Grouse Creek Character Area

Sec. 16-5-10.- Character Area characteristics.

The intent of the Community Plan is that the Grouse Creek Character Area provide a broad range of commercial services for visitors and residents that are conveniently accessible by automobile. The area functions as an auto-accessible commercial center providing retail, office space, services and the opportunity for redevelopment. The desired characteristics are to remain as a service commercial center, at an appropriate scale, and to generate sales tax revenue for the Town.

Sec. 16-5-20. - Grouse Creek Commercial Zone.

(a)

The Grouse Creek Commercial Zone can accommodate a broad range of commercial services and is conveniently accessible by automobile and delivery trucks. The building clusters share access points and on-site parking. Due to its proximity to Highway 24, the district can accommodate a substantial volume of traffic.

(b)

The purpose of the Grouse Creek Commercial Zone is to encourage a broad range of complementary commercial services that generate sales tax. Development or redevelopment plans should be designed to complement each other in character, scale and proximity and be linked by attractive pedestrian corridors and plazas.

Sec. 16-5-50. - Grouse Creek Character Area limited use standards.

(a)

The Planning Director shall approve the limited use based upon the submittal and review of the following material. The use shall be approved upon finding that the limited use is:

(1)

Not in conflict with applicable health, sanitation, safety or access regulations;

(2)

The use is allowed by limited review in the subject zone district; and

(3)

The use can be operated so that it is compatible with adjacent uses and negative impact to adjacent properties has been minimized.

(b)

Accessory building.

(1)

Size: Accessory buildings shall not exceed one thousand two hundred (1,200) square feet.

(2)

Use: Accessory buildings are for the use of the residents of the property.

(3)

Dimensional limitations: Accessory buildings shall only be permitted on lots that conform to the minimum lot standards of the underlying zone district. The building shall be developed so as to conform to all setback, height, building lot coverage, floor area and other dimensional limitations of the underlying zone district.

(c)

Festival marketplace.

(1)

Size: A festival market seeking approval for limited use review shall not exceed five thousand (5,000) square feet.

(2)

Location: The applicant shall demonstrate safe access to the site.

(3)

Parking: The applicant shall demonstrate that the parking provided is adequate to serve both the vendors and clientele of the market.

(4)

Operation: A festival market shall not produce noise, electrical or magnetic interference, vibration, heat, glare, odors, fumes, smoke or dust and shall not operate at such hours or in such a manner as to create a public nuisance or disturb neighbors.

(5)

Water, sanitation, solid waste: Proof shall be provided that adequate water and sanitation are in place for the use. Proof shall be provided that adequate solid waste storage and removal are in place.

(d)

Flea market.

(1)

Size: A flea market seeking approval for limited use review shall not exceed five thousand (5,000) square feet.

(2)

Location: The applicant shall demonstrate safe access to the site.

(3)

Parking: The applicant shall demonstrate that the parking provided is adequate to serve both the vendors and clientele of the market.

(4)

Operation: A flea market shall not produce noise, electrical or magnetic interference, vibration, heat, glare, odors, fumes, smoke or dust and shall not operate at such hours or in such a manner as to create a public nuisance or disturb neighbors.

(5)

Water, sanitation, solid waste: Proof shall be provided that adequate water and sanitation are in place for the property. Proof shall be provided that adequate solid waste storage and removal are in place.

(e)

Roadside stand.

(1)

Size: A roadside stand seeking approval for limited use review shall not exceed five hundred (500) square feet.

(2)

Location: The applicant shall demonstrate safe access to the site.

(3)

Parking: The applicant shall demonstrate that the parking provided is adequate to serve both the vendor and clientele of the roadside stand.

(4)

Operation: A roadside stand shall not produce noise, electrical or magnetic interference, vibration, heat, glare, odors, fumes, smoke or dust and shall not operate at such hours or in such a manner as to create a public nuisance or disturb neighbors.

(5)

Water, sanitation, solid waste: Proof shall be provided that adequate water and sanitation are in place for the property. Proof shall be provided that adequate solid waste storage and removal are in place.

(f)

Mobile/manufactured homes sales, service and rental.

(1)

Size: Limited use review shall be limited to a maximum size of five thousand (5,000) square feet.

(2)

Location: All activities shall be conducted indoors. Limited outdoor activity may be approved through this process.

(3)

Parking: The applicant shall demonstrate that the number of parking spaces provided is sufficient to serve employees and patrons of the establishment.

(4)

Operation: This use shall not produce noise, electrical or magnetic interference, vibration, heat, glare, odors, fumes, smoke or dust and shall not operate at such hours or in such a manner as to create a public nuisance or disturb neighbors.

(5)

Water, sanitation, solid waste: Proof shall be provided that adequate water and sanitation are in place for the property. Proof shall be provided that adequate solid waste storage and removal are in place.

(g)

Motor/recreational vehicle sales, service and rental.

(1)

Size: Limited use review shall be limited to a maximum size of five thousand (5,000) square feet.

(2)

Location: All activities shall be conducted indoors. Limited outdoor activity may be approved through this process.

(3)

Parking: The applicant shall demonstrate that the number of parking spaces provided is sufficient to serve employees and patrons of the establishment.
