POWERS AND DUTIES OF PLANNING BODIES1

This article identifies the bodies, officials, and administrators with designated responsibilities under the Zoning Ordinance.

The Community Development Director ("Director") or his/her designee, including the Planning Director or Manager, shall have the powers and duties including, but not limited to:
A.
Administering the provisions of this ordinance. Other City officers and employees shall assist the Zoning Administrator in this duty.
B.
Preparing the forms necessary for the administration of the ordinance.
C.
Determining required materials for application submittals and evaluating completeness.
D.
Preparing reports and recommendations to advisory committees, Planning Commission and City Council.
E.
Delegating administrative functions as deemed appropriate and necessary to members of the Planning Division.
F.
Making interpretations as described in Section 41.12 (Interpretations).

The Zoning Administrator shall have the powers and duties assigned by the City Council or City Manager, including, but not limited to:
A.
Holding a public hearing as required.
B.
Making decisions on applications subject to Zoning Administrator review.
C.
Issuing Notices of Official Action on applications per Article 41 (Common Procedures).
D.
Referring items to Planning Commission in lieu of making a decision on an application where the public interest would be better served by Planning Commission review and decision.

The Planning Commission shall have the powers and duties assigned by the City Council, including but not limited to:
A.
Holding a public hearing as required.
B.
Making decisions on applications subject to Planning Commission review.
C.
Making recommendations to City Council on General Plan and Zoning Ordinance amendments, new or amended specific plans or precise plans.
D.
Making determinations or recommendations on applications requiring a Negative Declaration, Mitigated Negative Declaration or Environmental Impact Report (EIR).
E.
Appointing members of the public to the Historic Resources Advisory Committee and Architectural Advisory Committee.
F.
Appointing a member of the Planning Commission as a member of the Subdivision Committee.

The Architectural Advisory Committee shall have duties as specified in Municipal Code Section 2.110 (Architectural Advisory Committee).

The Historic Resources Advisory Commission shall have powers and duties as specified in Municipal Code Section 40.5 (Powers and Duties of Commission).

The Subdivision Committee shall have powers and duties as specified in Municipal Code Section 30.6 (Functions of the Subdivision Committee).
