SECTION XVI

ADMINISTRATION AND PERMITS15

The Building Official shall administer this Zoning Code.

Each application for a building permit shall be accompanied by a plat, in duplicate, drawn to scale, showing the actual dimensions of the lot to be built upon, the size, shape, and location of the building to be erected and such other information as may be necessary to provide for the enforcement of this Ordinance. A record of such application and plat shall be kept in the office of the Building Official.

It shall be unlawful to use or permit the use of any building or premises thereon hereafter created or erected, changed or converted wholly or partly in its use or structure until a certificate of occupancy to the effect that the building or premises or part thereof and the proposed use thereof conform to the provisions of the Zoning Code and has been issued by the Town Building Official with approval of the Planning and Zoning Board. A temporary certificate of occupancy for a part of a building may be issued by the Town Building Official; provided, that upon written request from the owner, the Building Official shall issue a certificate of occupancy for any building or premises existing at the time of the passage of this Ordinance certifying, after inspecting the use of the building or premises, whether such use conforms to the provisions of this Zoning Code.

Where application is made to extend a nonconforming building or a nonconforming use in a building where a nonconforming building or use exists under the provisions of Section XIII of this Zoning Code, the application shall be accompanied by an affidavit giving the description of the premises owned at the date of passage of this Zoning Code and must bear the signature and seal of a registered architect or the signature and seal of a registered engineer. Such application shall be treated procedurally as an application for a variance.

Application for building permit for condominiums, cooperative apartments, clubs and time sharing dwellings shall also be accompanied by acceptable incorporation documents that establish their legal entity in the State of Florida and responsibility for construction.

Where application is made to construct an in-ground swimming pool, a form board survey shall be prepared and presented to the Building Official who shall determine that the swimming pool has been located in accordance with Town Code and the permit application. This shall be done prior to the installation of the swimming pool structural material.

Where application is made to install any perimeter fence or wall, survey stakes shall be utilized to guide the fence installation. The Building Official shall verify the proper location of the fence or wall in accordance with Town Code and the permit application. This shall be done prior to the installation of the perimeter fence or wall.
