40 - PROVISIONS GOVERNING THE HIGHWAY COMMERCIAL C-3 DISTRICT
The highway commercial (C-3) district is established to provide for commercial uses of a highway or thoroughfare-oriented nature. Other uses which may benefit from drawing a proportion of their clientele from passing traffic are permitted, as well as additional uses that require large space needs that cannot be accommodated in other commercial districts.

A.
Any use permitted in the C-2 district, except that all residential uses shall be prohibited;
B.
Auto related: fender work, painting, rebuilding, reconditioning, washing or steam cleaning, auto parts retail, service stations;
C.
Auto, truck, trailer and mobile home sales, rentals, storage and repair of new or used vehicles;
D.
Amusement and recreation establishments, public or private, such as bowling alleys, gymnasiums, commercial swimming pools, dance halls, skating rinks, drive-in theaters, golf courses or driving ranges;
E.
Contractors or construction offices and shops such as building, concrete, electrical, masonry, painting, plumbing; refrigeration and roofing (providing no assembly, construction, millwork or concrete block manufacture is done on the premises);
F.
Drive-in and open-air restaurants;
G.
Lumber yards;
H.
Motels;
I.
Frozen food stores and lockers;
J.
Commercial greenhouses, garden supply store, nurseries;
K.
Radio and television stations;
L.
Monument sales;
M.
Meeting halls, lodges, private clubs;
N.
Funeral parlors;
O.
Farm supply sales and service;
P.
Printing and publishing establishments;
Q.
Public services such as fire and police protection, libraries, post offices, transportation terminals;
R.
Utility office buildings; substations, pumphouses;
S.
Bus terminals and garages;
T.
Cleaning and janitorial services provided the service is not performed on the premises;
U.
Large item machinery or bulk sales;
V.
Signs, as permitted in Section 17.52.060;
W.
Accessory uses and buildings;
X.
Woodshops for production of custom wood products employing no more than ten employees (either full-time or part-time employees).

A.
Churches;
B.
Commercial and trade schools;
C.
Medical and research laboratories;
D.
Shopping centers, plazas or malls where two or more businesses share a roof and common parking space;
E.
Indoor storage of household goods; provided, however, that the following limitations shall apply to any such special use:
1.
Open-air storage and outdoor storage of any kind shall not be permitted.
2.
Storage of food, food products, grain, liquids, chemicals, fuel, explosive materials, waste of any kind and character and hazardous waste shall not be permitted.
3.
Newly established uses of this nature which are adjacent to or backing on any residential or neighborhood business district shall provide along the entire length of that adjacent property line a dense hedge, tree row or other suitable landscape device as shall be approved by the planning commission adequate to visually screen the entire storage area from the residential or neighborhood commercial area.
4.
Any structure erected shall be constructed and maintained in such a manner as to prevent entry into the structure by rodents, animals and birds.
5.
The use of the premises by the following, for storage shall not be permitted, to-wit: commercial movers and warehouse companies; commercial and industrial users.
F.
Outdoor storage of goods, materials or merchandise, but only under the following conditions:
1.
Outdoor storage shall be allowed only in conjunction with another permitted use or special use lawfully established in the C-3 district.
2.
Any goods, materials or merchandise stored outdoors may not be stored to a height in excess of ten feet above the surrounding grade.
3.
All goods, materials or merchandise stored outdoors shall be completely screened from public view with an appropriate fence, hedge or tree row. Such screening shall at all times be effectively maintained.
4.
Such other conditions as the village board deems necessary to protect the public interest.
G.
Towers which comply with the provisions of Chapter 15.52 of this Code.
H.
A traditional neighborhood development overlay district ("TND") as defined at Section 17.52.055 of this Code, but only under the following conditions:
1.
The TND is approved as provided in this title.
2.
To the extent that the procedures generally applicable to the consideration and approval of a special use conflict with the procedures set forth at Section 17.52.055 of this Code for the consideration and approval of a TND, the procedures set forth at Section 17.52.055 shall apply.
3.
To the extent that the uses, minimum lot areas and dimensions, provisions governing building height, density or setbacks or other standards established in the approved final development plan for the TND conflict with the uses, minimum lot areas and dimensions, regulations governing building height, density or setbacks or other standards established in this title, the provisions of the approved final development plan for the TND shall apply.
I.
The siting and construction of a small wind energy conversion system which complies with the wind energy code.

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in Chapter 17.54 this Zoning Ordinance, as appropriate:
A.
Adult-use cannabis dispensing organization;
B.
Adult-use cannabis infuser organization;
C.
Adult-use cannabis processing organization;
D.
Adult-use cannabis transporting organization.

No minimum lot width or lot area is required for commercial uses.

No building shall exceed thirty feet in height, unless each side yard is increased over the required minimum by five feet for every five feet or fraction thereof, of additional height over thirty feet. In no case shall the building height exceed fifty feet.

All structures to be constructed, altered or moved in the C-3 district shall provide yards of the following minimum depths:
A.
Front yard - forty feet;
B.
Side yard - twenty feet;
C.
Rear yard - same as outlined in the C-2 district.

Newly established C-3 uses adjacent or backing on a residential district shall provide on that adjacent property line a dense hedge, tree row or other suitable landscape device as approved by the planning commission adequate to visually screen the commercial area from the residential area.
