Districts

10.34.010 Establishment Of Zoning Districts

For the purposes of this Ordinance, the territory of Escalante City to which this Ordinance applies is divided into eight (8) zoning districts as follows:

10.34.020 Listing Of Ordinance And Map

This Ordinance and map shall be filed in the custody of the Escalante City Recorder and may be examined by the public subject to the reasonable regulations established by said clerk.

10.34.030 Rules For Locating Boundaries

Where uncertainty exists as to the boundaries of districts as shown on Escalante City maps, the following shall apply: 

  1. Boundaries indicated as approximately following the center-line of streets, highways, or alleys shall be construed to follow such center-line and in the event of change in the center-line shall be construed as moving with the center-line.
  2. Boundaries indicated as approximately following the right-of-way lines of streets, highways, or alleys shall be construed to follow such right-of-way lines, and in the event of a change in the right-of-way line shall be construed as moving with the right-of-way line.
  3. Boundaries indicated as approximately following the center-line of streams, rivers, canals, or other bodies of water, or flood control channels, shall be construed to follow such center-line and in the event of change of center-line shall be construed as moving with the center-line.
  4. Boundaries indicated as approximately following platted lot lines shall be construed to follow such lot lines.
  5. Boundaries indicated as parallel to, or extensions, of features indicated in paragraphs A through D shall be so construed. Distances not specifically indicated on the official map shall be determined by the scale of the map.
  6. In case any further uncertainty exists, the Escalante City Board of Boundaries
  7. Boundaries of each of the said zones are hereby established as described Adjustments shall determine the location of such boundaries.  herein or as shown on the map entitled Escalante City Zoning Map which map is on file with the Escalante City Recorder and all boundaries shown thereon are made by this reference a part of this Ordinance.

10.34.040 Procedure For Rezoning

The Planning Commission will consider applications to rezone contiguous parcels of land that fit within the intent of the Escalante General Plan and are considered to be in the best interest of the public and are consistent with current zoning districts and ordinances.

  1. The Planning Commission shall provide notice as required by state statute and hold a public hearing on any proposed zoning map amendment.
    1. For a zoning map amendment proposed by the City, a notice shall be mailed at least 10 days before the public hearing to each property owner whose land is directly affected by the proposed zoning map amendment.
    2. For a zoning map amendment proposed by a private property owner, a notice shall be mailed at least 10 days before the public hearing to each property owner whose land is directly affected by the proposed zoning map amendment. 
    3. Notification letters shall be mailed by City Clerk.
    4. Private property owner shall submit an application and plat map showing all properties directly affected by the proposed change.
  2. After holding a public hearing, the Planning Commission shall give their recommendation to the City Council for final consideration. 
  3. Directly affected means the land being proposed for the zone change. As per state statute there is no requirement that any neighboring landowner be notified of proposed zone changes if a publication is made on the state public meeting notice website.
