- BED AND BREAKFAST ESTABLISHMENTS
The purpose of this article is to establish performance standards for bed and breakfast establishments that provide temporary accommodations on an ongoing basis within residential and business areas.
(a)
District application. Bed and breakfast establishments, except as otherwise provided for in commercial districts, shall require a conditional use permit as allowed within the zoning districts established by article 40 of this Appendix E.
(b)
Conditions of approval. In addition to general standards and criteria provided in article 4 of this Appendix E, a bed and breakfast establishment may be allowed provided that:
(1)
A maximum of ten bed and breakfast units may be established within a structure.
(2)
The facility shall have a state-issued license for lodging and food service, and comply with and maintain all health, safety, building, and fire codes as may be required or applicable.
(3)
The primary owner-occupant shall be in residence of the residential property or on an adjacent property proposed for the bed and breakfast facility.
(4)
All bed and breakfast units shall be established within the principal or accessory structures.
(5)
The principal structure shall have a minimum size of 1,500 gross square feet.
(6)
Not more than the equivalent of one full-time person shall be employed by the bed and breakfast facility who is not a resident of the structure.
(7)
Dining and other facilities shall not be open to the general public for those bed and breakfast facilities in the R-1 and R-2 districts, but shall be used exclusively by the registered guests, residents, or guests of a meeting or event held at the facility.
(8)
Any structure proposed to be used for a bed and breakfast in a residential district must be in a historic building or site in accordance with article 62 of this Appendix E.
(9)
The owner-occupant of a bed and breakfast facility in the R-1 and R-2 districts shall be allowed to host a maximum of eight small groups and meetings per year if the facility contains at least 1,000 square feet of area for this purpose as well as a commercial kitchen that complies with all health, safety, and building code standards. Groups and meetings shall be limited to no more than two persons per bed and breakfast unit. The owners of a bed and breakfast may request an administrative permit for special events that will exceed the two persons per unit limit or the maximum number of events per year by submittal of an application and consideration of approval by the zoning administrator.
(10)
Two off-street parking spaces shall be provided for the facility plus one for each bed and breakfast unit. Parking areas shall be screened and landscaped and no parking space shall be located in the front yard of the property, other than on an existing driveway. The parking areas shall be improved with a dust-free surface, but shall be exempt from other commercial parking requirements of this Appendix E.
(11)
No more than one exterior identification sign not exceeding six square feet in area may be located on the premises. No window signage shall be allowed for bed and breakfast facilities.
(12)
Adequate lighting shall be provided between the principal structure and the parking area for the safety of guests. All external lighting shall be regulated by conditional use permit.
(13)
All bed and breakfast conditional use permits shall be reviewed annually by the zoning administrator. If violations of city ordinances, building code, or conditions of approval are found, the zoning administrator shall schedule a public hearing of the planning commission to consider the conditional use permit and conditions. Upon a planning commission recommendation, the city council may adjustments to or cancel the conditional use permit.
(14)
The provisions of article 4 of this Appendix E are considered and satisfactorily met.
