ARTICLE XXV

Violations, Penalties and Remedies

§ 340-168 Unlawful acts.

Failure to secure a special exception or variance previous to the erection, construction, extension or addition to a building or failure to secure an occupancy permit shall be a violation of this chapter. Failure to fulfill any or all conditions subsequent required in connection with the grant of development approval within the time permitted shall be a violation of this chapter.

§ 340-169 Notice of violation.

When written notice of a violation has been served by the Building Inspector upon the owner, lessee, agent, architect, contractor or builder, such violation shall be discontinued immediately.

§ 340-170 Violations and penalties.

Any person or persons, firm or corporation who shall violate this chapter or any of its provisions shall, upon conviction, be punished either by imprisonment in the county jail for a term not exceeding 90 days or by a fine not exceeding $200, or both, in the discretion of the court. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons, firm or corporation allowing or permitting for the continuation of the violation may be punished as provided above for each separate offense.

§ 340-171 Additional remedies.

If any building or structure is erected, constructed, altered, repaired, converted, maintained or used in violation of this chapter or any regulation made pursuant hereto, the Mayor and Township Council, in addition to any other remedies, may institute any appropriate action or proceedings in law or equity to:
A. 
Prevent such unlawful erection, construction, alteration, repair, conversion maintenance or use;
B. 
Restrain, correct or abate such violation;
C. 
Prevent the occupancy of said building, structure or land; or
D. 
Prevent any illegal act, conduct, business or use in or about said premises.
