15.40 Sign

Regulations

15.40.01 Definitions

"SIGN"

Any device designed and intended to bring the subject thereof to the attention of the public; provided, however, that the following shall not be included in the application of the regulations herein:

  1. Flags or insignia of any government, except when displayed in connection with a commercial promotion;
  2. Legal notices, traffic regulation signs, and signs used for identification of public structures and facilities and informational purposes, when erected by a governmental body; and
  3. Signs directing and guiding traffic and parking on private property but bearing no advertising matter.

"Accessory"

A sign which directs attention to merchandise, service, business or profession conducted on the premises of the sign’s location.

"Advertising"

A sign which directs attention to a use, product, commodity or service not related to the premises.

"Banner"

Any sign made of cloth, plastic or similar fabric material, with no enclosing framework, that is mounted to a pole or building.

"Business"

A sign which directs attention to a use conducted, product or commodity sold, or service performed upon the premises.

"Canopy"

Any sign that is part of or attached to an awning, canopy or other fabric, plastic or structural protective cover over a door, entrance window or outdoor service area.

"Fascia"

A sign attached to or erected against a wall or building with the face parallel to the building wall.

"Freestanding Monument"

An accessory sign, not attached to or part of a building, and having a height of nine feet (9') or less.

"Freestanding Pylon"

An accessory sign, not attached to or part of a building, and having a height greater than nine feet (9').

"Nameplate"

A sign indicating the name and/or occupation of a person or persons residing on the premises or legally occupying the premises, or indicating a home occupation legally existing on the premises.

"Nonaccessory Sign/Billboard"

A sign which directs attention to a business, commodity, service, or entertainment conducted, sold or offered elsewhere than on the premises, and only incidentally on the premises, if at all.

"Portable"

A sign not permanently attached to the ground or building or a sign designed to be transported, including, but not limited to, signs designed to be transported by means of wheels; A-frame and T-frame signs; balloons used as signs; banner signs; and signs attached to, displayed upon or painted on vehicles parked and visible from the public right of way, unless the vehicle is used in the normal day to day operation of the business.

"Projecting"

A sign attached to a building or other structure and extending in whole or in part more than fifteen inches (15") away from the wall or the building or structure.

"Property"

A sign related to the property on which it is located and offering such property for sale or lease, or advertising contemplated improvements, or announcing the name of the builder, owner, designer or developer of the project, or warning against trespassing, etc.

"Public Information"

A sign erected by a public or nonprofit agency, service club, etc., giving information to direct the public to both public and private facilities and major uses.

"Sign Face Area"

That area enclosed by one continuous line connecting the extreme points or edges of those portions of a sign containing text, lighting or logo, together with any frame or material which forms an integral part of the display, but not including the necessary support uprights on which the sign is placed. Where the sign consists of open letters or symbols, the area shall be considered to be that of the smallest parallelogram or triangle which encompasses all the letters or symbols. The area shall be determined using the largest silhouette usable at any one time. Freestanding or projecting signs having parallel planes not more than twenty four inches (24") apart shall be considered as a single sign both as to number and area.

"Temporary"

Temporary signs shall include any sign, banner, pennant or advertising display constructed of cloth, canvas, light fabric, cardboard, wallboard or other light materials, with or without frames, intended to be displayed for a short period of time only.

15.40.02 Requirements

The purpose of this section is to provide standards and requirements relating to the location and design of accessory signs and similar structures.

