The purpose of the OVL-7 Overlay District is to create a realistic opportunity for the construction of boutique hotels in the SED-5 zone district generally bounded by Interstate 287 (I-287)/Marine Hector Cafferata Jr. Congressional Medal of Honor Highway/Pomeroy Road, Interstate 80 (I-80)/Christopher Columbus Highway, the properties fronting Jefferson Road and Halsey Road.
All prohibited uses set forth in § 430-142 for the SED Specialized Economic Development Districts 3, 3A, 5, 5A and 10 shall apply in the OVL-7 Overlay District.
§ 430-440 Accessory uses.
Boutique hotels shall have only the following accessory uses, which shall be contained within the principal structure and shall not have a direct exterior entrance:
Restaurant: one restaurant/banquet room with dining area with a capacity of no more than the lesser of 10% of the floor space of the principal building or 150 seats.
Dedicated office-type workspace not to exceed an aggregate floor area of 1,500 square feet, limited to guests of the boutique hotel, as well as conference and/or banquet attendees. Convenience seating areas within hotel common areas shall not be counted within the workspace aggregate floor area.
Convenience retail/gift shop with a gross floor area not to exceed 500 square feet, limited to guests of the boutique hotel, as well as conference and/or banquet attendees.
Required parking, circulation, drainage, lighting, landscaping, and solid waste management facilities and permitted signage.
§ 430-441 Height, area and other bulk requirements.
The following dimensional requirements shall apply to the boutique hotel overlay. Relief from these standards shall require variances pursuant to N.J.S.A. 40:55D-70(c):
In light of the maximum number of guest rooms and amenity space prescribed herein for a boutique hotel and the fact that such uses are limited in size, the minimum parking requirement of Article XXXVII is hereby relaxed to the extent set forth in this section. Such requirements are adopted as conditional use standards for a boutique hotel, and relief from such standards shall require a variance pursuant to N.J.S.A. 40:55D-70(c):
Restaurant/banquet room with dining area: Spaces for guests of the boutique hotel are calculated as part of the boutique hotel requirement. Spaces for non-hotel guests are calculated as one space per three seats based on 30% of total guest rooms.
Meeting space: Spaces for guests of the boutique hotel are calculated as part of the boutique hotel requirement. Spaces for non-hotel guests are calculated as one space per two seats based on 30% of total guest rooms.
Except for the requirement that off-street parking spaces, together with appropriate access thereto, shall be provided on the same lot as the boutique hotel is intended to serve, existing parking lots/parking areas accessory to a boutique hotel that do not meet the location and setback requirements of § 430-147 may be continued in their present location and utilized for parking for such boutique hotel.
Except as specifically provided for hereinabove, off-street parking space shall be provided as specified in Article XXXVII or as otherwise may be required in this chapter.
§ 430-443 Signs.
Signs shall be regulated as provided in Article XXXVIII, Signs.
§ 430-444 Storage.
The provisions of § 430-146C regarding storage shall remain applicable to a boutique hotel.
