CHAPTER 17

173 BUSINESS PARK DISTRICT B-P

17.173.010: PURPOSE:

The purpose of the Business Park District B-P is to allow for and encourage a wide variety of office, creative services, manufacturing, technology, distribution, and other light industrial employment opportunities. Development under these regulations should provide for office space, light manufacturing, and commercial operations in a business park campus-type setting characterized by large buffer strips, open spaces, landscaping, and quality site development standards. This district requires site and design standards that:
   A.   Encourage high quality development while increasing the number of employers and jobs within the City;
   B.   Allow for the revitalization of areas within the City adjacent to I-15, as well as major arterial and major collector roadways;
   C.   Improve the urban design and streetscape elements in order to create a distinct visual quality for the area;
   D.   Manage parking and site access in a manner that enhances pedestrian and bicyclist safety, as well as limiting vehicular conflicts;
   E.   Encourage a safe, attractive and comfortable environment for the pedestrian and bicyclist by providing appropriate open space and landscape buffers, public sidewalks, bike lanes and other amenities as needed;
   F.   Encourage property owners, developers, architects, and contractors to use a mix of high quality, durable, low maintenance building materials which comply with the High- Performance Building Standards developed by the Utah Division of Facilities Construction and Management or comparable third-party sustainable development standards. 17.173.020: PERMITTED USES:

   A.   All uses and structures contained herein are listed by number as designated in the Standard Land Use Code published and maintained by the Planning Department. A use not specifically designated is prohibited.
   B.   The following uses are permitted in the B-P Zone:

17.173.030: CONDITIONAL USES:

   A.   The following uses and structures are permitted in the B-P Zone only after a conditional use permit has been approved by the Planning Commission and subject to the terms and conditions thereof:

17.173.040: MINIMUM LOT OR PARCEL SIZE:

   A.   All uses, lots, or parcels in this zone shall be of sufficient size to assure compliance with the City's development standards.
   B.   Larger lots or parcels are encouraged and will accommodate developments with a business park campus-type setting. (Ord. 18-10)

17.173.050: SETBACKS AND YARD REQUIREMENTS:

   A.   The requirements in this section describe the amount of space required between buildings and property lines.
   B.   All buildings in this zone, including accessory buildings, are required to maintain a minimum distance from property lines as follows:
      1.   Front: Twenty feet (20'). The Planning Commission may reduce the front setback from twenty feet (20') to ten feet (10') if in its judgment the reduction provides a more efficient use of the property. Such setbacks will be determined during the site plan review process.
      2.   Sides: Twenty feet (20') and where adjacent to a Residential Zone. The Planning Commission may reduce the side yard setbacks from twenty feet (20') to ten feet (10') where the side property line abuts a Commercial, Industrial, or Open Space Zone. Such setbacks will be determined during the site plan review process. In the event that the side of the building faces an arterial or collector street, there shall be a setback of twenty feet (20').
      3.   Rear: Twenty feet (20') and where adjacent to a Residential Zone. The Planning Commission may reduce the rear setback from twenty feet (20') to ten feet (10') where the rear property line abuts a Commercial, Industrial, or Open Space Zone. Such setbacks will be determined during the site plan review process. In the event that the rear of the building faces an arterial or collector street, there shall be a setback of twenty feet (20'). The Planning Commission may reduce this if in its judgment the reduction provides a more efficient use of the property.
      4.   Other General Requirements: In addition to the specific setback requirements noted above, no building shall be closer than five feet (5') to any private road, driveway, or parking space to provide for building foundation landscaping and to provide protection to the building. Also, the burden of proof to reduce any setback requirement listed above will be placed on the property owner or design professional prior to Planning Commission review. (Ord. 18-10)

17.173.060: MAXIMUM HEIGHT OF STRUCTURES:

   A.   The height of a structure located within one hundred feet (100') of a Residential Zoning District shall not exceed thirty five feet (35'). Beyond one hundred feet (100'), a structure in this zone is allowed at a height of fifty feet (50'). (Ord. 18-10)

17.173.070: DEVELOPMENT STANDARDS:

   A.   Architectural And Site Plan Review: All building elevations and site plans are required to go through an architectural plan review and approval process with the Planning Commission. This may include recommendations for architectural design of buildings and structures, as well as revisions to the proposed site plan.
   B.   Landscaping Buffers: Ten feet (10') of landscaping shall be required along all frontage areas abutting a public street. There shall be a minimum of ten feet (10') of landscaping between parking areas and side and rear property lines adjacent to residential zoning or land uses. Landscaping adjacent to off street parking within the yard area will require a minimum of five feet (5') of landscaping if not abutting residential zoning or land uses.
   C.   Landscape Coverage: Landscaping must cover at least ten percent (10%) of the development site. (Ord. 18-10)

17.173.080: USES WITHIN BUILDINGS:

   A.   All uses in the B-P Zone shall be conducted entirely within a fully enclosed building.
   B.   Outside storage of merchandise shall be accommodated within a fully enclosed building.
   C.   Temporary structures are not permitted. (Ord. 18-10)

17.173.090: SCREENING, LANDSCAPING, AND FENCING REQUIREMENTS:

   A.   A solid wall or solid fencing, and landscaping of acceptable design shall effectively screen the borders of any commercial or industrial lot which abuts a Residential Zoning District. Such solid wall or solid fence shall be at least six feet (6') in height, unless otherwise allowed by the Planning Commission during site plan review. Such solid wall or solid fence shall be maintained in good condition with no advertising thereon.
   B.   All developments shall comply with chapter 17.68, "Landscape Requirements", of this title.
   C.   All developments shall comply with chapter 17.64, "Fence Regulations", of this title. (Ord. 18-10)

17.173.100: TIMING OF LANDSCAPING INSTALLATION:

   A.   All landscaping shall be completed in accordance with the approved site plan and shall be installed prior to the issuance of a Certificate of Occupancy for any building. A security for performance will be required in accordance with section 17.76.110 of this title. It shall be the responsibility of the property owner to maintain all approved landscaping in accordance with the approved site plan and in compliance with the requirements of chapter 17.68, "Landscape Requirements", of this title. 17.173.110: TRASH STORAGE:

   A.   No trash, used materials, or wrecked or abandoned vehicles or equipment shall be stored in an open area. All such materials shall be kept within a fully walled enclosure that is architecturally compatible with the main building.
   B.   All refuse containers shall meet the requirements of section 17.76.170 of this title.
   C.   This section shall not apply to community or public recycling bins or drop boxes; however, the location of community or public recycling bins and drop boxes shall be determined by staff in accordance with the standards herein. (Ord. 18-10)

17.173.120: PARKING REGULATION:

   A.   All office uses will be calculated at the ratio of four (4) off street parking spaces for each one thousand (1,000) square feet of net useable floor area.
   B.   All retail uses will be calculated at the ratio of five (5) off street parking spaces for each one thousand (1,000) square feet of net useable floor area.
   C.   Light industrial uses, wholesale establishments, and warehouses will be calculated at the ratio of four (4) parking spaces for each one thousand (1,000) square feet of net useable office space, plus one parking space for each seven hundred fifty (750) square feet of net useable warehouse space, or one space for each person employed on the highest employment shift, whichever is greater.
   D.   Off street parking will not be permitted in any fire lane, aisle space, or front yard setback areas. (Ord. 18-10)
