ARTICLE I

INTRODUCTION

1-1 Interpretation

The provisions of this Appendix A shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, comfort, morals, prosperity and general welfare. It is not intended by this Appendix A to interfere with, abrogate or annul any ordinance, rules, regulations, or permits which are not in conflict with the provisions of this Appendix A. Nor is it intended by this Appendix A to interfere with, or abrogate or annul any easements, covenants or other agreements between parties, except that if this Appendix A imposes a greater restriction, this Appendix A shall control. All property owners or users of property must comply with the requirements of this Appendix A and shall be required to apply for any zoning approvals, permits, variances, or exceptions in order to bring any land, use of land, buildings, structures, or improvements into conformance with this Appendix A.

Where uncertainty exists with respect to the boundaries of the various districts as shown on the zoning map, the following rules apply:

  1. The district boundaries are either streets or alleys unless otherwise shown, and where the districts designated on the zoning map appear to be bounded approximately by street or alley lines, the street or alley shall be construed to be the boundary of the district.
  2. Where the district boundaries are not otherwise indicated, and where the property has been or may hereafter be divided into blocks and lots, the district boundaries shall be construed to be the lot lines, and where the districts designated on the zoning map appear to be bounded approximately by lot lines, the lot lines shall be construed to be the boundary of the districts unless the boundaries are otherwise indicated on the map.
  3. For unsubdivided property, the district boundary lines on the zoning map shall be determined according to the scale appearing on the map. (Ord. 03-1155, 3-18-2003)

1-2 Separability

Should any Section, clause or provision of this Appendix A be declared by the courts to be invalid, such partial invalidity shall not affect the validity of the Appendix as a whole or any other part of the Appendix. (Ord. 03-1155, 3-18-2003)

1-3 Scope

All ordinances or parts of ordinances in conflict are repealed. (Ord. 03-1155, 3-18-2003)

1-4 Enforcement

The Director of Community Development shall have the authority to enforce any provision of this Appendix A through the proper legal channels. An appeal from the decision of the Director of Community Development or his or her designee may be made to the Zoning Board of Appeals as provided in Chapter 4, Article IX of this Code.
