Sec. 18-1.- Definitions.

For the purposes of this article, the following words and phrases shall have the meanings ascribed herein, unless the context clearly indicates otherwise:

Handbill shall mean any free-printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, paper, booklet, advertisement or any other printed or otherwise reproduced original or copies of any matter of literature.

Newspaper shall mean any newspaper of general circulation and defined by general law, any newspaper duly entered with the post office of the United States in accordance with federal statute or regulation and any newspaper filed and recorded with any recording officer as provided by general law; and, in addition thereto, "newspaper" shall mean and include any periodical or current magazine regularly published with not less than four (4) issues per year, and sold to the public, and shall mean and include any other copyrighted material.

Sec. 18-2. - Exemptions.

The provisions of this chapter shall not apply to the distribution of mail by the United States nor to newspapers that are delivered to and upon property by consent of the owners, except that all newspapers shall be placed on private property in such a manner as to prevent their being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property, nor do the provisions of this chapter apply to persons distributing religious and ideological materials.

Sec. 18-3. - Permit required.

It shall be unlawful for any person to deliver, hand out, distribute or otherwise circulate, except by United States Postal Service, or to cause to be delivered, handed out, distributed or otherwise circulated, except by United States Postal Service, any free handbill, circular, poster, pamphlet, other printed matter or newspaper, not exempted by section 18-2 upon any street, sidewalk, public place or private property within the city without obtaining a permit therefor.

Sec. 18-4. - Application for permit.

(a)

Any person desiring to deliver, hand out, distribute or otherwise circulate any free handbill, circular, poster, pamphlet or other printed material or newspaper not exempted herein upon any street, sidewalk, public place or private property within the city shall first make application in writing, with a copy of the proposed handbill, circular, poster or pamphlet, to be distributed or circulated attached thereto to the city for a permit. Every person applying for a permit shall receive it without charge.

The permit shall be for twelve (12) months renewable annually by the applicant. The applicant shall be required to comply with all ordinances of the city and laws of the state. Failure to do so shall result, after notice and hearing, in a revocation of the permit issued.

Sec. 18-5. - Inhabited private premises.

(a)

No person shall throw, deposit or distribute any free handbill or newspaper not exempted herein in or upon private premises which are inhabited after being instructed by the owner of the property not to do so. Nothing contained herein prohibits the distribution of any free handbill, circular or other written matter by the handing or transmitting of same directly to the owner, occupant or other person then present in and/or upon such private premises; but, if asked by the occupant thereof not to do so in the future, the person so instructed shall cease and desist any further dissemination of such free handbill or advertisements on the property.

(b)

No person shall throw, deposit or distribute any handbill, circular or other written matter upon any private premises if there is placed on such premises a sign bearing the words, "No Trespassing," "No Peddlers or Agents," "No Advertisement" or similar notice, indicated in any manner that the occupants of such a premises do not wish to have their right of privacy disturbed or to have any free handbills, circulars or other advertisements left upon such premises.

Sec. 18-6. - Depositing on uninhabited vacant premises prohibited.

It shall be unlawful for any person to throw or deposit any handbill, circular or other written matter in or upon any private premises which is uninhabited or vacant.