  1. Permitted Signs In All Zone Districts. The following accessory signs shall be permitted in all zones; provided, that no sign shall be positioned in such a manner as to result in the creation of an unsafe visual clearance at any intersection or driveway location.
    1. Signs Not Requiring A Permit: The following signs shall be permitted without the necessity of requiring a permit:
      1. Real estate sales signs: One sign per street frontage advertising the sale, rental, or lease of the premises, provided that such signs shall not exceed six (6) square feet in residential zones or eight (8) square feet in other zones.
      2. Political signs: Signs for the purpose of promoting the candidacy of any person or persons seeking public office or measures on election ballots, provided that such signs shall be removed within seven (7) days following the election.
      3. Produce signs: One accessory sign announcing the sale of locally produced agricultural products, provided that such signs shall be removed at the end of the local season for said produce.
      4. Unlighted identification nameplates accessory nameplates: Accessory nameplates for professional persons or home occupations, which shall not exceed two (2) square feet.
      5. Governmental signs: Signs erected by a governmental unit for regulatory or informational purposes, such as traffic signs, street signs, and public notices.
      6. Public signs: Signs of a nonadvertising nature intended to identify a condition or provide information to the public, such as public utility information signs, safety and danger signs, "no trespass" signs, and entrance and exit signs, provided no sign shall exceed two (2) square feet in area.
    2. Signs Requiring A Permit: The following temporary and permanent accessory signs shall be permitted in all zones upon the acquisition of a permit therefor:
      1. Building project identification signs: One sign per street frontage of a building which is under construction or structural alteration or repair, announcing the character of the building enterprise or the purpose for which the building is intended, including names of architects, engineers, contractors, developers, financiers, and others, provided the area of such sign shall not exceed sixteen (16) square feet in residential districts or thirty two (32) square feet in other districts, and provided the sign shall be removed upon completion of construction.
      2. Subdivision project identification signs: One sign per street entrance to the subdivision located on the property to be subdivided, provided such sign shall not exceed thirty two (32) square feet in area. Such a sign may not be erected until the subdivision has received final approval by the appropriate Town officials and may be displayed for a period of one year from the date of such approval, or until all lots are sold, whichever is less.
      3. Development project identification signs: A sign denoting the name of any apartment structure containing five (5) or more units, or the name of any residential, commercial or industrial complex provided such sign shall not exceed twelve (12) square feet in area.
      4. Directional and public services signs: Signs which identify or provide direction to scenic or historic areas or points of interest, public buildings, sports facilities, etc., or signs which serve as community entrance signs, or which convey community service information, provided, that no such sign shall have a sign face exceeding twenty four (24) square feet, except when approved by the Town Council.
      5. Institutional identification signs: One sign, with or without a changeable text bulletin board, located on the premises and denoting the name of the public building, school, or charitable or religious institution; provided, that such signs shall contain a sign face area of not more than twenty four (24) square feet and the design and location of any such sign shall be first approved by the planning commission.
  2. Additional Signs And Requirements. In addition to the signs permitted under subsection A of this section, the following accessory signs shall be permitted in the Town, subject to the conditions specified and the prior acquisition of a permit therefor:
    1. Fascia And Canopy Signs: Accessory fascia and canopy signs identifying and advertising the names of the business, the products sold, trade names and/or the business or activity conducted, subject to the following:
      1. There shall be not more than two (2) signs per building street frontage. Where a building fronts on more than one street, each street shall be considered a separate frontage.
      2. Where a building contains more than one owner or tenant (e.g., strip mall), the portion applicable to each owner/tenant shall be considered as a separate building street frontage.
      3. The maximum sign face area of all fascia and canopy sign(s) shall be determined by the size of the building face, or that portion of the building face occupied by an owner/tenant (in the instance of a multi-tenant building), in accordance with the provisions of figure 1 in subsection 15.40.030A of this chapter.
      4. Each sign shall be painted upon or attached to the wall of the building most nearly parallel to the applicable fronting street. No portion of the sign shall project more than fifteen inches (15") from the vertical face of the building to which it is attached.
      5. The sign shall not extend above the roofline of the structure to which it is attached.
    2. Projecting Signs: Accessory projecting signs identifying and advertising the name of the business, the products sold, trade names and/or the business or activity conducted subject to the following:
