ARTICLE XVIII

ACCESSORY STRUCTURES

18-1 Purpose

An accessory structure that is secondary and incidental to a permitted or approved special use within a particular zoning district may, in accord with this Article, be allowed to occupy the same zoning lot as the principal structure. To qualify as an allowable accessory structure, it must be maintained under the same ownership and on the same lot as the principal structure and must meet the definition as stated in Article III of this Appendix A. All accessory buildings and structures shall conform to the applicable requirements of this Appendix A and to all other Village regulations, including, but not limited to, the Building Code, Electrical Code and the Fire Prevention Code. The requirement that the accessory structure be maintained on the same lot as the principal structure shall not apply to tennis courts maintained by a public school. (Ord. 03-1155, 3-18-2003; amd. 18-2 General Standards

  1. No accessory structure shall occupy more than thirty percent (30%) of any required yard.
  2. Accessory structures shall not be located on or within a drainage, access, utility or other easement created by a duly recorded document or by prescription in the case of a governmental easement.
  3. No accessory structure shall be approved, established or constructed until fifty percent (50%) or more of the principal use or structure has been completed. In addition, no accessory building shall be used unless the main building on the lot is occupied.
  4. No accessory building or structure shall be used as a dwelling unit.
  5. Permitted accessory structures and the standards for each are indicated in the table below. A description of each standard follows the table. These standards shall apply to all accessory structures, including those in existence at the time of adoption of this Appendix A. Existing accessory structures that do not comply with these standards shall be deemed nonconforming, and subject to the provisions of Article XXI, "Nonconforming Situations", of this Appendix A.
  6. Any accessory building that is not a part of the main structure shall be located not less than sixty feet (60') from the front lot line. (Ord. 03-1155, 3-18-2003)
  7. No outdoor storage shall be permitted in any district. (Ord. 04-1216, 9-21-2004)
  8. Subsections A, C and F of this Section shall not apply to tennis courts maintained by a public school. (Ord. 18-1700, 1-16-2018)
