79 SECOND KITCHENS IN SINGLE-FAMILY RESIDENTIAL DWELLINGS
17.79.010: PURPOSE:
The purpose of this chapter is to establish use and development regulations for a secondary kitchen within a single-family residence. These regulations are intended to allow Murray City residents to have a second kitchen within a single-family dwelling unit for use by the family residing within the dwelling unit. The purpose of the second kitchen shall be for entertaining, recreation or convenience, without creating a new dwelling unit. (Ord. 14-33)
17.79.020: DEFINITION:
SECOND KITCHEN: A secondary location of kitchen materials which provide permanent provisions for eating, cooking, sanitation, and storing food goods, as an accessory to the primary kitchen within the dwelling. (Ord. 14-33)
17.79.030: DEVELOPMENT STANDARDS:
A second kitchen in a single-family residence may be allowed in an A-1, R-1-6, R-1-8, R-1-10, or R-1-12 zone if the following requirements are met:
A. The residence shall have only one primary entrance.
B. The residence shall have only one address.
C. The residence shall have no more than one electrical meter.
D. Interior access shall be maintained to all parts of the residence to assure that an accessory unit or apartment is not created.
E. A second kitchen shall exist only as part of the primary structure and shall not be installed in an accessory building.
F. The property owner shall sign a written restrictive covenant prescribed by the city which declares that the residence will not be converted into two (2) or more units without specific approval under chapter 17.78 of this title governing accessory dwelling units. The signature on the restrictive covenant shall be notarized, and the restrictive covenant shall be recorded with the Salt Lake County recorder's office prior to issuance of a building permit, or any approval by city staff.
G. Construction of any such kitchen shall comply with current building codes adopted by the city and may require issuance of a building permit prior to the commencement of construction or remodeling to accommodate the additional kitchen.
H. A second kitchen shall not be established in a single-family residential structure which contains an accessory dwelling unit, whether or not such accessory structure unit was established pursuant to chapter 17.78 of this title.
I. Approval of a second kitchen within a single-family dwelling unit shall not constitute an approval of a second dwelling unit or accessory dwelling unit without the required approvals for such as prescribed under chapter 17.78 of this title. (Ord. 14-33)
17.79.040: COVENANT:
Applicants for second kitchens shall provide a copy of the signed, notarized and recorded restrictive covenant stating that the owner or leaseholder of the property will live in the primary dwelling unit as their permanent residence and shall limit the use of the single-family residence to one family only. (Ord. 14-33)
17.79.050: INSPECTION:
Prior to the issuance of a certificate of occupancy, a member of the community and economic development staff shall inspect the project to ensure that all required improvements meet the conditions of this title. (Ord. 14-33)