      1. There shall be not more than one projecting sign for each owner/tenant. Each sign shall be attached to the building face adjacent to the portion of the building face occupied by the owner/tenant to which it applies.
      2. The sign shall not extend above the wall to which it is attached.
      3. No projecting sign shall exceed thirty (30) square feet in area. Also, where the owner/tenant utilizes the fascia or canopy sign, the combined total of the projecting sign and fascia or canopy sign shall be not greater than the maximum area allowed for fascia or canopy signs in accordance with the provisions of figure 1 in subsection 15.40.030A of this chapter.
      4. No such sign shall be placed above or project into the air space above a public right of way.
      5. The sign shall have a minimum clearance of twelve feet (12') above the ground and fourteen feet (14') above a driveway, alley or other vehicular accessway.
    3. Freestanding Pylon And Monument Signs: Permanent accessory, freestanding pylon and monument signs identifying and advertising the name of the business, the products sold, trade names and/or the business activity conducted may be erected upon the premises occupied by the business, subject to the following:
      1. Each project area may include one freestanding pylon sign.
      2. Each sign shall have a maximum of two (2) sign faces. The maximum area of each sign face shall be determined by the length of the street frontage along with the signs to be placed in accordance with provisions of figure 2 in subsection 15.40.030B of this chapter.
      3. The maximum height of any pylon sign shall be thirty five feet (35') above the adjacent ground level.
      4. No portion of any sign shall project into the air space above a public right of way.
      5. Where the project area fronts upon two (2) or more public streets, a freestanding monument sign may be constructed adjacent to each street frontage, not including the frontage upon which the pylon sign is constructed. Each freestanding monument sign shall have a maximum of two (2) sign faces. Each face shall have a maximum sign face area of not more than sixty (60) square feet and shall be designed and constructed in accordance with figure 3 in subsection 15.40.030C of this chapter.
      6. No freestanding pylon or monument sign shall be placed or constructed in such a manner as to produce an unsafe visual clearance at any intersection or driveway location or closer than ten feet (10') to ground level.
      7. A freestanding monument sign may be substituted for the freestanding pylon sign permitted pursuant to this subsection B3.
  3. Signage Plan Required. Any commercial or industrial development project which requires approval of a site plan by the planning commission, pursuant to the terms of the Town’s development code, shall include a signage plan, showing the intended location of all freestanding signs and the general design and maximum size of each proposed sign, as part of the materials required to be submitted for review by the planning commission. No freestanding pylon sign, monument sign or project identification sign will be permitted unless the location of such sign and the design thereof shall have been approved as a part of the site plan.
  4. Prohibited Signs. Except as specified herein, the following signs shall be prohibited within the Town:
    1. Nonaccessory Signs/Billboards: Nonaccessory signs shall not be permitted within the Town.
    2. Temporary Signs: Except as may be specifically authorized by other provisions of the development code, temporary signs shall not be permitted.
    3. Hazardous Signs: Any sign which purports to be or resembles an official traffic sign or signal or which is constructed or maintained in such a manner as to conflict or be confused with an official traffic sign or signal. Any sign with intermittent or flashing illumination, animated, or moving signs. Signs that emit a sound.
    4. Banner Signs: Permanent banner signs shall be prohibited, except that banner signs may be permitted on a temporary basis in the instance of a new or relocated business establishment until such time as the permanent signs have been installed, but not to exceed ninety (90) days.
    5. Portable Signs: Portable signs shall be prohibited, except that portable signs may be permitted on a temporary basis in the instance of a new or relocated business establishment until such time as the permanent signs have been installed, but not to exceed ninety (90) days.
    6. Political Signs: Political signs in public rights of way or public property.
    7. Painted Signs: Signs mounted, attached, or painted on trailers, boats, or motor vehicles when parked for extended periods of time on or near the premises.
    8. Roof Signs: Roof signs, or signs that project above the highest point of the roofline or parapet of the building.
    9. Garage Sale/Handbill Signs: No person shall paint, mark, write on, post or otherwise affix any handbill or sign to or upon any public utility pole, streetlamp pole, street sign, traffic sign, tree, fence, hydrant, or stake.

Any handbill or sign found posted upon any public property contrary to the provisions of this subsection may be removed by the police department, zoning administrator or other person designated by the Town for that purpose. The person responsible for such posting shall be liable for the cost incurred in the removal, storage and/or disposal thereof and the Town is authorized to effect the collection of said cost.

15.40.04 Penalty

Any person violating any provision of this chapter shall, upon conviction, be subject to penalty.
