10.50 Commercial-Residential

District C-R

10.50.010 Purpose

To provide an area within Escalante City where a mix of development has occurred and may continue to occur, including residential housing and commercial business to provide a wide variety of goods and services.

10.50.020 Permitted Uses

  1. Single-family uses subject to the following provisions
    1. Height Regulations: 
      1. No building may exceed thirty-five (35)) feet in height above existing grade. No dwelling shall be less than one (1) story in height.
    2. Minimum Area, Width, And Yard Requirements:
      1. Minimum Area 1/4 acre 
      2. Minimum Width 75'
      3. Front setback 25'
      4. Side and Rear setbacks 10'
    3. Side Yards:
      1. Main buildings, other than dwellings, shall have a minimum side yard of (10) feet, and the total of the two side yards shall be a minimum of twenty (20) feet. 
      2. Private garages and other accessory buildings located at least ten (10) feet behind the main building may have a side yard of two (2) feet, except that the street side yard of the corner lot shall be the same as the front yard setback required for that district.
      3. Rear Yards: Private garages and accessory buildings located at least ten (10) feet behind the main building may have a rear yard of two (2) feet, provided that on corner lots abutting on the side of another lot, the minimum rear yard for all buildings shall be the same as the minimum side yard requirements of the zoning district.

10.50.030 Conditional Uses

  1. Animal hospital for small animals only, provided business is conducted within a completely enclosed building.
  2. Automobile repair, storage, and/or service station, including paint, body and fender, brake, muffler, and transmission work provided business is conducted within an enclosed building.
  3. Bus terminal.
  4. Planned Unit Developments..
  5. New and used car sales.

10.50.035 Prohibited Uses

Any use not expressly identified as a use allowed within Escalante City, as either a Permitted, Conditional, or Temporary Use, is hereby determined to be a prohibited Use.

10.50.040 Height Regulations

No building shall be erected to height greater than two and one-half (2.5) stories or thirty-five (35) feet without a conditional use permit. No building shall be erected a height lower than (8) feet.

10.50.060 Special Provisions

  1. All materials and merchandise, except vehicles in running order, shall be stored in an enclosed building or within an enclosure surrounded by a sight-obscuring fence or wall of not less than six (6) feet in height and neither materials nor merchandise shall be stored to a height of more than the height of the enclosing fence or wall.

10.50.070 Signs

  1. Business signs are permitted, subject to the following requirements:
    1.  Signs shall not exceed eighty (80) square feet in area;
    2. All business signs shall be flat wall or free standing signs.
    3. No business sign shall be revolving.
    4. Businesses with more than one entrance may be permitted an additional free standing sign not to exceed forty (40) square feet.
    5. Blade Signs
  2. The following non-advertising signs are permitted, subject to the limitations stated. All such signs shall be flat wall signs or pole signs but no such sign shall project above the eaves or parapet wall of the building on the premises to which it is appurtenant. The maximum sign area of fifty feet (50) may be used in not more than three (3) signs.
    1. Development sign, maximum forty (40) square feet.
    2. Civic Sign, maximum fourteen (14) square feet.
    3. Real Estate sign, maximum sixteen (16) square feet.
    4. Residential: Personal name plate, maximum two (2) square feet Other maximum eight (8) square feet.
