CHAPTER 1266

R-3 One-Family Residence Districts

1266.01 APPLICATION OF OTHER PROVISIONS OF CODE.

   The provisions of Section 1258.03 and Chapter 1296, as set forth in this Zoning Code, shall apply to all R-3 Districts.

1266.02 PERMITTED USES.

   In an R-3 Residence District, no building or premises, unless otherwise provided in this Zoning Code, shall be erected which is arranged, intended or designed to be used except for the following purposes, and as regulated by this Zoning Code:
   (a)   One-family detached dwellings.
   (b)   Churches, schools, libraries, public buildings and memorials, public parks and public playgrounds.
   (c)   Agriculture, horticulture or gardening, but not including commercial nurseries, the raising of any animals for commercial purposes or the sale of any products on the premises.

1266.03 ACCESSORY USES.

   An accessory use in an R-3 District is a use that is customarily incident to a permitted use, provided that such accessory use does not constitute or become a public or private nuisance.

1266.04 AREA REQUIREMENTS.

   Area requirements in an R-3 District are as follows:
   (a)   Minimum Lot Area. 10,500 square feet.
   (b)   Minimum Lot Width. Seventy-five feet.
   (c)   Minimum Lot Depth. 140 feet.
   (d)   Minimum Lot Coverage. 800 square feet of first floor living area.
   (e)   Minimum Yards.
      (1)   Front yard. Fifty feet.
      (2)   Side yards. Fifteen feet total. No side yard shall be less than five feet.
      (3)   Side yard of corner lot. A side yard along the side street lot line of a corner lot, which lot abuts in the rear, either directly or across an alley, the side lot line of another lot in an "R" District, shall have a width of not less than one-half the required depth of the front yard on such other lot fronting on the side street, with twenty-five foot minimum.
      (4)   Rear yard. Fifty feet.

1266.05 MAXIMUM BUILDING HEIGHT.

   The maximum building height in an R-3 District is two and one-half stories, but not to exceed thirty-five feet.

1266.06 OFF-STREET AUTOMOBILE PARKING REQUIREMENTS.

   Off-street parking requirements in an R-3 District are two car spaces for each dwelling unit.

1266.07 COMPLIANCE WITH SUBDIVISION REGULATIONS AND CITY SPECIFICATIONS REQUIRED; SEWER AND WATER FACILITIES REQUIRED.

   (a)   Any subdivision of land within an R-3 District shall fully comply with the Subdivision Regulations of the City of Norton, Ohio.
   (b)   Minimum improvements must be constructed according to City specifications.
   (c)   All lots within R-3 Districts must be served by adequate sewer and water facilities controlled or operated by a duly constituted public authority or by a person or company licensed to do business as such under the laws of the State of Ohio, with such sewer and water facilities connected to any dwelling located or to be located thereon.
