ARTICLE II

PURPOSE AND STANDARDS

2-1 Goals And Objectives

This Appendix A is established pursuant to 65 Illinois Compiled Statutes 5/11-13 of the Illinois Municipal Code to meet specified goals and objectives. These goals and objectives shall be considered when interpreting or amending this Appendix A and are as follows:

  1. To establish adequate standards for the provision of light, air and open space.
  2. To zone all properties with a view to conserving property values and encouraging the most appropriate use of land throughout the Village.
  3. To minimize congestion on public streets.
  4. To facilitate the provision of adequate transportation and other public services such as water, sewerage, schools and parks.
  5. To avoid hazards to persons and damage to property from inappropriate development of lands and provide for adequate drainage, curbing of erosion and reduction of flood damage.
  6. To avoid and to prevent the undue overcrowding of land, thereby ensuring proper living and working conditions and preventing the development of blight and slums.
  7. To foster a rational relationship between residential, business, commercial and industrial uses for the mutual benefit of all.
  8. To protect residential, business, commercial and industrial areas alike from harmful encroachment by incompatible uses and to ensure that land allocated to a class of uses shall not be usurped by inappropriate uses.
  9. To isolate or control the location of unavoidable nuisance producing uses.
  10. To establish reasonable standards to which buildings and structures shall conform, but also to encourage innovative development design.
  11. To provide for the regulation of nonconforming buildings, structures, lots and uses.
  12. To prevent such additions to and alterations or remodeling of existing buildings or structures as would not comply with the restrictions and limitations imposed by this Appendix A.
  13. To define the powers and duties of administrative and enforcement officers and bodies.
  14. To prescribe penalties for any violation of the provisions of this Appendix A.
  15. To implement the objectives of the Northfield Comprehensive Plan, enhance quality of life and protect all appropriate existing structures and uses. (Ord. 03-1155, 3-18-2003)

2-2 Applicability

  1. General Prohibition. No land or structure on land and no lot of record or zoning lot shall be established, built, altered, moved, divided or maintained except in accordance with the provisions of this Appendix A.
  2. Private Agreements. This Appendix A is not intended to nullify or enforce any private agreement or covenant. The Village shall not be obligated to recognize or enforce a private covenant or agreement, but may, in its sole discretion, choose to do so.
  3. Other Laws And Regulations. Unless otherwise specifically provided, this Appendix A shall control over less restrictive laws of any statute or other ordinance and a more restrictive statute or other ordinance will control over the provisions of this Appendix A. In addition to the provisions of this Appendix A, all other provisions of this Code shall be applied. The Village Board may grant an exception to any of the requirements of this Appendix A or from any Village policy or practice in order to avoid violating a person's rights which are based in the exercise of religious freedom afforded by any federal or state law. Such an exception may be granted only after due notice and a public hearing.
  4. Existing Structures. Existing structures that do not comply with the regulations of Appendix A are subject to the nonconformity provisions of Article XXII of this Appendix A.
  5. Existing Variations And Special Use Permits. Existing variations and special use permits (including planned developments) which were validly granted shall remain valid.
  6. Applicability To Building Permits Issued Before Effective Date. Structures for which building permits were issued before the effective date of this Appendix A may be completed under the terms of the regulations in existence at the date of issuance and shall be deemed to be conforming uses or structures. However, if a structure does not comply with the provisions of either this Appendix A or the zoning ordinance in effect at the time of issuance that structure shall be subject to the nonconformity provisions of this Appendix A.
  7. Applicability To Pending Applications. If a required public hearing has been held with respect to a pending application the zoning provisions in effect on the first date of the public hearing shall apply. The provisions of this Appendix A shall apply to all other applications which are pending on its effective date. (Ord. 03-1155, 3-18-2003)

2-3 Zoning Of Annexed Land

At such time as property is annexed to the Village it shall be zoned, R-1 countryside residential, unless an annexation agreement with the Village prescribes otherwise. (Ord. 03-1155, 3-18-2003)

2-4 Zoning Lots

Only one principal structure is permitted on a zoning lot. The Division of zoning lots shall be regulated as described in Appendix B, "SubDivision Regulations", of this Code. (Ord. 03-1155, 3-18-2003)
