15.01 General

15.01.01 Title

This ordinance shall be known as the "Rocky Ridge Town Zoning Ordinance" and may be so cited and pleaded.

15.01.04 Scope Of Ordinance

This ordinance is designed and enacted in accordance with a master plan for Rocky Ridge Town and to designate, regulate and restrict:

  1. The use of land;
  2. The erection, construction, reconstruction, alteration, location and uses of buildings;
  3. The height, size and bulk of buildings and other structures hereafter erected or altered;
  4. The size of lots, courts, yards and other open spaces and the percentage of the lot that may be occupied;
  5. The height, bulk and location of objects of natural growth where such objects are deemed hazardous to life or property;
  6. The density and distribution of population.

15.01.05 Interpretation

In interpreting and applying the provisions of this ordinance the requirements contained herein are declared to be the minimum requirements for the purposes set forth, unless otherwise specifically stated. If in the course of administration hereof, a question arises as to the meaning of any phrase, section, chapter, or zone boundary, the Planning and Zoning Commission is empowered to interpret the ordinance. In the event that there is a need of further interpretation by any person, firm or corporation or official of Rocky Ridge Town the question shall be submitted to the Board of Adjustment who is authorized to interpret the ordinance, as provided for in this ordinance. Where the question is still unsatisfied, the applicant may either apply for an amendment to this ordinance to clarify the portion thereof which is in question or may file a petition with the District Court for final interpretation.

15.01.06 Separability And Validity Clause

If any chapter, section, subsection, sentence, clause, phrase, or part of this ordinance is for any reason held invalid by a court of competent jurisdiction, such judgement shall not affect, impair, or invalidate the remaining, provisions of this ordinance but shall be confined in its operation to the specific chapter, section, sentence, clause, or part of this ordinance held invalid, and shall not affect the validity of the remaining portion of this ordinance in any other instance.

15.01.07 Effect Of Other Ordinances And Regulations

Wherever higher or more restrictive standards are established by the provisions of any other applicable statute, ordinance, or regulation than are established by the provisions of this ordinance, the provisions of such other statute, ordinance, or regulation shall govern.

15.01.11 Compliance Regarding Violation

Whenever a violation of this ordinance occurs or is alleged to have occurred, any person may file a written complaint. Such complaint stating fully the causes and bases thereof shall be filed with the Planning and Zoning Commission who shall record properly such complaint and timely investigate and take action thereof as provided  by this ordinance.

15.01.12 Penalties

Any person, firm, corporation, whether as principal, agent, employee, or otherwise, violating any of the provisions of this ordinance or requirement or decision of the Board of Adjustment shall be guilty of a Class C misdemeanor, and upon conviction thereof by a court of competent jurisdiction shall be punishable to the full extent allowed by law.
