SECTION XX

INTERPRETATION, PURPOSE, AND CONFLICT

Pf. 20.1.- Requirements of code minimum or maximum.

In interpreting and applying the provisions of this Zoning Code, such provisions shall be held to be minimum or maximum requirements, as the case may be, necessary to promotion of the public health, safety, morals, and general welfare of the residents of the Town. It is not intended that this Zoning Code shall interfere with, abrogate, or annul any easements, covenants, deed restrictions, or other agreements between or among private parties; provided, however, that where this Zoning Code imposes greater restrictions, of whatsoever type, upon properties situate in the Town that the restrictions imposed by any private agreement, covenant, or deed restriction, the provisions of this Zoning Code shall be controlling.

Pf. 20.2. - Intent in event of declaration of unconstitutionality.

Should a court of competent jurisdiction hold that any provision of this Zoning Code, or the Official Zoning Map made a part hereof, is unconstitutional or unenforceable as to any particular parcel of land or structure within the Town of Palm Beach Shores, because uses permitted for such parcel of land or structure or other restriction thereon amounts to the taking of such property or structure without due process of law or for other lawful reason, then and in that event, such parcel of land or structure is hereby declared to be, and is hereby classified under this Zoning Code as being in the next less restrictive classification; that is to say, if a court of competent jurisdiction holds the classification of a particular parcel of land or structure classified in District A to be arbitrary and unreasonable, such property shall thereafter be classified under this Zoning Code as District B, and so for other zoning classifications under this Code.
