ARTICLE 3

CLASS “N” DISTRICT

§ 1 Generally; use regulations.

(a) 
Class “N” District shall include newly annexed territory until such time as it is zoned by the city planning and zoning commission and city commission. Until such zoning, newly annexed territory shall be subject to all the rules, regulations and restrictions herein provided with respect to Class “A” Single-Family Residence Districts.
(b) 
Home occupations are permitted through the issuance of a conditional use permit.
Editor’s note–Ordinance 82-36, sec. 1, amended article 3 by allowing home occupations with a conditional use permit. Inclusion of the provisions as subsection 1(b) was at the discretion of the editor. The existing provisions of section 1 have been designated as subsection (a).

§ 1A Conditional use–Temporary structures.

a. 
Temporary structures used for temporary purposes.
Editor’s note–Ordinance 2017-25 amended article 3 of the zoning ordinance, but did not specify the manner of inclusion of such provisions. Designation as section 1A was at the discretion of the editor.

§ 2 Issuance of permits.

No permit for construction of buildings for other uses than Class “A” Single-Family Residence District use shall be issued by the building inspector in such territory. An application for any other uses shall be made to the building inspector and by him referred to the planning and zoning commission for consideration to the type of permanent zoning to be applied to the area in which the property described in the application is located. Consideration and recommendation to the city commission [shall be made] after giving due consideration to the type of permanent zoning to be applied to the area in which the property described in the application is located. Such recommendation shall be advisory only, and the city commission may affirm or deny it as it sees the justification for it.

§ 3 Permits for existing buildings.

No existing building in the area annexed to the city, not used for business purposes shall be altered, remodeled, or converted for business purposes without a building permit from the City of Mercedes, Texas.

§ 4 Permit application; suspension of work on annexed land.

The owner, lessee, or any other person, firm or corporation owning, controlling, constructing, supervising or directing the construction of any building or structure in process of construction and incomplete at the time when the land on which it is situated is annexed to the City of Mercedes, Texas, before proceeding further with the construction, alteration or completion thereof, shall apply to the building inspector for permit authorizing further work and shall attach to his application plans and specifications for the construction of said building or structure. This application shall be referred to the city planning and zoning commission for consideration and recommendation to the city commission. Construction work shall be suspended until action by the city commission of the City of Mercedes, Texas, authorizing the building inspector to issue a building permit for construction of the proposed building or structure.
