CHAPTER 1256

Amendments

1256.01 PUBLIC HEARING REQUIRED.

   The regulations, restrictions and boundaries set forth in this Zoning Code may from time to time be amended, supplemented, changed or repealed, provided, however, that no such action may be taken until after a public hearing in relation thereto has been held, at which hearing parties in interest and residents shall have an opportunity to be heard.

1256.02 INITIATION OF AMENDMENTS OR SUPPLEMENTS.

   Amendments or supplements to this Zoning Code may be initiated by motion of the Planning Commission, by the adoption of an ordinance therefor by the City Council or by the filing of an application therefor with the Planning Commission by one or more of the owners or lessees of property within the area proposed to be changed or affected by the proposed amendment or supplement. The City Council shall, upon the adoption of such an ordinance, certify it to the Planning Commission.

1256.03 SUBMISSION OF APPLICATIONS; VERIFICATION.

   Applications for amendments or supplements to this Zoning Code shall be submitted to the Planning Commission upon such forms, and shall be accompanied by such data and information, as may be prescribed for that purpose by the Planning Commission, so as to assure the fullest practicable presentation of facts for the permanent record. Each such application shall be verified by at least one of the owners or lessees of property within the area proposed to be changed or affected by the proposed amendment or supplement, attesting to the truth and correctness of all facts and information presented with the application.

1256.04 SUBMITTAL OF NAMES AND ADDRESSES OF CONTIGUOUS PROPERTY OWNERS.

   Any person desiring an amendment or supplement to the Zoning Code shall file with the application for such change a statement giving the names of all owners of property within and contiguous to the area proposed for reclassification or redistricted and the property owners directly across the street from the contiguous property owners. The names and addresses of such owners shall be as they appear on the current tax duplicate of the County. A copy of each application and statement shall be delivered by the Secretary of the Planning Commission to the Clerk of Council upon filing.

1256.05 APPLICATION FEE.

   Each application for an amendment, except those initiated by Council or the Planning Commission, shall be accompanied by a check payable to the City of Norton or a cash payment in accordance with the schedule of fees, charges and expenses as set forth in Section 1252.03.

1256.06 RECOMMENDATION BY PLANNING COMMISSION TO CITY COUNCIL.

   The Planning Commission shall, within sixty days of the adoption of a motion, the certification of a resolution or the filing of an application, approve, disapprove or make suggestions concerning the proposed amendment or supplement, and shall submit such recommendation, together with such resolution or application, and together with the text and map pertaining thereto, to the City Council.

1256.07 ZONING MAP AMENDMENTS.

   When an amendment to this Zoning Code changing the zoning of any area is adopted, it shall be the duty of the Building and Zoning Inspectors to cause such change to be entered on the Official Zoning Map on file in the office of the Clerk of Council of the City of Norton.

1256.08 PUBLIC HEARING BY CITY COUNCIL.

   Before any proposed amendment or supplement may be passed, the City Council shall hold a public hearing thereon.
   Notice of the hearing shall be provided in accordance with Section 3.19 of the Charter at least fifteen days prior to the hearing. Notice of the hearing shall also be mailed at least fifteen days prior thereto, addressed to the owners of the property under consideration and also to each owner of property identified in Section 1256.04 of the Codified Ordinances. The name and addresses of such owners shall be as they appear on the current tax duplicate of the County. The notice of the hearing shall contain a brief description of the property involved, a statement as to its location, a list of the maps and documents to be considered and a summary statement of the matters to be heard. The Administrative Officer shall cause a temporary sign to be placed on the property which is the subject of the application or contemplated action for the purpose of giving notice of the public hearing. The sign shall be placed no less than fifteen days before the public hearing on the matter. Copies of the maps and other documents to be considered at the hearing shall be filed in the office of the Clerk of Council of the City of Norton. Such copies shall be made available at such office for public inspection.

1256.09 PUBLIC EXAMINATION OF DOCUMENTS.

   During the fifteen-day period following the publication of notice of a public hearing, the text or a copy of the text of a proposed amendment or supplement, together with the maps or plans, or copies thereof, forming part of or referred to in such amendment or supplement, and the maps, plans and reports submitted by the Planning Commission, shall be on file for public examination in the office of the Clerk of Council of the City of Norton.

1256.10 VOTE BY CITY COUNCIL.

   Within ninety days after a public hearing, the City Council shall either adopt or deny the recommendations of the Planning Commission or adopt some modification thereof. No such amendment or supplement which violates, differs from or departs from the recommendation of the Planning Commission shall take effect unless passed or approved by not less than four of the membership of the City Council.

1256.11 EFFECTIVE DATE OF AMENDMENT OR SUPPLEMENT.

   Any amendment or supplement adopted by the Council shall become effective as provided under the provisions of the laws of the State of Ohio, or as provided by the Charter of the City of Norton.
