Sec. 14-143

Nonconforming uses.

Nonconforming uses may be continued subject to the following:

(a)

A nonconforming use may be changed to a conforming use in accordance with the requirements in this ordinance, but in no event shall a nonconforming use be converted to another nonconforming use or replace an abandoned or discontinued nonconforming use. If a nonconforming use is changed to or replaced by a conforming use, the prior nonconforming use shall be prohibited.

(b)

If a nonconforming use is abandoned or discontinued for a continuous period of one (1) year, the nonconforming use shall be prohibited. Operation of only an accessory use to the principal nonconforming use during the time of abandonment or discontinuance of the nonconforming use shall not constitute continuation of the principal nonconforming use.

(c)

A nonconforming use or structure housing a nonconforming use shall not be expanded in area, extended, enlarged, or altered except as expressly permitted herein.

(d)

A nonconforming use damaged by casualty may be continued provided that the use has not been discontinued or abandoned. (Ord. No. 12-16, Jan. 2013)
