15.04 Administration

And Enforcement

15.04.01 Effect Of Chapter

This chapter affects the entire ordinance with respect to the Administration thereof and establishes the responsibility for such administration.

15.04.02 Administration And Enforcement

The Planning and Zoning Commission shall represent Rocky Ridge Town in carrying out the stated purposes of this ordinance and in so doing shall cause that all required permits be obtained by persons required to do so. The Planning and Zoning Commission or his agent shall not grant a permit for the construction or alteration of any building or structure if such construction or alteration would be in violation of any of the provisions of this ordinance. It shall be the duty the planning and zoning commission to inspect or cause to be inspected all buildings or structures in the course of construction, alteration or repair.

15.04.02 Administration And Enforcement

15.04.03 Building Permits Required

The erection of any building or structure or any part thereof, or any alteration of any existing building that would permit the extension or enlargement of any use therein, or the preparation of a building site, shall not be commenced or proceeded with, except after the issuance of a written permit on a form furnished by Rocky Ridge Town. The request for a building permit will be submitted according to the Town of Rocky Ridge Building Permit Application Policy Revised November  1, 2004.  Which by reference is made a part of this ordinance.

15.04.05 Certificate Of Occupancy

No land shall be changed in use or occupancy and no building shall be occupied, changed in use, or structurally altered until a Certificate of Occupancy shall have been issued by the Planning and Zoning Commission. A like certificate shall be required for the purpose of maintaining, renewing, changing, or extending a nonconforming use, and also as a prerequisite to the application and/or receipt of a business license.

  1. No Certificate of Occupancy shall be issued unless the contemplated use of the land and/or buildings for which said Certificate is requested is in full compliance with the requirements of this ordinance and said Certificate bears thereon the approval of the Planning and Zoning Commission or his agent.
  2. Limitation - Effect of Certificates.
    1. Unless a Certificate of Occupancy shall have been issued or approval otherwise given as provided for herein, it shall be unlawful for any person, firm or corporation to make connection to or furnish water or electrical service for any new building except for temporary use incidental to construction.
    2. After such Certificate has been issued, unless proved to be in error within one year of the date of issue, the building or part thereof to which it applies shall be deemed to be in full compliance with requirements hereof.

15.04.06 License And Permits To Conform With The Zoning Ordinance

All officials and employees of Rocky Ridge Town who are vested with the duty or authorized to issue permits and licenses shall conform to the provisions of this ordinance and shall issue no permit or license for use, building, or purpose where the same would be in conflict with the provisions of this ordinance. All applicable permits and licenses shall be approved by the Planning and Zoning Commission or his designee. Any such permit, or license, if issued in conflict with the provisions of this ordinance, shall be null and void.

15.04.07 Powers And Duties Of Planning And Zoning Commission

It shall be within the power and authority of the Planning and Zoning Commission to inspect or cause to be inspected all plans for the construction or repair of buildings, to visit all buildings in the course of construction, to enforce or cause to be enforced all of the provisions of this ordinance pertaining thereto, particularly with respect to the location requirements, to uphold and enforce any decision in the administration of this ordinance entering actions in the court  when necessary; failure to do so shall not legalize any violation of such provisions. Also where any building, sign or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained or where any building, structure, or land is used in violation of this ordinance or any amendment thereto, the 
Planning and Zoning Commission, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use to restrain, correct, or abate such violation, to prevent the occupancy of such building, structure or land, or to prevent any illegal act, conduct of business,or use in or about such premises.

15.04.08 Moratoriums

The Planning and Zoning Commission with approval of the Town Council may from time to time declare a moratorium on any building or development in the town of Rocky Ridge or in particular areas of the town, as needed to preserve and promote the health, safety, convenience, orderly growth and the general welfare of the Town of Rocky Ridge.

15.04.09 Board Of Adjustments

A group of five individuals residing in Rocky Ridge and appointed  by the Mayor with the advice and consent of the Town Council  will function  as the Rocky Ridge Town Board of Adjustments.

Decisions of the Town council or Planning and Zoning Commission, may be appealed to the Board of Adjustment by filing such appeal with the Town Clerk within 15 days after the Town Council or 
Planning and Zoning Commission decision. The Board of Adjustment may grant a variance, uphold or reverse the decision of the Town Council or Planning and Zoning Commission and impose any 
additional conditions that it may deem necessary in granting an appeal. The decision of the Board of Adjustment shall be final. A conditional use permit affirmed by the Board of Adjustment shall be effective immediately.
