Per the request of the city, said provisions have been redesignated as article 56, §§ 56-1—56-7, so that provisions dealing with the B-5 district follow provisions dealing with the B-6 district.


Sec. 56-1.- Purpose.

The purpose of the P, Public Park district is intended to provide a specific zoning district for public park and trail use. It is unique in that the primary objective of uses within this district is the provision of recreational facilities. It is intended that uses within such a district will be compatible with adjoining development.

Sec. 56-2. - Permitted uses.

In addition to other uses specifically permitted within this District that are identified elsewhere in this Appendix E, the following are permitted uses in the P District:

(1)

Parks and recreational fields, structures, buildings, and trails.

(2)

Public docks and associated facilities.

(3)

Dry stacking pursuant to duly issued city permit.

(4)

Essential services and essential service structures necessary for the health, safety, and general welfare of the community.

Sec. 56-3. - Permitted accessory uses.

In addition to other uses specifically accessory within this district that are identified elsewhere in this Appendix E, the following are permitted accessory uses in a P district:

(1)

Accessory uses, buildings, and structures customarily incidental and directly related to the uses allowed as permitted, conditional, interim, and administrative permits in this section, subject to applicable regulations of this Appendix E.

(2)

Fences, as regulated by article 21 of this Appendix E.

(3)

Signs, as regulated by article 24 of this Appendix E.

(4)

Off-street parking and off-street loading, as regulated by articles 18, 19, and 23 of this Appendix E.

Sec. 56-4. - Conditional uses.

In addition to other uses specifically conditional within this district that are identified elsewhere in this Appendix E, the following are conditional uses in a P district and require a conditional use permit based upon procedures set forth in and regulated by article 4 of this Appendix E. Additionally, besides the specific standards and criteria what may be cited below for respective conditional uses, each request for a conditional use permit shall be evaluated based upon the standards and criteria set forth in subsection 4-3(5) of this Appendix E.

(1)

Operation of rail transit systems, but not switching, storage or other railroad operation.

a.

The hours of operation shall be limited to 6:00 a.m. to 11:00 p.m., unless extended by the city council as part of the conditional use permit.

b.

Provisions are made to control and reduce noise in accordance with section 16-9 of this Appendix E.

Sec. 56-5. - Interim uses.

In addition to other uses specifically interim within this district that are identified elsewhere in this Appendix E, the following are interim uses in a P district based upon procedures set forth in and regulated by article 5 of this Appendix E:

(1)

WECS, as regulated by article 28 of this Appendix E.

(2)

Temporary structures, as regulated by article 27 of this Appendix E.

Sec. 56-6. - Uses by administrative permit.

In addition to other uses specifically allowed by administrative permit within this district that are identified elsewhere in this Appendix E, and subject to applicable provisions of this section, performance standards established by this Appendix E, and processing requirements of article 8 of this Appendix E, the following are uses allowed in a P district by administrative permit as may be issued by the zoning administrator:

(1)

All telephone lines, pipelines, and structures for local distribution, underground transmission lines, and overhead transmission lines of 35 KV or less, as regulated by article 26 of this Appendix E.

Sec. 56-7. - Lot requirements and setbacks.

The following minimum requirements shall be observed in a P district subject to the following additional requirements, exceptions, and modifications set forth in this Appendix E:

    Front Yard 50 feet
    Side Yard 10 feet
    Rear Yard 10 feet
Building Height 2 25 feet
Green Space 85%
Impervious Surface Coverage Maximum 3 50%
