36 PARKING

17.36.010 Enlargement Or Increase Of Use

  1. For new buildings or any enlargement or increase in seating capacity, floor area, or guest rooms of any existing building, the recommended parking standard is as provided.
  2. In the Downtown Zone, existing buildings, regardless of the use, shall be exempt from parking requirements. Such buildings, businesses, and uses may utilize public parking, or on-street parking when allowed. There are no exemptions for the parking spaces required for residential uses. This exemption does not apply to new construction, nor to expansions of buildings.

17.36.030 Access

  1. Access to parking spaces as required in this chapter for commercial and industrial uses shall not be less than twelve (12) feet wide and not more than forty (40) feet wide at the curb line.
  2. Twelve (12) foot width shall be minimum width for one-way access.
  3. Twenty-four (24) foot width shall be minimum width for two-way access.

17.36.040 Existing Building Not Deemed Nonconforming

No lawfully existing building shall be deemed nonconforming solely because of the lack of required parking spaces; provided, that the space being used for off-street parking or loading in connection with any such building shall not be further reduced in area or capacity.

17.36.050 Rounding Up Of Fractional Numbers

When the calculation of the required number of spaces called for in this chapter results in a fractional number, fractions shall be rounded to the next higher whole number of spaces.

17.36.070 Mixed Uses

Off-street parking facilities for several buildings, structures or uses, or for mixed uses, may be provided that the total number of spaces so located together shall not be less than the sum of the separate requirements for each of the buildings or uses.

17.36.080 Hard-Surfaced Parking Spaces

  1. Every open off-street parking area having more than four (4) contiguous parking spaces shall be hardscaped with an impermeable surface of concrete or asphalt. This includes access driveways.
  2. The front yard (the area between the front building line out to the side property lines and forward to the right of way) of any commercial or industrial building shall be landscaped or hardscaped for parking or a combination thereof. The side yard for a corner lot shall be considered part of the front yard.
  3. The parking and landscaping plans of any newly constructed building, or any building adding on 500 square feet or more to the original structure, shall be reviewed and approved by the Planning and Zoning Commission before the issuance of any building permit.

17.36.090 Lighting - Screening

  1. Lighting used to illuminate off-street parking areas shall be directed away from residential properties. Parking areas shall be effectively screened on any side adjoining property in a residential zone by a wall, privacy fence or hedge to a height of six (6) feet except for the front yard setback area of the adjoining residential property, in which case the maximum height shall be three (3) feet.
  2. Fencing and screening, including landscaping, shall be maintained in good condition. The space between such fence, wall, or planting screen and the lot line of the adjoining premises in any residential district shall be landscaped with grass, hardy shrubs or evergreen ground cover, and maintained in good condition.
  3. If terrain or other natural features are such that the erection of such a fence, wall, or planting screen will not serve the intended purpose, then the Planning and Zoning Commission may choose not to require the wall or planting screen and landscaping.
  4. Lighting and screening plans should be approved by the Planning and Zoning Commission in conjunction with landscaping and parking plans.

17.36.100 Required Parking Spaces

  1. Parking spaces which require the backing of vehicles into a roadway, except such spaces as are typical with a single-family home in a residential zone, should be avoided wherever possible.
  2. Parking spaces as set forth in this section shall be provided for all uses allowed and special uses permitted in any zone, provided that a greater or fewer number of spaces may be required or allowed in any case where a special use permit is involved:

    Two (2) parking spaces for each three (3) employees working on the highest employment shift plus required spaces as specified below.
    Hotel, Motel, Club, Lodging Houses
    One (1) for each guest bedroom
    Boarding Houses, Rooming Houses, Dormitories and Fraternity Houses with Sleeping Rooms
    One (1) for each guest bedroom and/or one and a half (1.5) for each permanent occupant
    Social Hall, Dance Hall, Nightclub, Pool Hall, or other similar Enterprise or Establishment
    One (1) for every 250 square feet of gross floor area
    Restaurant
    One (1) for each booth or eating table
    Bowling Alley
    Two (2) spaces for each alley
    Drive-In Theater
    A reservoir space at the entrance containing one (1) parking space for each ten (10) vehicles accommodated within
    Medical, Clinic, or Dentist Offices
    One (1) for every 250 square feet of net floor area
    Retail Stores, Banks, and Shops other than specified in this table
    One(1) for every 250 square feet of retail floor area over two thousand (2,000) square feet
    Retail sales establishments handling only durable goods or bulky merchandise, such as machinery, furniture, or vehicles, personal services, repair shops, and wholesale stores
    One (1) for every 600 square feet of net floor area over two thousand (2,000) square feet
    All other types of business or commercial use permitted in any business district
    One (1) for every 300 square feet of floor area
    Mortuary, Funeral Parlors, and Similar Uses
    One (1) for every 100 square feet of floor area
    Daycare, Dance, and Similar Businesses
    One (1) for each employee, one (1) for every five (5) children
    Church and Other Places of Religious Worship, Auditorium, Theater, or Sports Arena
    One (1) for every five seats. For areas having fixed benches or pews, the occupant load shall not be less than the number of seats based on 1 person for every 18 inches of length of the pew or bench in the main area of occupancy
    Hospitals
    One (1) for every 1,000 square feet of gross floor area
    Convalescent, Assisted Living, Nursing, or Rest Home, Sanitarium or Home for the Care of Children or the Aged
    One (1) for every 2 beds, plus one (1) for every 2 doctors assigned full-time to the staff, plus 2 parking spaces for each 3 other employees
  3. For all new or expanding buildings, including multi-use facilities, the proponent is required to produce a proposed or anticipated parking load for their building/business to include parking for their employees. The parking plan shall be approved or disapproved by the Planning and Zoning Commission.

17.36.110 Parking Standards

  1. Wheel Blocks: Whenever a parking lot extends to a property line, wheel blocks or other suitable devices shall be installed to prevent any part of a parked vehicle from extending beyond the property line.
  2. Joint Use: Two (2) or more nonresidential uses may jointly provide and use parking spaces when their hours of operation do not normally overlap, provided that, a written agreement approved by the permit administrator shall be filed with the application for a building permit and/or business license.
  3. Parking spaces shall adhere to the following dimensions:

17.36.120 Required Loading Zones

  1. Any newly constructed commercial/industrial building requiring shipments in or out shall be required to have a loading area.
  2. Loading areas shall not be permitted to encroach upon any public property, including the right of way.
  3. Parking areas shall not double as loading areas during regular operating hours.

17.36.130 Fines For Violations

Unless otherwise specified in this code, any violation shall be punishable by the general punishment found in 17.52.
