ENFORCEMENT
This article:
A.
Establishes procedures to ensure compliance with the LUDC;
B.
Establishes procedures to correct violations of the LUDC;
C.
Establishes remedies and penalties for violations of the LUDC; and
D.
Encourages the voluntary correction of violations, where possible.
The following entities shall enforce the LUDC and are authorized to order the discontinuance of any violation of the LUDC: town council, department of planning and development and, when specified, the finance, utilities, and maintenance department, the police department, and the fire department.
A.
No person shall develop or use any land, building, or structure within the town in violation of the LUDC, regulations authorized under the LUDC, or the terms and conditions of entitlements issued under the LUDC.
B.
Violation of any condition or safeguard imposed as part of a development permit order or development permit is a violation of the LUDC.
No development order may be issued under the LUDC unless all structures and uses of land and structures permitted under the development order conform to the LUDC, the regulations promulgated under the LUDC, and the terms and conditions of other development orders issued under the LUDC that apply to the use or structure. A development order issued in violation of the LUDC is void.
The LUDC does not prohibit the continuation of previous enforcement actions undertaken by the town pursuant to previous regulations.
Each day that a violation occurs or remains uncorrected constitutes a separate and distinct violation of the LUDC.
The town shall provide written notice to the property owner, agent, or applicant, or shall post it in a prominent location at the place of violation. The notice shall order the necessary steps to abate the violation.
Any person who violates any provision of the LUDC, fails to secure a permit or certificate of occupancy as required by the LUDC, or fails to comply with any order issued by the authorities set forth in section 8.1.2, is punishable in accordance with section 1-11 of the Code of Ordinances. Penalties shall be assessed upon finding of violation by the special magistrate or any court of competent jurisdiction.
