10-1.- Text.

The text of the Pawleys Island Zoning Ordinance is amended to adopt the following to be applied to the portion of the Town of Pawleys Island shown on the map entitled "Prince George U.S.C. Development Foundation, Planned Development District.

1.1

Purpose—General. The general purpose of the Prince George, U.S.C. Development Foundation and the Planned Development District is to provide a place for education, research and related activities associated with the ecology of this unique property.

1.2

Use areas. The following use areas are established for this planned development district. The use areas are shown on the zoning district map of the property.

1.2-1

Education, preservation and conservation area.

1.2-1.1

Purpose. The purpose of this area is to provide people with unique learning experiences through contact with the natural environment with support facilities necessary to facilitate this experience. Access to these areas and the number of people at any given time will be controlled by the U.S.C. Development Foundation and/or the University of South Carolina.

1.2-1.2

Permitted uses. The following uses will be permitted in this area:

a.

Boardwalks.

b.

Shelters.

c.

Observation platforms.

d.

Educational facilities including classrooms.

e.

Cabins/lodges.

f.

Research laboratories.

g.

Caretaker residence/counselors not to exceed four of which no more than one permanent residence.

h.

Maintenance and storage facilities.

i.

Other similar facilities needed to accommodate the learning experience.

Nature based tourism area.

1.2-2.1

Purpose. The purpose of this area will be to provide facilities to accommodate people attracted to this unique area by conferences, tours, exhibits or other activities related to the educational, environmental and wildlife qualities of the property. Access to these areas will be controlled by the U.S.C. Development Foundation and/or the University of South Carolina.

1.2-2.2

Permitted uses. The following uses will be permitted in this area:

a.

Conference facilities to include overnight accommodations with food service facilities limited to that necessary to accommodate guests of overnight accommodations and other groups utilizing the property.

b.

Caretaker residences—No more than two—No more than one permanent.

c.

Maintenance and storage facilities.

d.

Welcome center.

e.

Community service facilities such as fire stations, police stations, etc.

f.

Other facilities related to the purpose of the area.

Setback from U.S. Highway 14 ROW: All structures other than informational signs shall be set back at least 200 feet from the right of way line of U.S. Highway 17 as it exists as of the date of the adoption of this ordinance.

1.2-3

Educational conference complex area.

1.2-3.1

Purpose. The purpose of this area is to provide facilities to accommodate research, educational and conference activities having limited access to the public controlled by the U.S.C. Development Foundation and/or the University of South Carolina.

1.2-3.2

Permitted uses. The following uses will be permitted in this area;

a.

Laboratories and classrooms.

b.

Overnight accommodations for conference and research participants.

c.

Conferences facilities.

d.

Caretaker residences.

e.

Maintenance and storage facilities.

f.

Other facilities related to the purpose of the area.

Pawleys inlet buffer area.

1.2-4.1

Purpose. The purpose of this area is to insure that educational, preservation and conservation activities containing enclosed structures shall not encroach on Pawleys Inlet. This area includes the strip of land parallel to the frontage on Pawleys Inlet and extending westward a distance of 200 feet from the mean high water level.

1.2-4.2

Permitted uses. The following uses will be permitted in this area:

a.

Boardwalks.

b.

Shelters.

c.

Observation platforms.

d.

Other facilities related to the purpose of the area; provided, however, no enclosed structure shall be permitted in this area.

1.3

General provisions and procedures.

1.3-1

Submission of building plans and plats. All plans for buildings and other structures shall be submitted to the Pawleys Island Building Official for permits as required by the building code. All plans for the streets and roads to be used to access uses in the Educational Conference Complex area and Nature-Based Tourism area shall conform to the grading and drainage requirements of the Pawleys Island Subdivision Regulations, however the street surface may be of any all weather material. Streets, driveways and other access within the Education, Preservation and Conservation area will not be required to meet any street or road standards of Pawleys Island. All streets, driveways and other access shall be privately owned, controlled and maintained.

Setbacks. Any buildings located in this district shall be setback from the exterior property line at least 25 feet.

Pawleys Island requirements to apply. The standards and requirements of ordinances of the Town of Pawleys Island not addressed in this text for the Prince George - U.S.C. Development Foundation and the Planned Development District shall apply to all development within this zoning district.

10-2. - Zoning district map.

The zoning district map of the Town of Pawleys Island is hereby amended to include the Prince George U.S.C. Development Foundation, Planned Development District Map dated October 11, 1995. This map is the official zoning map for this Planned Development District.

10-3. - Planned development district amendments.

Recognizing that improvements included in this planned development district will be carried out over an indefinite number of years, it may be necessary to amend the development plan from time to time. Such amendments may be classified as "minor" or "major" amendments; the Pawleys Island Planning Commission shall determine the classification of a proposed amendment.

3.1

Minor amendments. Minor amendments may be reviewed and approved or disapproved by the Pawleys Island Planning Commission after a public hearing. Minor amendments will extend only to adjustments in the location or character of buildings or facilities within the various use areas to carry out the purpose of the use areas.

3.2

Major amendments. Major amendments will constitute an amendment to the Pawleys Island Zoning Ordinance and will follow the procedure required for all zoning ordinance amendments. Major amendments will include the proposed addition of use areas or changes in the location of use areas within the planned development district or change in the purpose of a use area. Major amendments will be required only where uses proposed for a use area deviate substantially from those permitted uses described for that use area.
