone, cable television, and other public utilities developed linearly, roads and streets and other similar services provided or maintained by any public or private entity.

RECOMMEND MANAGEMENT PRACTICE
The management program which employs the most efficient use of available technology and natural, human and economic resources.
RECORD TREE
The largest tree of a particular species in New Jersey based on its circumference at 4.5 feet above ground level. A listing of the largest known tree of each species and its location is maintained at the principal offices of the Commission.

RECREATIONAL FACILITY, INTENSIVE
Any recreational facility which does not satisfy the definition of "low-intensive recreational facility," including but not limited to golf courses, marinas, amusement parks, hotels and motels.

RECREATIONAL FACILITY, LOW-INTENSIVE
A facility or area which complies with the standards of N.J.A.C. 7:50-5, Part III, utilizes and depends on the natural environment of the Pinelands and requires no significant modifications of that environment other than to provide access, and which has an insignificant impact on surrounding uses or on the environmental integrity of the area. It permits such low-intensity uses as hiking, hunting, trapping, fishing, canoeing, nature study, orienteering, horseback riding and bicycling.

RESOURCE EXTRACTION
The dredging, digging, extraction, mining and quarrying of sand, gravel, clay or ilmenite for commercial purposes, not including, however, the private or agricultural extraction and use of extraction and use of extracted material by a landowner.

SEASONAL HIGH-WATER TABLE
The level below the natural ground surface to which water seasonally rises in the soil in most years.[5]
SOLAR ENERGY FACILITY
A solar energy system and all associated components, including, but not limited to, panels, arrays, footings, supports, mounting and stabilization devices, inverters, electrical distribution wires and other on-site or off-site infrastructure necessary for the facility, which converts solar energy into usable electrical energy, heats water or produces hot air or other similar function.

STRUCTURAL ALTERATION
Any change in either the supporting members of a building, such as bearing walls, columns, beams and girders, or in the dimensions or configurations of the roof or exterior walls.

SUBMERGED LANDS
Those lands which are inundated with water throughout the year.
UTILITY DISTRIBUTION LINES
Lines, conduits or pipes located in a street, road, alley or easement through which natural gas, electricity, telephone, cable television, water, sewage or stormwater discharge is distributed to or from service lines extending from the main line to the distribution system of the building or premises served. Utility distribution lines do not include electric transmission lines.

VEGETATION
Any plant material, including grasses, shrubs and trees.
WETLANDS
Those lands which are inundated or saturated by water at a magnitude, duration and frequency sufficient to support the water at a magnitude, duration and frequency sufficient to support the growth of hydrophytes. Wetlands include lands with poorly drained or very poorly drained soils as designated by the National Cooperative Soils Survey of the Soil Conservation Service of the United States Department of Agriculture and further defined in N.J.A.C. 7:50-6.3 and 7:50-6.5.
WETLANDS MANAGEMENT
The establishment of a characteristic wetland or the removal of exotic species or phragmites from a wetland in accordance with the standards of N.J.A.C. 7:50-6.10. For purposes of this definition, "exotic species" are those that are not indigenous to North America.

WETLANDS SOILS
Those designated as very poorly drained or poorly drained by the Soil Conservation Service of the United States Department of Agriculture, including but not limited to Atsion, Bayboro, Berryland, Colemantown, Elkton, Keansbury, Leon, Mick, Othello, Pocomoke, St. Johns and Freshwater Marsh and Tidal Marsh soil types.
