CHAPTER 17

20 - COMPLIANCE CERTIFICATES

17.20.010 - Construction compliance certificate.

A.

A construction compliance certificate shall be obtained from the zoning administrator before any building or structure is erected, reconstructed or structurally altered to increase the exterior dimensions, height or floor area, or remodeled to increase the number of dwelling units or accommodate a change in use of the building and/or premises or part thereof.

B.

The construction compliance certificate shall state that the proposed construction complies with all provisions of this title, and no subsequent modifications shall be made to plans or to actual construction that would be in violation of this title. The construction compliance certificate shall be accompanied by a drawing to scale, showing existing and proposed structures, uses, open spaces, parking and loading facilities, and other features affecting the use of the property.

C.

The zoning administrator shall not issue a construction compliance certificate as contemplated hereunder for any building or structure requiring special access for handicapped persons as required by the Code of Iowa, as subsequently amended, or for any building or structure subject to thermal efficiency energy conservation standards as set out in the State of Iowa Building Code as subsequently amended, until such time as the applicant has provided in writing to the zoning administrator a compliance certificate from the State of Iowa Department of Public Safety stating that all applicable regulations thereunder have been complied with. The applicant shall be solely responsible for providing this certificate to the zoning administrator. The city shall not be responsible for any inspections or certifications but shall rely upon the certifications of the Department of Public Safety indicating that compliance with the aforementioned sections has been determined.

17.20.020 - Occupancy compliance certificate.

No change in the use or occupancy of land nor any change in use or occupancy in an existing building, other than for single-family dwelling purposes, shall be made, nor shall any new building be occupied for any purpose other than a single-family dwelling until an occupancy compliance certificate has been issued by the zoning administrator. Every occupancy compliance certificate shall state that the new occupancy complies with all provisions of this title and no subsequent modifications shall be made to the occupancy, use or method of operation that would be in violation of this title.

17.20.030 - Applications for compliance certificates.

A.

Applications for compliance certificates shall be made prior to beginning construction or assuming occupancy, on fully completed application forms, obtained from the zoning administrator, accompanied by such plans and information necessary to determine that the proposed construction or occupancy complies with all applicable provisions of this title.

B.

A record of all certificates shall be kept on file in the office of the zoning administrator, and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected.

17.20.040 - Fees.

A.

The zoning administrator is directed to issue a construction compliance certificate and/or an occupancy compliance certificate as required by this chapter for proposed construction, reconstruction or alteration which complies with all provisions contained herein and to charge a fee.

B.

There shall be no fee charged to the United States government, the state of Iowa, or any political subdivision thereof.

C.

All fees required shall be paid through the zoning administrator to the city clerk, who shall keep a complete and accurate record of fees received and shall forthwith deposit them to the credit of the general fund of the city.

D.

Applications for compliance certificates and/or occupancy certificates shall be accompanied by a fee as established from time to time by the city council by appropriate resolution which fee shall be set out in the appendix to the Decorah Municipal Code.
