VARIATIONS AND AMENDMENTS
Requests for variations from the strict application of this Appendix A shall be made to the Zoning Board of Appeals in accordance with the standards, reviews and submittal process set forth in Chapter 4 of this Code. Variations may only be applied to structures and not to uses. The only regulations which may be varied are those with numerical standards. (Ord. 03-1155, 3-18-2003)
The Village Board may from time to time on their own motion or on petition, after public notice and hearing before the Plan and Zoning Commission, amend the regulations of this Appendix A. In case a written protest against any proposed amendment of the regulations or districts is signed and acknowledged by: 1) the owners of twenty percent (20%) of the frontage of the property or properties proposed to be altered; or 2) by the owners of twenty percent (20%) of the frontage immediately adjoining or across an alley from the property or properties; or 3) by the owners of twenty percent (20%) of frontage directly opposite the frontage of the property or properties proposed to be altered, is filed with the Village Clerk and such protest has been served by the protestor on the zoning amendment applicant or his or her attorney by regular mail, such amendment shall not be passed except by a favorable vote of two-thirds (2/3) of the trustees then holding office. Any fees or escrows associated with any variation or rezoning of any property shall be as set forth in Appendix D of this Code. (Ord. 03-1155, 3-18-2003)
